MAYOR'S REPORT Mayor Juracek welcomed Bethany Miller from Scout Troop 105, who is working onearning merit badges. 3.1 PROCLAMATION: Honoring Maria McCarthy on her Retirement as 3rd District Supervisor of the Cook County's State's Attorney Is Office Mayor Juracek read the proclamation into record. Ms. McCarthy stated she is honored to receive this recognition and recognized Chief John Koziol and the entire Police Department for their outstanding service to the community. 3.2 A RESOLUTION FOR THE HOLIDAY SEASON Mayor Juracek presented a resolution for the holiday season. On behalf of the Village, Ms. Kane thanked the Lions Club for their generous donation. Emerson Street / 1st reading of an ORDINANCE REGULATING CANNABIS BUSINESS ESTABLISHMENTS IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS Mayor Juracek introduced the ordinance regulating cannabis business establishments in the Village and stated the ordinance will stand as a first reading. The second reading will take place on Tuesday,, December 10. Assistant Village Manager Nellie Beckner presented background information on the subject ordinance. Public Act 101- 0027, which creates the Cannabis Regulation and Tax Act (the "Act"), was signed in to state law on June2019 by the Illinois General Assembly and goes into effect January 1,, 2020. The Act legalizes the sale of adult use recreational cannabis and regulates possession, sale, and consumption. It also defines the various types of cannabis business establishments and regulates each. Trailer Bill SB 1557, passed by the State on November 14, 2019,, helps clarify certain ambiguity contained in the Act. The Village must decide to either Opt -in,, which will allow the sale of recreational cannabis as described in the Act in the Village of Mount Prospect or Opt -out, which prohibits all cannabis business establishments as well as on-site consumption within the Village. Ms. Beckner stated several public meetings were conducted dedicated to the discussion of the subject draft ordinances. Recommendations to Opt -in were received from the Finance Commission and the Economic Development Commission. On November 14, 2019, a public hearing was held at the Planning and Zoning Commission relating to the regulation of the sale of recreational cannabis. The Planning and Zoning Commission voted 6-0 in favor of the proposed recreational cannabis zoning regulations. Ms. Beckner provided details pertaining to the Trailer Bill and identified key items worth noting. The Bill clarifies social sites and defines conditions relating to on-site consumption. The Act will allow on-site consumption of cannabis at or in a dispensing location or tobacco store. Cannabis dispensing establishments would be a conditional use in the B3 and Il zoning districts; no such establishment would be a permitted use anywhere in the Village. In conjunction with the liquor code restrictions, a 11 •• restriction on any cannabis business establishment from any public or private school, church/place of worship or hospital. Ms. Beckner noted an applicant for a cannabis business establishment must first obtain a license from the State of Illinois. Should the Village approve the Opt -in ordinance,, staff recommends approval of a taxation ordinance that allow for a tax of 3% of the gross receipts of all cannabis sold in the Village. The Opt -in budget impact is estimated at approximately $440,000 in annual revenue, should the proposed taxation ordinance be adopted. Ms. Becker stated the Village has provided the public with several opportunities to share in the discussions and process including: • site portal dedicated the recreational cannabis • Five (5) formal meetings • Up-to-date information shared via social media and the Village website • Email address established solely for the discussion of cannabis; as of December 3,, 201 9,, staff received 26 emails in favor and 12 against the sale of recreational cannabis. Ms. Beckner stated Village staff is recommending approval of the Opt -in ordinance and related Taxation ordinance. A discussion followed. Staff.provided the following in response uestions from the YJlage Board: Billboards are prohibited in the Village of Mount Prospect Signs identifying a business are not considered advertising Signage is closely regulated in the Act with many limitations; i.e. pictures or illustrations depicting a bud or lea are prohibited. The Village can implement additional regulations. Advertising is limited to medical use; the conditional use process required by the Village will include and define signage parameters A decision to Opt -out will still require our police officers to be fully trained by Drug Recognition Experts (Mount Prospect Police Department currently has two DREs on staff) Public Comment: Louis Goodman 310 N. School St. • Supports to Opt -in, adding the additional revenue would be beneficial to the Village. • Mr. Goodman asked if an Opt -out decision is reversible after January 1st. Ms. Beckner added that the Act includes regulations for minimumlmaximum product content and an ingredient list must accompany the product to be sold. Board Comments Use of funds from the sale of recreational cannabis should be used for education, training and to fund pensions • Importance of fully training our police officers was noted • Should not justify the use of funds with public education; this needs to occur either way • Consideration of how this will affect the Village brand; does opting -in send the wrong message about our community? • Residents of Mount Prospect will use the product whether it is sold in our Village or not; will not affect our brand •% of Mount Prospect residents who voted in the 2018 Cook County advisory referendum voted in favor of advising the state of Illinois to legalize adult use of recreational cannabis. • Responsibility as trustee to be the voice of the community • Questioned how a decision to Opt -in will benefit our community - Mr. Cassady responded, stating legalization will negatively impact illegal drug cartels. Mayor 3uracek added a cleaner, safer product not obtained by the drug cartels, will result. Mayor Juracek summarized the evening's discussion. Staff was directed to add language to the tax ordinance that directs and specifies the use of proceeds from the sale of recreational cannabis. No other changes were identified. Mayor Juracek stated the second reading will take place on Tuesday, December 10,, 2019 at a Special Meeting of the Village Board. S. VILLAGE MANAGER'S REPORT No report. 9. ANY OTHER BUSINESS None 10.
