MOODY COOK COUNTY RECORDER OF DEEDS DATE: 0111512020 02:56 PM PGs 1 OF 4 for Recorder's ORDINANCE NO. 6496 —AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 1601 FEEHANVILLE DRIVE, MOUNT PROSPECT, ILLINOIS DATED AS OF JANUARY 14, 2020 After recording return to: RECORDER'S BOX 324 417526_1 ORDINANCE NO. 6496 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED 1601 FEEHANVILLE DRIVE, MOUNT PROSPECT ILLINOIS WHEREAS, Park View Montessori ("Petitioner') has filed a petition for a Conditional Use permit for the property located at 1601 Feehanville, Drive ("Property") and legally described as follows: LOT 502 IN KENSINGTON CENTER -RESUBDIVISION 17, IN PART OF THE NORTHEAST % OF SECITON 35, TOWNSHIP 42 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF REGISTERED IN THE OFFICE OF THE REGISTRAR OF TITILES OF COOK COUNTY ON MARCH 21, 1986 AS DOCUMENT NUMBER 3503002, IN COOK COUNTY, ILLINOIS Property Index Number: 03-35-200-034-0000: and WHEREAS, the Petitioner seeks a Conditional Use permit to allow a daycare center for the property located at 1601 Feehanville Drive; and WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being the subject of PZ - 24 -19 before the Planning and Zoning Commission of the Village of Mount Prospect on the 12th day of December, 2019, pursuant to proper legal notice having been published in the Dail Herald News a er on the 27th day of November 2019; and WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of PZ -24-19; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use permit would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Ordinance No. 6454 passed and approved on May 7, 2019, granting a conditional use for property located at 1000-1080 S. Elmhurst Road, is hereby repealed. SECTION TWO: The recitals set forth are incorporated as findings of fact by the Mayor and Board of Trustees of the Village of Mount Prospect. SECTION THREE: The Mayor and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use permit for a daycare center for the property located at 1601 Feehanville Drive subject to the following conditions: 1. "Providing architectural plans, including: a. A building code analysis reflecting existing and proposed conditions; b. All egress, uses, types of construction, occupant load, and any necessary changes due to the change in use group per the International Building Code (IBC); 2. Continuous landscaping to a height not less than three feet (3') be provided to screen the bollards and fence enclosing the playground area from the right-of-way; and 3. Compliance with all Development, Fire, Building, and other Village codes and regulations." Page 2/2 PZ- 24-19, 1601 Feehanville Drive Ordinance with the Recorder of Deeds of Cook County. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
