ORDINANCE NO. 2378
AN ORDINANCE GRANTING FRONT YARD REQUIREMENT VARIATION
FOR PROPERTY LOCATED AT 1409 SAUK LANE, MOUNT PROSPECT,
ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
meet on the 24th day of August, 1972, at the hour of 8:00 P. M.,
at the Mount Prospect Village Hall and did hear Case No. 72-25A,
pursuant to proper legal notice; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
hear this request for a front yard variation to allow the petition
er to construct a 241 x 241 garage to be attached to the front of
petitioner1s property, thereby expanding his residence beyond
thirty (3D') feet of his front property line of the lot legally
described h~rein below; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees the approval of
this request under Case No. 72-25A for the reasons that:
(1) There is a practical difficulty and
particular hardship on the petitioner;
(2) The purpose of the variation is not
based exclusively upon the desire to
make money;
(3) The conditions upon which the petition
for this variations is based rests in
the original development of the prop-
erty, which has a 411811 setback from
the street, versus a 301 lot line set-
back for all adjacent property.
(4) In order to construct a 2-car garage,
which is a necessity for the petitioner
within the confines of the road, it will
be necessary for him to build a long,
narrow drive and construct the 2-car
garage to the rear of his yard, which
is already restricted by the fact that
the residence is constructed with the
aforesaid 411811 front setback.
(5) The construction of the proposed
structure would not obstruct any
windows or doorways to the existing
building, inasmuch as the wall to which
it would be affixed is presently devoid
of windows and doors.
(6) The granting of this variation will not
be detrimental to the public or injurious
to surrounding property in that it will
not alter the essential character of the
locality; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have concurred with the recommendation of the
Board of Appeals that the variation herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have determined
that the same is for the best interests of the Village of Mount
Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case
No. 72-25A, being legally described as follows:
Lot 91 in Woodview Manor Unit No.1, being
a subdivision in the North half of the North
East 1/4 of Section 25, Township 42 North,
Range 11 East of the Third Principal Meridian,
plat recorded June 16, 1960, as Document No.
19883769, in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of
Mount Prospect as R-l (Single-Family Residence), which zoning
classification shall remain in effect subject to the variation
granted herein:
(a) That the front yard abutting the
frontmost lot line of the subject
property may be reduced to seven-
teen feet eight inches (1718").

SECTION TWO: That all requirements of the Mount Prospect Buildin~
and Zoning Code shall be applicable except the variation noted in
SECTION ONE heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby authorized to issue a build-
ing permit for construction in accordance with the variation
hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an
application for a building permit pusuant to such variation is
made and construction commenced within one (1) year of the date
said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and
effect from and after its passage, approval, and publication in
the manner provided by law.
