George Street, as shown on the plans created by KAdd Associates, dated October 21, 2019. Public Content Information The Petitioners, Anna Soltys and Dariusz Zdanowski, propose to perform several site improvements, including constructing a larger attached garage. The current attached garage has just over a four and a half foot (4.54') side yard setback to the north. Thus, the primary structure is existing non -conforming. The proposed remodeled house, and larger attached garage would result in a two and a half foot (2.5') side yard setback. The property is zoned R -A Single Family Residential, and requires a five foot (5') side yard setback. A variation to deviate from the current setback standards set forth in the R -A Single Family Residential section of the Village Code is required. The property is not unique, as 10 of the 21 properties on the block of the Subject Property have an identical lot width of forty-eight feet (48'). The property allows for modifications to the architectural plans to accomplish additional garage space without requiring a variation to this extent; there is ample space in the rear of the property to construct a detached garage, or a side load attached garage. Additionally, per the non -conforming structure regulations in the Village Code, the Petitioner may construct a back to back (tandem) garage utilizing the existing non -conforming setback. The Public Works Department has also determined that granting the variation request could compromise the drainage for the property and surrounding properties. A two and a half foot (2.5') side yard setback is insufficient to insure a drainage flow path is maintainable. The Petitioner provided five letters in support of the variation request, including the adjacent neighbor to the north. https://go.boarddocs.com/iI/vomp/Board.nsf/Private 1/2 3/20/2020 BoardDocs® Pro At the Public Hearing held on December 12, 2019, after hearing no objections and four neighboring properties speaking in favor of the variance, the Planning and Zoning Commission recommended approval of the Petitioner's request for a variation by a vote of 4-2. The applicant is requesting a waiver of a second reading; request letter is attached. Alternatives 1. Deny the variation to allow a two and a half foot (2.5') side yard setback for 108 S. George Street, as shown on plans created by KAdd Associates, dated October 21, 2019. 2. Action at discretion of Village Board. Staff Recommendation Staff recommends that the Village Board deny the variation request, as it does not meet the standards for a variation. The requested setback would result in inadequate space for proper drainage to be maintained on the site. This case is Village Board final because the variation request exceeds twenty-five percent (25%) of the Zoning Ordinance requirement.
