ORDINANCE NO. 2375
AN ORDINANCE GRANTING A HEIGHT VARIATION FOR PROPERTY
LOCATED AT 1821 GOLF ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect
held a public hearing on August 24,1972, at the hour of 8:00 p.m.,
in the Mount Prospect Village Hall, pursuant to notice published
in the Mount Prospect Herald on August 4, 1972; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect
heard testimony presented under Case No. 72-28A pertaining to a re-
quest by DiMucci Home Builders, Inc., for certain variations from
the Mount Prospect Zoning Ordinance to permit the erection of an one
hundred (100') foot tower upon the property hereinafter described; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect
have recommended to the President and Board of Trustees that the re-
quested height variation be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter contained herein and believe
that the best interests of the Village of Mount Prospect will be served
by the granting of the said petition;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the following variation be and it is hereby
granted for the property which is the subject matter of Case No. 72-28A,
which property is legally described as follows:
Lot 659 in Elk Ridge Villa Unit No. 7A,
being a subdivision of part of the North
East 1/4 of Section 15, Township 41 North,
Range 11, East of the Third Principal Meri-
dian, in Cook County, Illinois;
(a) The terms of the Mount Prospect Building Code are
hereby varied so as to permit the construction and
erection of an one hundred (100') foot high tubular
television antenna support within the existing develop-
ment upon the subject property in a location which
will allow a full drop of the entire length of the
antenna and tower within the property lines of the
subject tract and without affecting any building
except the recreational center to which this tower
will be adjacent.
SECTION TWO: That the aforesaid variation will be valid and
effective only upon the performance and continuous maintenance with
respect to the subject property of the following conditions and re-
strictions:
(a)
That the base of the subject tower shall not be
located within two hundred fifty (250') feet of
any public right-of-way;

(b) That the base of the tower shall not be located
within two hundred (200') feet of aboveground
electrical wires; and
(c) That the antenna to be located on the subject
property shall in no way cause any interference
with radio or television reception to any other
properties in Mount Prospect.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby directed to issue a building permit
for the subject tower in accordance with the variation and limitations
herein set forth.
SECTION FOUR: That the variation granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an appli-
cation for a building permit, pursuant to such variation and restric-
tions contained herein, is made and construction commenced within one
(1) year of the date this Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and
effect from and after its passage, approval, and publication in the
manner provided by law.
