ORDINANCE NO. 2360
AN ORDINANCE GRANTING A PARKING VARIATION FOR PROPERTY LOCATED
AT 107-109 WEST PROSPECT AVENUE.

WHEREAS, the Board of Appeals of the Village of Mount Prospect did hold
a public hearing on April 27, 1972, at the hour of 8:00 p.m. in the
Mount Prospect Village Hall pursuant to notice published in a newspaper
of general circulation within the Village of Mount Prospect; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear
testimony presented under Case No. 72-9A pertaining to a request to
construct at 107-109 West Prospect Avenue three (3) stores with only
six (6) parking spaces instead of ten (10) spaces as presently pro-
vided by ordinance; and
WHEREAS, the Board of Appeals r.ecommended to the Building Committee of
. the Board of Trustees of the Village of Mount Prospect to allow the
variation petitioned for because:
1. There is a practical hardship on the petitioner, since at
the time the property was rezoned to its present zoning
classification, parking requirements were less stringent;
2. The purpose of the variation is not based exclusively
upon the desire to make money;
3. The granting of the variation will not be detrimental
to the public or injurious to surrounoing property in
that it will not alter the essential character of the

locality; and
4. The proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire~ or endanger the public safety, or
otherwise substantially diminish or impair property values
within the neighborhood; and
5. The granting of the variation will not be detrimental to
the public or injurious to surrounding property in that
it will not alter the essential cha~acter of the locality; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that
the same is in the best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case
No. 72-9A, being legally described as follows:

Lots 18 and 19 in Busse's Resubdivision on Lots 1
to 6 inclusive in Block 4, also of Lots 2 and 3 in
Block 5, all of Block 6, Lots 13 to 24 inclusive in
Block 7, and Lots 17 to 20 in Block 8, all in Meier's
Addition to Mount Prospect, being a Subdivision in the
Northwest Quarter of Section 12, Township 41 North,
Range 11, East of the Third Pr~ncipal Meridian in
Cook County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as B-3 (Business - Retail and S~rvice District), which

zoning classification shall remain subject to the following granted
variation:
That the land described above may include the construction
and erection of a building to house th~ee (3) stores according
to the plans attached hereto and made a part hereof, and
that only six (6) parking spaces need be provided to serve
the above-described building.
SECTION TWO: That all of the requirements of the Village Code of Mount
Prospect be applicable except those variations set out in SECTION ONE
above.
SECTION THREE: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby authorized and directed to issue a building
permit in accordance with the variations and limitations hereinbefore
mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variation is made and construction
commenced within one (1) year of the date said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect
from and after its passage, approval, and pUQlication in the manner
provided by law.
