Information
The redevelopment agreement between 20West, LLC and the Village of Mount Prospect, as amended, stipulates a
grant of license to utilize Village property for the purpose of satisfying the Metropolitan Water Reclamation District of
Greater Chicago (MWRDGC) stormwater volume control requirements.
Stormwater volume control requirements are facilities designed to capture the first inch of rainfall from a development
site. The first inch of rainfall usually contains the highest concentrations of pollutants. Capturing the "first flush" of
rainfall, ultimately improves the health of local waterways and can reduce the overall volume of rain water discharged
to local sewers. Volume control measures are required of all real estate development sites in Cook County larger than
a half -acre. These measures are permitted and enforced by the Metropolitan Water Reclamation District of Greater
Chicago in its role as the primary stormwater management agency for Cook County.
In this instance, the volume control facilities include permeable clay pavers installed upon a specialized stone base. A
perforated storm sewer is installed at the bottom of the backfill. The design is intended to collect rainwater and allow
it to percolate into the ground beneath the brick pavers rather than directly discharged to a local storm sewer.
For reference, a typical cross section depicting the volume control measures installed for the 20 West site is enclosed
as Attachment A.
Attachment A also includes a layout map depicting the volume control area. Please note that the volume control is
installed on 20 West property as well as property and public right-of-way owned by the Village.
In summary, the agreement grants 20West'LLC the right to use Village property for the purpose of operating and
maintaining MWRDGC-required stormwater volume control systems. It also stipulates maintenance, repair, and

replacement responsibilities for the volume control features. Notably, 20West, LLC, and all subsequent owners, will
be responsible for cleaning and sanding the permeable paver bricks, maintaining backfill, cleaning the underdrain, and
ultimately replacing worn components at end of useful life. The Village will provide snow removal and street sweeping
services in a manner and frequency consistent with other Village -owned streets. In addition, 20West is responsible for
regulatory compliance and coordinating annual inspections of the volume control system with Village staff.
The Long -Term Maintenance and License Agreement enclosed as Attachment B memorializes these terms. This
document, once executed, will be recorded against the title of parcels that comprise the 20West development at the
Office of the Cook County Recorder of Deeds.
Alternatives
1. Pass a resolution authorizing the execution of a long-term maintenance and license agreement for
stormwater volume control facilities.
2. Action at discretion of Village Board.
Staff Recommendation
Staff recommends that the Village Board pass a resolution authorizing a Long -Term Maintenance and License
Agreement between 20 West, LLC and the Village of Mount Prospect for the operation and maintenance of a
stormwater volume control system.
