ORDINANCE NO. 2358
AN ORDINAN~E GRANTING A HEIGHT VARIATION FOR PROPERTY
LOCATED WITHIN HUNTINGTON ESTATES
,
WHEREAS, the Board of Appeals o~ the Village of Mount Prospect did meet
on April 27, 1972, at the hour of 8:00 p.m. in the Mount Prospect
Village Hall p~rsuant to notice published in the manner provideQ by
law; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony under case No. 72-6A pertaining to a request for a variation
to allow the erection o~ two (2) buildings with a height of twelve (12)
stories; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect have.
repommended to the President and Board of Trustees the granting of the
variation requested under Case No. 72-6A for reasons that:
1. The purpose of the variation is by no means ba~ed on a
de$ire to make money;
2. The proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire, or endanger the public safety, or
otherwise substantially diminish or impair property values
within the neighborhood; and
3. The granting of the variation will not be detrimental to
the pqblic or injurious to surrounding property in that
it will not alter the essential character of the locality;
and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interest of the Village of Mount Prospect;
NOW, THEREFO~E, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No.
72-6A, be~ng ~egally described as follows:

That part of Lot 1 in Kenroy's Huntington, being a Subdivision
of part of the East 1/2 of Section 14, Township 41 North,
Range 11, East of the Third Principal Meridian, described as
follows: Commencing at the point of intersection of the West
line Of said Lot 1 (being the'West line of the NQrtheast 1/4
of the Southe~st 1/4 of Section 14 aforesaid) with the North
line of said Lot 1 (being the North line of the South 20.00
acres of the ~orthwest 1/4 of the Southeast 1/4 of said
$ect~on 14); thence South 88 degrees 59 minutes 01 seconds
West, 660.00 feet, along the aforesaid North line of said Lot 1;
Thence South 1 degree 00 minutes 59 seconds East, 100.00 feet,
along a line perpendicular to said North line, to the place of
beginning of the following described parcel of land; thence
South 13 degrees 01 minutes 00 seconds East, 163.573 feet;
thence South 10 degrees 59 minutes 00 ,seconds West, 163.573

Thence Northeasterly along said North line of the easement 321.89
feet, said North line being the arc of a circle of 1201.838 feet

Subdivision of part of the East 1/2 Of Section 14, Township 41
North, Range 11, East of the Third Principal Meridian, described
as follows: Commencing at the most Northwesterly corner of said
Lot; thence South 0 degrees 02 minutes 15 seconds West along the
West line thereof, 450.165 feet to the point of intersection with
a line drawn 450.00 feet (measured perpendicularly) South of and
parallel with the North line of said Lot, being the point of
beginning of the herein described parcel of land;
Thence North 88 degrees 29 minutes 07 seconds East along said

Thence Southwesterly 152.834 feet along the arc of a circle
of 12~.00 feet radius, convex to the Northwest and whose chord
bears South 35 degrees 20 minutes 49 seconds West to a point
of tangency with the West line of Lot 1, aforesaid; thence
North 0 degrees 02 minutes 15 seconds East along said West line
671.769 feet to the herein designated point of beginning, all
in Cook County, Illinois;
is currently zoned R-4 (Residential Development District) with a
Planned Unit Development under the Zoning Ordinance of the Village of
Mount Prospect, which zoning classification shall remain subject to the
following granted variations from Ordinance No. 2278 and other
applicable Ordinances of the Village of Mount Prospect:
That buildings 19 and 44 shown upon the Site Plan contained
in Ordinance No. 2278 (granting a Planned Unit Development
for the construction of Huntington Estates) be erected not
to exceed twelve (12) stores in height, pursuant to the
"Partial Revised Site Plan" attached hereto and hereby made
a part hereof as Exhibit A.
SECTION TWO: That all other requirements of the Village Code shall
continue to be applicable, except those height variations as specified
in SECTION ONE hereinabove mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby directed to issue a building permit in
accordance with the variations herein contained.
SECTION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an applica-
tion for a building permit pursuant to such variations is made and
construction commenced within one (1) year from the date this Ordinance
becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner
provided by law.
