WHEREAS, the Board of Appeals of the Village of Mount Prospect I
did meet on the 12th day of July, 1972, at the hour of 8:00 P. M. I
in the Village Hall of Mount Prospect and did hear Case No. 72-18~
pursuant to legal notice published in the Mount Prospect Herald 'I'
on June 26, 1972; and

AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED
AT 14 E. BUSSE AVENUE IN ~1OUNT PROSPECT, ILL.

WHEREAS, the Board of Appeals of the Village of Mount Prospect I
did hear a petition requesting a variation pursuant to the re- I
quirements of the Mount Prospect Building Code and Zoning i
Ordinance in order to construct and operate a temporary building I
and to erect a fi ve (5) foot hi gh louvered fence; and I
WHEREAS, the Board of Appeals of the Village of Mount Prospect ha~
recommended to the President and Board of Trustees the granting 01
the building variation requested under Case No. 72-18A for reason
that:

1",1 WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that the matters herein are for
II the best interests of the Village of Mount Prospect;

There is a practical difficulty and particular hardship on
the petitioner;

The purpose of the variation is not based on any desire to
make money, the Mount Prospect Public Library being part
of a not-for-profit Municipal Corporation;
The plight of the petitioner is due to unique circumstance
in that there is an immediate need for additional space in
which the library employees may work without sufficient
time to plan and erect same;

The alleged difficulty or hardship has not been created by
any person presently having an interest in the property, I
but rather said hardship has been brought about through thl
annexation of some 10,200 additional residents;
The proposed variation will not impair an adequate supply I
of light and air to adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire, or endanger the public safety, or sub-
stantially diminish or impair property values within the
neighborhood; and

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case
No. 72-18A, being legally described as follows:

Lot Eleven (11) in Block four (4) in Busse and Wille's Re-
subdivision in Mount Prospect in the West half (1/2) of
Section 12, Town 41 North, Range 11, East of the Third
Principal Meridian. Lot Ten (10) in Block Four (4) in
Busse and Wille's Resubdivision in Mount Prospect in the
West half (1/2) of Section 12, Town 41 North, Range 11,
East of the Third Principal Meridian;

Ii is currently zoned under the Zoning Ordinance of the Village of
11: Mount Prospect as B-2 (Business-Office District), which zoning
I classification shall remain subject to the following variation

That the petitioner, Mount Prospect Public Library~ be
allowed to erect, construct, operate, and maintain a
temporary office building upon the above-described parcel,
which temporary construction shall be eliminated within on
year from the date this Ordinance is passed and approved. J
That the petitioner be allowed to erect a maximum five (5)
foot louvered fence for purposes of screening the temporar
building aforesaid from surrounding properties.
SECTION TWO: That all other requirements of the Mount Prospect
Building and Zoning Code shall be applicable except the variation
noted in SECTION ONE heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby directed to issue a building
permit in accordance with the variations hereinbefore mentioned.
I SECTION FOUR: That the variations granted by this Ordinance shall
I be null and void and of no force and effect whatsoever unless an
" application for a building permit pursuant to such variation is
I made and construction commenced within one (1) year of the date
I said Ordinance becomes effective.

SECTION FIVE: That this Ordinance shall be in full force and
effect from and after its passage, approval, and publication in
the manner provided by law.
