ORD INANCE NO. ~ 3 P ()
AN ORDINANCE AUTHORIZING THE PURCHASE OF
CERTAIN PROPERTY FOR RIGHT-OF-WAY PURPOSES
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have adopted Resolution No~~for the improvement of Main
Street (Illinois Route 83) from Evergreen Avenue north to Central Road
pursuant to recommendations contained in a traffic survey prepared for
the Village of Mount Prospect by Crawford, Bunte & Roden; and
WHEREAS, the Village of Mount Prospect has agreed to enter into an
agreement with the State of Illinois Division of Highways whereby the
aforementioned rights-of-way will be improved and upgraded pursuant to
the plans attached hereto and hereby made a part hereof as Exhibit "A";
and
WHEREAS, Page No. of said Exhibit "A" details the improvement for
the intersection or-central Road and Illinois Route 83 (Main Street),
showing the widening of said intersection to include left turn lanes,
as well as two traffic lanes for each direction of travel; and
WHEREAS, it has become necessary to acquire an additional seven feet
along the easterlymost line of Illinois Route 83 between the southerly
line of Central Road and a point 363.44 feet south of said southerly
line of Central Road; as well as an additional seven feet along the
southerlymost line of Central Road between the east line of Illinois
Route 83 and a point 314.33 feet east of said east line of Illinois
Route 83; and
WHEREAS, the acquisition of these lands is necessary for the improve-
ment of the aforementioned rights-of-way and payment for said lands
has been arranged.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That it is hereby determined that the intersection of
Central Road and Illinois Route 83 (Main Street) be improved pursuant
to the plans attached hereto and hereby made a part hereof as Exhibit
"A"; and furthermore, that such improvement is necessary and convenient
for public use.
SECTION TWO: That it is hereby determined that it is necessary and
desirable that the Village of Mount Prospect shall acquire title to
and possession of the following described real property, which said
real property is necessary, required, and needed for such improvement
to the intersection of Central Road and Illinois Route 83 (Main Street),
lying within the corporate limits of the Village of Mount Prospect,to-wit:
The West 7.00 feet of Lot 14 in Block 4 in Busse and
Wille's Resubdivision in Mount Prospect, a Resubdivision
of part of ~he East 1/2 of the Northwest 1/4 of Section
12, Township 41 North, Range 11 East of the Third Princi-
pal Meridian; together with the West 7.00 feet of Lots 19
to 22, both inclusive, and the North 7.00 feet of Lot 22,
all in Block 8 in Mount Prospect in the Northwest 1/4 of
Section 12, Township 41 North, Range 11 .East of the Third

ALSO
The North 7.00 feet of Lot 1 in Block 4 in Busse and
Wille's Resubdivision in Mount Prospect in the West 1/2
of Section 12, Township 41 North, Range 11 East of the
Third Principal Meridian, in Cook County, Illinois.
SECTION THREE: That Robert J. Eppley, Village Manager of the Village
of Mount Prospect, be and he is hereby authorized, empowered and directed
to negotiate for and in behalf of the said Village of Mount Prospect with
the owner or owners of the hereinabove described real property for the
purchase thereof by the said Village of Mount Prospect, a municipal
corporation.
SECTION FOUR: That in the event the said Robert J. Eppley is unable
to agree with the owner or owners of the said property as to the com-
pensation to be paid therefor then title to and possession of the said
real property legally described in SECTION TWO of this Ordinance shall
be acquired by the Village of Mount Prospect through condemnation, and
John J. Zimmermann, as attorney for the Village of Mount Prospect, is
hereby authorized, empowered, and directed to institute proceedings in
any court of competent jurisdiction to acquire title to and possession
of said property for said Village of Mount Prospect in accordance with
the eminent domain laws of the State of Illinois.
SECTION FIVE: That this Ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner pro-
vided by law.
