ORDINANCE NO. 2352
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED ON THE
NORTHEAST CORNER OF KENSINGTON AVENUE AND ELMHURST ROAD (ILLINOIS ROUTE 83)
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hold
a public hearing on April 27, 1972, at the hour of 8:00 p.m. in the
Mount Prospect Village Hall pursuant to proper legal notice; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 72-7A pertaining to a request to
erect an enclosed indoor sports complex on the south end of property
described hereinunder; and
WHEREAS, the Building Committee of the Board of Trustees of the Village
of Mount Prospect did meet on May 10, 1972, and did consider the recom-
mendations of the Board of Appeals under Case No. 72-7A; and
WHEREAS, the Building Committee recommended to the President and Board
of Trustees of the Village of Mount Prospect to allow the variations
as presented; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No.
72-7A, being legally described as follows:
Parcel 1
The West half of the Southeast quarter of
Section 27, Township 42 North, Range 11,
East of the Third Principal Meridian (ex-
cept that part thereof falling in a 100
foot strip conveyed to the County of Cook
by deed recorded May 6, 1941 as document
12674702 and filed May 6, 1941 as document
LR 895623, the center line of which is
described as follows: Beginning at the
Northwest corner of the Southeast quarter
of Section 27 aforesaid; thence East along
the North line of said Southeast quarter,
a distance of 550 feet to a point of curve;
thence in a generally Easterly direction
along a curved line tangent to said North
line of the Southeast quarter1 convexed
Northerly~ and having a radius of 24>>555.35
feet, a distance of 1028.57 feet to a point
of tangency, thence in a generally Easterly
direction along a straight line tangent to
the last described curved line a distance
of 165.03 feet to a point of curve; thence
in a generally Easterly direction alo~g a
curved line tang~nt to tho last descrIbed
straight lino. convoxed Southerly, and
having a radius of 24,555.35 feet, for a
distance of 1028.57 feet); also

The West 460 feet, as measured along the
North line, of the East half of the Southeast
quarter of Section 27, Township 42 North,
Range 11, East of the Third Principal Meridian
(except that part thereof falling in a 100
foot strip conveyed to the County of Cook by
deed recorded October 8, 1941 as document
12771139, the center line of which is des-
cribed as follows: Beginning at the North-
west corner of the Southeast quarter of
Section 27 aforcsaid; thence East along the
North line of said Southeast quarter, a
distance of 550 fcet to a point of curve;
thence in a generally Easterly direction
along a curved line tangent to said North
line of the Southeast quarter, convexed
Northerly} and having a radius of 24,555.35
feet, a distance of 1028.57 feet to a point
of tangency; thence in a generally Eastcrly
direction along a straight line tangent to
the last described curved line, a distance
of 165.03 feet to a point of curve; thence in
a generally Eastorly diroction along a curved
line tangent to the last described straight
line, convexed Southerly, and having a rad:'Js
of 24,555.35 feet, for a distance of 1028.57
feet; and also except the North 70 foet of
the West 70 feet of the South 120 feet of
said East half of the Southeast quarter of
Section 27) all in Cook County, Illinois;
is currently' zoned under the Zoning Ordinance of the Village of Mount
Prospect as B-3 (Business - Retail and Service) which zoning classi-
fication shall remain subject to the following granted variations:
(a) That the owners of the land described above shall
have the right to construct an enclosed indoor sports
complex with twin ice rinks on a site located at the south-
eastern corner of "the Randhurst Shopping Cent'er, and that
such building shall be free-standing -- being in no way
connected or joined to the existing main shopping center
building thereon.
(b) That the aforedescribed sports complex shall be located
no closer to the lot lines and public utility easements than
as shown upon the survey attached hereto and hereby made a
part hereof as Exhibit A.
Cc) That the building design and layout shall be similar
to those "center core plans" attached hereto and hereby made
a part hereof as Exhibit B.
Cd) That the operation of the complex itself shall be
classified as providing a retail service and shall be li-
censed as such upon payment of the proper fees provided
for such business within Chapter 11 of the Municipal Code
of Mount Prospect.
SECTION TWO: That all other requirements of the Village Code of Mount
Prospect be applicable, except those variations as specified in SECTION
ONE heretofore mentioned.

SECTION THREE: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby directed to issue a building permit in
accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be
null and vOId and of no force and effect whatsoever unless an applica-
tion for a building permit pursuant to such variations is made and
construction commenced within one year of the date said Ordinance be-
comes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner
provided by law.
