ORDINANCE NO. 2373
AN ORDINANCE GRANTING FRONT YARD AND SIDE YARD REQUIREMENT
VARIATIONS FOR PROPERTY LOCATED AT 700 SOUTH CANDOTA AVENUE,
MOUNT PROSPECT, ILLINOIS

I' WHEREAS, the Board of Appeals of the Village of Mount Prospect
did meet on the 27th day of July, 1972, at the hour of 8:00 P. M.,
I at the Mount Prospect Village Hall and did hear Case No. 72-23A,
I pursuant to proper legal notice; and

WHEREAS, the Board of Appeals of the Village of Mount Prospect
did hear this request for a front yard variation and a side yard
variation to allow the petitioner to expand his residence to
within thirty (30) feet of his front property line and to within
ten (10) feet of his side property line of the lot legally
described herein below; and

WHEREAS, the Board of Appeals of the Village of Mount Prospect
did recommend to the President and Board of Trustees the approval
of this request under Case No. 72-23A for the reasons that:
(1) There is a practical difficulty and
particular hardship on the petitioner;
(2) The purpose of the variations is not
based exclusively upon a desire to
make money;
(3) The conditions upon which the petition
for these variations is based are unique
in that its layout was not similar to
any other lot in the area, being of un-
usual physical shape; and
(4) The granting of these variations will
not be detrimental to the public or
injurious to surrounding property in
that they will not alter the essential
character of the locality; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have concurred with the recommendation of the Boar
of Appeals that the variations herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have deter-
mined that the same is for the best interests of the Village of
~~ount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

SECTION ONE: That the property being the subject matter of Case
No. 72-23A, being legally described as follows:
Lot 13 in Block 26 in Prospect Park Country
Club Subdivision of the South East Quarter
of Section 11 and the South 15 acres of the
East half of the North East Quarter of Sec-
tion 11, Township 41 North, Range 11, East
of the Third Principal Meridian, in Cook
County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of
Mount Prospect as R-l (Single-Family Residence), which zoning

shall remain in effect subject to the variations granted herein:
(a) That the front yard abutting the frontmost
lot line of the subject property may be re-
duced to twenty-nine feet ten inches (2911011);

(b) That the side yard abutting the adjacent lot be
reduced to seven feet six inches (71611).
SECTION TWO: That all requirements of the Mount Prospect Buildin
and Zoning Code shall be applicable except the variations noted i
SECTION ONE heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby authorized to issue a build-
ing permit for construction in accordance with the variations
hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an
application for a building permit pursuant to such variations is
made and construction commenced within one (1) year of the date
said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication in
the manner provided by law.
