ORDINANCE NUMBER 2349
AN ORDINANCE CREATING THE DEPARTMENT OF CIVIL DEFENSE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Chapter 4 of the Municipal Code of Mount Prospect of
1957, as amended, be and the same is hereby further amended by adding
thereto an additional Article, Article X, establishing a Department of
Civil Defense; so that hereafter the said Article X shall be and read
as follows:
"ARTICLE X - DEPARTMENT OF CIVIL DEFENSE
SECTION 4.1001. Creation of Department - Appointment.
There is hereby established a Department of Civil Defense of the
Village of Mount Prospect which shall be under the jurisdiction
and control of the Village Manager, who shall appoint the Director.
A. This Department is created for the purpose of performing
such civil defense functions as shall be prescribed in
the State Civil Defense Plan and Program, and by such
order, rules and regulations as may be promulgated by the
Governor, with this Village, and outside its territorial
limits if required under any mutual aid agreement or compact
entered into under the provisions of the Illinois Civil
Defense Act of 1951, as amended.
B. This Department may be referred to as "the Local Civil
Defense Organization" to prevent, minimize, repair, and
alleviate attack, sabotage, or other hostile action, or
from natural disaster, in accordance with "The Illinois
Civil Defense Act of 1951", as amended.
C. All other members of the Local Civil Defense Organization
shall be appointed, or designated, by the Director. Every
member of the Local Civil Defense Organization may be
removed at any time by the Director.
SECTION 4.1002. Oath.
Every member of the Local Civil Defense Organization, and every
person who is appointed to serve in any capacity in connection
therewith, shall subscribe and file with the Director, the fol-
lowing oath, to be administered and attested to by an officer auth-
orized to take oaths in this State:
"I, , do solemnly swear (or affirm) that I will
support and defend and bear true faith and allegiance to the
Constitution of the United States and the institutions and facilities
thereof, both public and private, against all enemies, foreign and
domestic; that I take this obligation freely, without any mental
reservation or purpose of evasion; and that I will well and faithfully
discharge the duties upon which I am about to enter. And I do
further swear (or affirm) that I do not advocate, nor am I nor have
I been a member of any political party or organization that advocates
the overthrow of the Government of the United States or of this State
by force or violence; and that during such time as I am affiliated
with the Village Civil Defense Organization of the Village of Mount
Prospect, Illinois, I will not advocate nor become a member of any
political party or organization that advocates the overthrow of the
government of the United States or of this State by force or violence."

Sec"tion
4.1003. Powers and Duties of the Director.
Subject to the direction and control of the President and Board of
Trustees of the Village, the Director shall be responsible for the
organization, administration, training and qperation of the Local
Organization and of the members thereof.
A. He or his authorized representative shall preside at
meetings of the Civil Defense Board and shall be chief
executive officer of the Local Civil Defense Organization.
B. He shall have all the powers and shall perform all the
duties prescribed for the Director of a Local Civil Defense
Organization by the Illinois Civil Defense Act of 1951, as
amended.
c. The Director shall be ex-officio chairman of the Local Civil
Defense Organization. The Local Civil Defense Organization
shall meet at the call of the Director or his authorized
representative and shall advise him on all matters pertaining
to civil defense.
D. The Local Civil Defense Organization shall, from time to
time, recommend for adoption (or rescission) by the Mayor
and Board of Trustees of the Village of Mount Prospect,
such regulations as it may deem necessary or advisable in
order to provide for the accomplishments of the purposes of
this Ordinance and of the Illinois Civil Defense Act of
1951, as amended, including but not limited to:

4.1004.

The creation of separate departments for the performance
of the several functions of the Local Civil Defense
Organization;
2.
The assignment of each department of a member or members
of the Local Civil Defense Organization, and specifi-
cation of the number, and method of appointment, or
subordinates to serve in each department;
3.
The specification of the duties and functions of each
department, particularly with respect to preparation for
any emergency which may require the active interposition
of the Local Civil Defense Organization in order to
protect the community, and with respect to action to be
taken upon occurrence of any such emergency;
4.
The formulation of a plan of action, to be coordinated
with the State Civil Defense Plan and Program, and to
serve particularly the residents of this Village and of
any surrounding areas, if required by agreement between
the Local Civil Defense Organization and other similar
organizations.
5.
The adoption of provisions for organization, separately
or in cooperation with the State Civil Defense Agency, of
"mobile support teams", as defined in the Illinois Civil
Defense Act of 1951, and for recruitment of residents of
the Village for assistance in carrying out the plan or
program for civil defense.
Compensation for Services under Call by State Agency.
Every member of the Local Civil Defense Organization called to duty
by the Governor or the State Director of Civil Defense, pursuan~ to
Section 8 of the Illinois Civil Defense Act of 1951, shall rece1ve
for such duty the compensation to which he may be entitled under
that statute to be paid by the State, or by the village, subject to
reimbursement by the State.
Section
4.1005. Reimbursement by State.
The Village Treasurer shall receive and allocate to the appro-
priate funds any reimbursements by the State for expenses incident
to service of members of the Local Civil Defense Organization and
any other reimbursement made by the State incident to civil defense
activities.
Section
4.1006. Offices.
The Village Manager is authorized and directed to provide such
space in the Village Hall and elsewhere as may be available and
necessary for the accommodation of the Local Civil Defense
Organization, together with such clerical help as may be required."
SECTION TWO: That Article IV of Chapter 8 of the Municipal Code of
Mount Prospect of 1957, as amended, is hereby further amended in its
entirety, by providing for a succession of officers; so that hereafter
the said Article IV shall be and read as follows:
"ARTICLE IV - SUCCESSION OF OFFICERS
Section
8.401. Succession in the Event of Emergenc~.
A. In the event that an incumbent Mayor or in the event the Village
Manager is killed or rendered incapable of performing the duties
of such office or position, said office or position shall be
filled in the following fashion until such time as a successor
is named and takes office in the manner provided by law.
B. Any such vacancy shall be filled in the following order of
preference:
The Mayor; the remaining members of the Board of Trustees -
Senior Trustees utilized first and in alphabetical order if
two or more are of the same seniority; the Village Manager;
the Director of Civil Defense; the Chief of the Fire Department;
the Chief of Police.
Section
8.402. Powers and Duties.
The person(s) filling such vacancies as provided herein shall exercise
all the duties and powers of that position during the emergency
and until such time as a successor can be appointed or selected in
the manner provided by law."
SECTION THREE: That Ordinance No. 696, Ordinance No. 710, and Ordinance
No. 712 be and the same are hereby repealed.
SECTION FOUR: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner
provided by law.
