HomeMy WebLinkAboutOrd 2332 12/21/1971 i" ORDINANCE NO. 2332 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY LOCATED AT 604 W. CENTRAL ROAD, MOUNT PROSPECT, ILLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect diq meet on the 18th day of November, 1971, at the hour of 8:00 p.m. in the Village Hall of Mount Pros'pect and did hear Case No. 7l-38A, pursuant; to legal notice published in the Mount Prospect Herald on November 3, 1971; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear a petition requesting variations from the requirements of th~ Mount Prospect Zoning Ordinance concerning front yard lot size and individual side yard -- so that the petitioner might construct an addition to the existing lumberyard and building at this location; and WHEREAS, the Board of Appeals of the Village of Mount Prospect has recommended to the President and Board of Trustees the granting of th~ variations requested under Case No. 7l-38A for reasons that: 1. There is a practical difficulty and particular hardship on the petitioner in that this 1.7 acre parcel has been utilized as a lumberyard and is zoned I-I, which zoning district allows such lumberyards but requires four (4) acre minimum lots with a thirty (30) foot setback and an ;industrial side yard of not less than thirty (30) feet; 2. The purpose of the variations is not based exclusively on a desire to make money; 3. The plight of the owner is due to unique circumstances in that the land is so located that additional acreage is not available, since contiguous land has been im- proved with office buildings, railroad tracks, and a storage yard -- the office building immediately adjacent to the west having no front yard setback whatsoever; 4. The alleged difficulty or hardship has not been created by any person presently having an interest in the property; S. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the. congestion in the public streets, or increase the danger of fire, or endanger the public safety, or sub- stantially diminish or impair property values within the neighborhood; and 6. The granting of the variations will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the President ,and Board of Trustees of the Village of Mount Prospect on December 7, 1971, have reviewed Case No. 7l-38A and have concurred with recommendations of the Board of Appeals to grant these variations; and ! WHEREAS, the President and Board of Trustees o~ the Village of M04~t Prospect have determined that the matters here1n are for the best 1nter~ ests of the Village of Mount Prospect; ~.. - -- y ".~----~ ---,--- :-_-- :'~_- ~>;, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 71-38A, being legally described as follows: The West 282.52 feet of Lot Three (3) of Charles Behlendorfts Division of the Southwest Quarter (1/4) of the Northwest Quarter (1/4) and the West 10.58 chains of the Southwest Quarter (1/4) of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian (except the right-of~way of the Chicago and North Western Railway Company) in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as 1-1 (Light Industrial), which zoning classification shall remain subject to the variations granted hereinbelow: That industrial side yard requirement for this property shall be eliminated to such extent as to permit the open storage pf lumber and other building materials ~s has been the custom and usage thereof prior to the petition herein; That the addition to the existing building shall be in accord with the plans and specifications therefor attached hereto and made a part hereof as Exhibit A. That the developer and/or owner provide sufficient on-site detention for storm water pursuant to plans approved by the Village Engineer. SECTION -TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECTION ONE heretofore mentioned. (a) (b) (c) (d) i (e) That the 1.7 acre size of the subject property shall be sufficient to construct this I-I (Light Industrial) lumber~ yard use; That the front yard setback requirement for this property shall be eliminated entirely; SECTION THREE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, pub- lication and such time as an accurate plat resubdividing the parcel described in SECTION ONE above is recorded with the Recorder of Deeds of Cook County, Illinois, a copy of which plat of subdivision shall b~ . attached hereto and made a part hereof as Exhibit B. SECTION FOUR: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
