The Planning & Zoning Commission transmits their recommendation to approve Case PZ06-06, a request to install
a 60' roof mounted antenna as detailed in the attached Staff Report. The Planning & Zoning Commission heard the
request at their May 25,2006 meeting.
The S ubj ect Property is located on the south side of Kensington Road, east of F orest Avenue, and contains a high
school with related improvements. The Subject Property is zoned R1 Single Family Residence and is bordered by
the RA District to the east, by the RX district to the south and by residential to the west and north, located in
Arlington Heights. The Subject Property has a regular shape and measures over 58 acres.
The Planning & Zoning Commission discussed with the Petitioner why the significant height was needed and how
the Petitioner could be sure the antenna would not interfere with neighboring properties' electronic devices. The
Petitioner explained that the mature tree line was necessitating the need for the additional height to ensure a direct
line of sight with Forest View School. Also, the proposed technology (antenna and system) was designed to
constantly search for an open frequency, which negates interference. In addition, the only possible way another
device could experience interference would be if the device was in the antenna's direct line of sight, which would
be approximately 90' off the ground. The Petitioner reviewed the overall cost savings to the school and
emphasized that the antenna would ensure communication if the phone system failed. There was further discussion
on how neither the permitted 10' roof mounted antenna or the existing 46' antenna could provide the service
needed by the school district. The Petitioner stated their intention to remove the existing 46' antenna.
The Planning & Zoning Commission voted 6-0 to recommend that the Village Board approve a Variation to allow
one 60' roof mounted antenna to be used only as specified on the Petitioner's application, and further modifications
to the antenna require Village Board review and approval, for the school at 801 W. Kensington Road, Case No. PZ-
06-06.

Chairperson Arlene Juracek called the meeting to order at 7:30 p.m. Richard Rogers moved to approve the
minutes of the April 27, 2006 meeting and Joseph Donnelly seconded the motion. The motion was approved 6-0.
Chair Juracek informed the Commission that the Petitioner for case PZ-40-05 requested their case be continued.
Richard Rogers motioned to continue the case to the June 22, 2006 Planning and Zoning Meeting; Joseph
Donnelly seconded the motion. The motion was approved 6-0. After hearing two prior cases, Chairperson
Juracek introduced Case Number PZ-06-06; a Variation request for antenna height, at 8:33 p.m.
Judy Connolly, Senior Planner, stated that the Subject Property is located on the south side of Kensington Road,
east of Forest Avenue, and contains a high school with related improvements. The Subject Property is zoned R1
Single Family Residence and is bordered by the RA District to the east, by the RX district to the south and by
residential to the west and north which is located in Arlington Heights. She said the Subject Property has a
regular shape and measures over 58 acres. The Subject Property includes a 46' tall roof mounted antenna that was
installed prior to the Village adopting the existing regulations, as well as a 60' roof mounted antenna, which has
subsequently been taken down.
Ms. Connolly said Staff was contacted by a representative of the Petitioner seeking a Zoning Compliance letter
for the 60' antenna installed prior to seeking relief from the Zoning Ordinance. She stated that Stafflearned about
the antenna at that time and confirmed with the Village Attorney that while the State exempts schools from local
building permitting processes, the schools must adhere to the local zoning regulations. She said Village zoning
regulations limit the antenna to 10' in height. She stated that in order to obtain zoning compliance, the Petitioner
is requesting a Variation for the 60' antenna. Although a building permit was not required, relief from zoning
regulations must be obtained prior to installation of the antenna.
Ms. Connolly showed exhibits documenting the location and size of the existing antennas. She stated that the site
plan shows that the Subject Antenna is located on the roof of a three story building, and is a significant distance
feet from the closest residential dwelling.

Ms. Connolly said the existing 46' tall antenna does not comply with the Village's zoning regulations. However,
Staff was informed that it was installed before the Village adopted regulations limiting the height of a roof
mounted antenna to 10'. Therefore, it is a legal nonconforming structure and allowed to remain. She stated a
Variation would be required if the Petitioner removed it and sought to replace it with an antenna taller than 10' in
height.
Ms. Connolly stated that the second antenna measures 60' in height and exceeds the 10' height limitation for roof
mounted antennas. She said the antenna is regulated by Village Code Section 14.313 Regulations for Personal
Wireless Telecommunications Facilities because it is an unlicensed wireless service and is classified as a Personal
Wireless Service facility per the 1996 Telecommunications Act.
Ms. Connolly said the Petitioner is seeking Variation approval to allow the 60' antenna. She stated that after
further discussions with the Petitioner, Stafflearned that if the school's phone system fails, this antenna allows the
school to maintain communications with District 214. She said Staff learned that the increased antenna height
was necessary to maintain a line of sight with Forest View High School, which allows the schools to maintain
communication if the phone system go down. She stated that the antenna is the primary support for the school's
computers, lap tops, and HV AC system.
Ms. Connolly stated that the Petitioner confirmed that the school explored alternative designs and equipment, but
the alternatives had limited capacity and did not allow for adequate bandwidth and speed. She also said the
Petitioner confirmed that the permitted 10' antenna height was inadequate as it cannot attain the necessary line of
sight with Forest View School.
Ms. Connolly said the Petitioner's application states that the antenna is a noncommercial antenna, which means it
is not used to support or maintain service for a commercial cell phone carrier. She stated that the Petitioner will
present information that confirms the antenna will not interfere with other technology systems or adjacent
properties and that the 10' antenna cannot attain the necessary line of sight with Forest View School.
Ms. Connolly stated that Staff received a significant number of inquiries regarding this case. Many, if not all of
the people were surprised to learn the antenna had already been installed.
Ms. Connolly said the Petitioner's request to maintain the existing 60' antenna meets the standard for a Variation
because the permitted 10' height creates a hardship for the Petitioner: the school cannot maintain back-up
emergency communications with a 10' tall antenna because the 10' antenna cannot attain the required line of
sight. She stated that the increased antenna height will be used to benefit the school, and not for commercial
purposes. Therefore, Staff found that the Variation request meets the standards for a Variation contained in
Section 14.203.C.9 of the Zoning Ordinance. Based on this analysis, Staff recommends that the P&Z approve
the following motion:
"To approve a Variation to allow one 60' roof mounted antenna to be used only as specified on the Petitioner's
application, and further modifications to the antenna require Village Board review and approval, for the school at
801 W. Kensington Road, Case Number PZ-06-06."
Ms. Connolly stated that the Village Board's decision is final for this case because the amount of the Variation
exceeds 25% of the Zoning Ordinance requirement.
Chair Juracek asked if the commission had questions for Staff. Richard Rogers asked Staff if the proposed 60'
antenna is replacing the existing 46' antenna. Ms. Connolly said that the 46' antenna, which is legal non-
conforming, would remain in place and the variation is to reinstall the 60' antenna.

Chair Juracek asked what the nature of the public inquiries were concerning this case. Ms. Connolly stated that
most of the callers had seen the public hearing sign and thought that the issue might be another school related
request. Chair Juracek then questioned if the Village mapping would reflect the need for the line of sight to
remain clear between Prospect High School and Forest View School. Ms. Connolly stated that the maximum
building height in Mount Prospect is 30' and the 60' antenna, placed on top of a 3-story building, should maintain
that line of sight between the schools.
Chair Juracek swore in Keith Bockwoldt, Director of Technology for Township High School District 214,2121 S.
Goebbert Road, Arlington Heights, Illinois. Mr. Bockwoldt said the state-of-the-art communications system was
installed by the District to maintain constant communications between the District buildings. Mr. Bockwoldt
further stated that they would in fact, like to remove the 46' antenna currently on the building, leaving just the
proposed 60' antenna. Mr. Bockwoldt showed exhibits demonstrating the elevations of the antennas atop the
building. He also explained the construction needs and requirements for placing the antenna on the building. Mr.
Bockwoldt explained that the intelligence of this system prevents any interference with residential or other
commercial communications systems.
Chair Juracek called for further discussion. Hearing none, the public hearing was closed at 8:48 p.m. Joseph
Donnelly made a motion to approve the Variation as presented, Case Number PZ-06-06, Richard Rogers seconded
the motion.

Motion was approved 6-0. The case will go to Village Board for their consideration.
Leo Floras made a motion to adjourn at 8:50 p.m., seconded by Joseph Donnelly. The motion was approved by a

BACKGROUND
A public hearing has been scheduled for the March 23,2006 Planning & Zoning Commission meeting to review
the application by Township High School District 214 (the "Petitioner") regarding the property located at 801 W.
Kensington Road (the "Subject Property"). The Petitioner is seeking a Variation to allow a roof mounted antenna
height of 60' when the Zoning Ordinance limits the maximum height to 10'. The P&Z hearing was properly
noticed in the March 8, 2006 edition of the Journal Topics Newspaper. In addition, Staff has completed the
required written notice to property owners within 250-feet and posted a Public Hearing sign on the Subject
Property .
PROPERTY DESCRIPTION
The Subject Property is located on the south side of Kensington Road, east of Forest Avenue, and contains a high
school with related improvements. The Subject Property is zoned R1 Single Family Residence and is bordered by
the RA District to the east, by the R.X district to the south and by residential to the west and north, located in
Arlington Heights. The Subject Property has a regular shape and measures over 58 acres. The Subject Property
includes a 46' tall roof mounted antenna that was installed prior to the Village adopting the existing regulations,
as well as a recently installed 60' roof mounted antenna.
SUMMARY OF PROPOSAL
Staff was contacted by a representative of the Petitioner seeking a Zoning Compliance letter for the 60' antenna
installed prior to seeking relief from the Zoning Ordinance. Staff learned about the antenna at that time and
confirmed with the Village Attorney while the State exempts schools from local building permitting processes,
the schools must adhere to the local zoning regulations. Village zoning regulations limit the antenna to 10' in
height. In order to obtain zoning compliance, the Petitioner is requesting a Variation for the 60' antenna.
Although a building permit was not required, relief from zoning regulations must be obtained prior to installation
of the antenna. In this case, the Petitioner is seeking an 'after-the-fact' Variation because the antenna is already
installed.
The attached exhibits document the location and size of the existing antennas. The site plan shows that the
Subject Antenna is located on the roof of a three story building, approximately 5490 feet from the closest
residential dwelling.

GENERAL ZONING COMPLIANCE
The existing 46' tall antenna does not comply with the Village's zoning regulations. However, Staff was
informed that it was installed before the Village adopted regulations limiting the height of a roof mounted antenna
to 10'. Therefore, it is a legal nonconforming structure and allowed to remain. A Variation would be required if
the Petitioner removed it and sought to replace it with an antenna taller than 10' in height.
The second antenna measures 60' in height and exceeds the 10' height limitation for roof mounted antennas. It is
located over 500' from the nearest residential property. The antenna is regulated by Sec. 14.313 Regulationsfor
Personal Wireless Telecommunications Facilities because it is an unlicensed wireless service and is classified as a
Personal Wireless Service facility per the 1996 Telecommunications Act. The following table compares the
Petitioner's proposal to the Village's regulations.

VARIATION STANDARDS
The standards for a Variation are listed in Section 14.203.C.9 of the Village Zoning Ordinance and include seven
specific findings that must be made in order to approve a Variation. The following list is a summary of these
findings:
· A hardship due to the physical surroundings, shape, or topographical conditions of a specific property not
generally applicable to other properties in the same zoning district and not created by any person
presently having an interest in the property;
· Lack of desire to increase financial gain; and
· Protection of the public welfare, other property, and neighborhood character.
The Petitioner is seeking Variation approval to allow the 60' antenna. After further discussions with the
Petitioner, Staff learned that if the phone system goes down, this antenna allows the school to maintain
communications with District 214. Staff learned that the increased antenna height was necessary to maintain a
line of sight with Forest View High School, which allows the schools to maintain communication if the phone
system go down. (Forest View is the central communication location and has multiple roof mounted antennas,
one for each school.) In addition, the antenna is the primary support for the school's computers, lap tops, and
HV AC system.
The Petitioner confirmed that the school explored alternative designs and equipment, but the alternatives had
limited capacity and did not allow for adequate band width and speed. Also, they confirmed that the permitted
10' antenna height was inadequate as it cannot attain the necessary line of sight with Forest View School.
The Petitioner's application states that the antenna is a noncommercial antenna, which means it is not used to

meeting that confirms the antenna will not interfere with other technology systems or adjacent properties. In
addition, Staff recommends the Petitioner provide documentation that the 10' antenna cannot attain the necessary
line of sight with Forest View School when presenting the technology non-interference data at the P&Z meeting.

RECOMMENDATION
The Petitioner's request to maintain the existing 60' antenna meets the standard for a Variation because the

Dear Mr. Cooney:
The Planning & Zoning Commission recommended approval of the Prospect High School
Antenna Variation by a 6-0 vote. Our case is scheduled to go before Village Board for the
ordinance's first reading on June 6,2006.
I am requesting that the Village Board waive the second reading, tentatively scheduled for the
second Village Board meeting, and take final action at the June 6,2006 meeting. The
antennas provide critical wireless data and voice backup systems for the school. District 214
installed a new Voice over Internet Protocol phone system that runs over the fiber connection
that connects Prospect High School to the District 214 office. If the fiber is cut or goes down,
the wireless antenna will provide Life/Safety backup. This is important for Homeland Security
and for the students that we serve (nearly 13,000). The antennas are being installed at our
other 6 campuses and since Prospect High School has summer school this year, I would like to
start the project as soon as possible.

The purpose of this communication is to confirm that Township High School District 214 wishes to
install an antenna at Prospect High School, 801 W. Kensington for telephone and data
communications between each ofthe schools. The antennas will be replacing ten-year old models
and will be used as critical backup systems to our voice and data network. The antennas are being
installed by Sentinel Technologies and are for non-commercial use.
I have had conversations with Judy Connolly and will be submitting our paperwork by February 10,
2006 to proceed with the approval process.
At this time, the school district is requesting dispensation to exempt the district from application
fees and fees associated with permits.

ORDINANCE NO.
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 801 WEST KENSINGTON ROAD (PROSPECT HIGH SCHOOL)
WHEREAS, Township High School District 214 (hereinafter referred to as "Petitioner") has filed a
petition for a Variation with respect to property located at 801 West Kensington Road (Prospect High
School) (hereinafter referred to as the "Subject Property"),
PIN: 03-33-201-002-0000
and as legally described in Exhibit A; and
WHEREAS, the Petitioner seeks a Variation to allow for a sixty foot (60') roof mounted antenna as
shown on the attached Exhibit A; and
WHEREAS, a Public Hearing was held on the request for the Variation being the subject of PZ-06-
06 before the Planning and Zoning Commission of the Village of Mount Prospect on the 25th day of
May, 2006, pursuant to proper legal notice having been published in the Mount Prospect Journal &
Topics on the 8th day of March, 2006; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and positive
recommendations to the President and Board of Trustees of the Village of Mount Prospect;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the request herein and have determined that the same meets the standards of the
Village and that the granting of the proposed Variation would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE
OF THEIR HOME RULE POWERS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the
President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby
grant the Variation from Section 14.313, Regulations for Personal Wireless Telecommunication
Facilities, of the Village Code, to allow for a sixty foot (60') roof mounted antenna for non-
commercial use only.

ORDINANCE NO.
AN ORDINANCE PERTAINING TO A DETERMINATION OF
THE PREVAILING WAGE RATES
WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and
other works employed in any public works by the State, County, Village or any other public body or
any political subdivision or by anyone under contract for public works," approved June 26, 1941, as
amended (820 ILCS 13011); and
WHEREAS, the aforesaid Act requires that the Village of Mount Prospect of Cook County
investigate and ascertain the prevailing rate of wages as defined in said Actfor laborers, mechanics
and other workers in the locality of said Village of Mount Prospect employed in performing public
works projects for said Village of Mount Prospect.
BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR
HOME RULE POWERS:
SECTION ONE: To the extent as required by "An Act regulating wages of laborers, mechanics and
other workmen employed in any public works by the State, County, City or any public body or any
political subdivision or anyone under contract for public works," approved June 26, 1941, as
amended, the general prevailing rate of wages in this locality for laborers, mechanics and other
workers engaged in the construction of public works coming under the jurisdiction of the Village is
hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook
County areas as determined by the Department of Labor of the State of Illinois as of June 1, 2006,
a copy of which wage rates are on file in the Office of the Village Clerk. The definition of any terms
appearing in this Ordinance which are also used in the aforesaid Act shall be the same as in said
Act.
SECTION TWO: Nothing herein contained shall be construed to apply said general prevailing rate
of wages as herein ascertain to any work or employment except public works construction of this
Village to the extent required by aforesaid act. .
SECTION THREE: The Village Clerk shall publicly post or keep available for inspection by any
interested party in the main office of this Village this determination of such prevailing rate of wages.
SECTION FOUR: The Village Clerk shall mail a copy ofthis determination to any employer, and to
any association of employees and to any person or association of employees who have filed, or file
their names and addresses, requesting copies of any determination stating the particular rates and
the particular class of workers whose wages will be affect by such rates.

SECTION FIVE: The Village Clerk shall promptly file a certified copy ofthis determination with both
the Secretary of State and the Department of Labor of the State of Illinois and shall further cause
to be published in a newspaper of general circulation within the Village, a copy of this determination
which shall constitute notice that the determination is effective and that this is the determination of
the President and Board of Trustees of the Village of Mount Prospect.
SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.

TRUCK DRIVERS (WEST) - That part of the county West of Barrington
Road.
The following list is considered as those days for which holiday rates
of wages for work performed apply: New Years Day, Memorial/Decoration
Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day,
Christmas Day. Generally, any of these holidays which fall on a Sunday
is celebrated on the following Monday. This then makes work
performed on that Monday payable at the appropriate overtime rate for
holiday pay. Common practice in a given local may alter certain days
of celebration such as the day after Thanksgiving for Veterans Day.
If in doubt, please check with IDOL.
EXPLANATION OF CLASSES
ASBESTOS - GENERAL - removal of asbestos material/mold and hazardous
materials from any place in a building, including mechanical systems
where those mechanical systems are to be removed. This includes the
removal of asbestos materials/mold and hazardous materials from
ductwork or pipes in a building when the building is to be demolished
at the time or at some close future date.
ASBESTOS - MECHANICAL - removal of asbestos material from mechanical
systems, such as pipes, ducts, and boilers, where the mechanical
systems are to remain.
CERAMIC TILE FINISHER
The grouting, cleaning, and polishing of all classes of tile, whether
for interior or exterior purposes, all burned, glazed or unglazed
products; all composition materials, granite tiles, warning detectable
tiles, cement tiles, epoxy composite materials, pavers, glass,
mosaics, fiberglass, and all substitute materials, for tile made in
tile-like units; all mixtures in tile like form of cement, metals, and
other materials that are for and intended for use as a finished floor
surface, stair treads, promenade roofs, walks, walls, ceilings,
swimming pools, and all other places where tile is to form a finished

interior or exterior. The mixing of all setting mortars including but
not limited to thin-set mortars, epoxies, wall mud, and any other sand
and cement mixtures or adhesives when used in the preparation,

The handling and unloading of all sand, cement, lime, tile, fixtures,
equipment, adhesives, or any other materials to be used in the
preparation, installation, repair, or maintenance of tile and/or
similar materials. Ceramic Tile Finishers shall fill all joints and
voids regardless of method on all tile work, particularly and
especially after installation of said tile work. Application of any
and all protective coverings to all types of tile installations
including, but not be limited to, all soap compounds, paper products,
tapes, and all polyethylene coverings, plywood, masonite, cardboard,
and any new type of products that may be used to protect tile
installations, Blastrac equipment, and all floor scarifying equipment
used in preparing floors to receive tile. The clean up and removal of
all waste and materials. All demolition of existing tile floors and
walls to be re-tiled.
COMMUNICATIONS ELECTRICIAN - Installation, operation, inspection,
maintenance, repair and service of radio, television, recording, voice
sound vision production and reproduction, telephone and telephone
interconnect, facsimile, data apparatus, coaxial, fibre optic and
wireless equipment, appliances and systems used for the transmission
and reception of signals of any nature, business, domestic,
commercial, education, entertainment, and residential purposes,
including but not limited to, communication and telephone, electronic
and sound equipment, fibre optic and data communication systems, and
the performance of any task directly related to such installation or
service whether at new or existing sites, such tasks to include the
placing of wire and cable and electrical power conduit or other
raceway work within the equipment room and pulling wire and/or cable
through conduit and the installation of any incidental conduit, such
that the employees covered hereby can complete any job in full.

Department generally has on file such definitions which are
available. If a task to be performed is not subject to one of the
classifications of pay set out, the Department will upon being
contacted state which neighboring county has such a classification and
provide such rate, such rate being deemed to exist by reference in
this document. If no neighboring county rate applies to the task,
the Department shall undertake a special determination, such special
determination being then deemed to have existed under this
determination. If a project requires these, or any classification not

LANDSCAPING
Landscaping work falls under the existing classifications for laborer,
operating engineer and truck driver. The work performed by landscape
plantsman and landscape laborer is covered by the existing
classification of laborer. The work performed by landscape operators
(regardless of equipment used or its size) is covered by the
classifications of operating engineer. The work performed by
landscape truck drivers (regardless of size of truck driven) is
covered by the classifications of truck driver.

The new solid waste contract signed between the Village and ARC Disposal ushered in
a new era of solid waste collection. The changes in solid waste collection, the
introduction of a direct charge and an increase in the Village yard waste sticker fee
necessitates several changes to the Village Code. The updates found in the three
attached ordinances reflect the changes to the new solid waste program. The changes
found in Appendix A represent two new fees and a change in an existing fee.
The two new fees reflected in Appendix A are the annual direct bill charge of $75 for
properties receiving curbside collection and the new annual fee for multifamily
properties. Multifamily properties will now be responsible for 35% of the first collection of
the week, whereas, in the past the Village paid for the first collection of the week. This
percentage is the same portion the curbside collection residents are now paying. In
addition, the increase from $1.75 to $2.25 for the Village yard waste sticker has been

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 11
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE
EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That Article XXIII entitled Secondhand Dealers and Scavengers of
Chapter 11 of the Village Code of Mount Prospect; as amended, is hereby further
amended to delete Sections 11.2301 and 11.2303 in their entirety and to insert in lieu
thereof, entirely new Sections 11.2301 and 11.2303 to be and read as follows:
ARTICLE XXIII
SECONDHAND DEALERS AND SCAVENGERS
"11.2301: LICENSE REQUIRED: No person shall engage in the business of scavenger,
garbage collector, yard material collector, recycling collector, secondhand dealer or junk
dealer within the corporate limits of the Village, except in compliance with the provisions
of this Article.
A. Exclusive Franchise License; Residential Dwellings and Dwelling Units: There
shall be issued in the Village no more than one scavenger license, authorizing the
collection of garbage, refuse, recyclables, and yard materials for any and all
residential dwellings located within the corporate limits of the Village.
1. The said exclusive franchise license shall be issued to that contractor awarded
the "exclusive residential refuse disposal service contract" by the most current
resolution passed by the President and Board of Trustees of the Village.
2. The exclusive franchise licensee shall furnish all labor, materials and
equipment for the removal of trash and refuse, recyc1ables and yard materials in
regular weekly collections, as detailed in the current solid waste contract.
3. Upon award of the contract for residential garbage/refuse, recycling, and yard
material collection by resolution aforesaid, the Village shall issue the said
exclusive franchise license upon payment of the proper fee therefore as set
forth herein below.
B. Other Licenses: An unlimited number of licenses for other than residential
collections shall be available to persons engaged in the business of scavenger,
garbage collector, secondhand dealer or junk dealer upon application therefore
submitted to the Village in the manner provided in Chapter 10 of the Village
Code. (1981 Code; amd. Ord. 3993, 10-19-1988; Ord. 4166, 4-3-1990)"
"11.2303: GENERAL OPERATING REQUIREMENTS FOR seA VENENGERS:
In addition to all other duties and obligations imposed by this municipal code upon
scavengers and garbage collectors, such licensees shall have the following duties and
obligations whether such license is a general license or an exclusive franchise license:
A. Equipment:
1. Any licensee shall collect all such garbage and refuse in fully enclosed leakproof
trucks.
2. Open body trucks, dump trucks and similar equipment may be used only for large
bulky items such as discarded furniture, fixtures and household appliances.
B. Disposal: Licensees will transport all garbage, refuse and other materials collected for
disposal to areas outside of the corporate limits of the Village and shall deposit same
at a proper lawful site designated and maintained for such purpose under the laws of
the state of Illinois.
C. Insurance: Any licensee hereunder shall carry the following insurance:
1. Workers' Compensation: With a company authorized under the laws of the state of
Illinois a policy to protect himself against liability under the workers' compensation
and occupational diseases statutes of the state of Illinois;
2. Automobile Liability Insurance: Automobile liability insurance coverage and
amounts as set forth in Appendix A, Division I of the Village Code; and
3. General Liability: A comprehensive liability policy for all operations other than
vehicular operations with limits of at least the amounts set forth in Appendix A,
Division I of the Village Code.
D. Indemnification: The licensee shall indemnify and save harmless the Village against
any and all damages to property or injury to or death of any person or persons,
including property and employees, agents or invitees of the Village, and shall defend,
indemnify and save harmless the Village from any and all claims, demands, suits,
actions or proceedings of any kind or nature, including workers' compensation claims,
or by anyone whatsoever, in any way resulting from or arising out of the operations in
connection with the license issued pursuant to this code, including operations of
subcontractors and actions or omissions of employees or agents of licensee or his
subcontractors.
1. Insurance coverage specified in Subsection C of this section and the special
conditions constitute the minimum requirements and said requirements shall in no
way lessen or limit the liability of the licensee.
2. The licensee shall procure and maintain, at his own cost and expense, any
additional kinds of insurance, in his own judgment, which may be necessary for his
proper protection in the prosecution of the work.
3. The licensee shall well and truly save and indemnify and keep harmless, the
Village against all liability, judgments, costs and expenses which may in any wise
come against the Village, or which may in any wise result from carelessness or lack
of the licensee or his agents, employees or workers in any respect whatsoever.
E. Care And Performance: The licensee shall undertake to perform all disposal services
rendered hereunder in a neat, orderly and efficient manner, to use care and diligence
in the performance of his contract, and to provide neat, orderly and courteous
employees and personnel on his crews.
F. Sobriety: The licensee shall prohibit any drinking of alcoholic beverages by its drivers
and crew members while on duty or in the course of performing their duties under
said license.
G. Obedience To Other Laws: The licensee shall obey all other laws regulating his
business including those contained in Chapter 19, Article II of the Village Code.

H. Working Hours: Collection of garbage, refuse, recyclables, and yard waste from
residential properties and commercial/industrial sites adjacent to residential property
is prohibited prior to 6:30 a.m. Monday through Saturday and collection of all
properties is prohibited on Sundays."
SECTION TWO: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.

OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF

SECTION ONE: That Article II entitled Garbage and Refuse of Chapter 19 of the Village Code
of Mount Prospect; as amended, is hereby further amended to delete Sections 19.201,
19.202,19.203, 19.208, and 19.209 in their entirety and to insert in lieu thereof, entirely new
Sections 19.201, 19.202, 19.203, 19.208, and 19.209 to and read as follows:
ARTICLE II
GARBAGE, REFUSE, AND RECYCLING
"19.201: RESIDENTIAL SERVICE REQUIRED:
Every owner, agent, tenant or occupant of any single-family residential home or residential
dwelling unit located within the corporate limits of the village shall have accumulations of
garbage and refuse collected and disposed of as outlined in the most recent edition of the Village
"Solid Waste Services" booklet, at least once each seven (7) days unless interrupted by a legal
holiday.
A. Such collection shall be made by the scavenger company servicing the village under the
current exclusive franchise license issued by the village for residential dwellings and residential
dwelling units, as outlined in the current Solid Waste Contract.
B. The occupancy of any premises for residential purposes shall be prima facie evidence that
refuse is being produced and accumulated on such premises. (Ord. 2888, 4-4-1979; amd. Ord.
4167,4-3-1990)"
"19.202: COMMERCIAL AND INDUSTRIAL ESTABLISHMENTS:
All commercial or industrial establishments are required to make private arrangements for the
collection and disposal of all garbage, refuse or waste, recyclables, and yard materials in a
prompt and sanitary manner, which includes the use of approved receptacles or other containers
meeting the specifications for same as set forth in section 19.203 of this article. (Ord. 2888, 4-4-
1979; amd. Ord. 4167, 4-3-1990)"
"19.203: RECEPTACLES:
A. It shall be the duty of every owner, agent, tenant or occupant of any house, building, flat,
apartment, apartment building or other place where people reside, board, lodge or prepare or
serve animal or vegetable matter, to place all garbage, refuse or waste, recyclables and "yard
materials" in approved receptacles as set forth and defined hereinbelow and to maintain same
in good order and in accordance with the law. These receptacles shall include the following:
1. A Village imprinted and furnished green wheeled cart thirty-five (35), sixty-five (65)
and/or ninety-five (95) gallon receptacle for the purpose of storage of garbage, refuse
or waste, rocks and building materials resulting from do-it-yourself projects and all
other items of similar nature which do not exceed the size of the approved receptacle.
Said receptacle shall be a wheeled cart of standard waterproof construction with
handles, wheels and a tight-fitting cover or lid and shall be no larger than 35, 65 or 95
gallons in capacity. There is no limit as to the number of such containers used by any
family unit. All garbage must be in a cart or it will not be collected.
2. A biodegradable thirty-two (32) gallon compost bag, a thirty-two (32) gallon standard
garbage can with a yard material decal or a 95-gallon wheeled cart provided by the
Village's residential solid waste contractor are the only approved receptacles for
disposal of yard materials. "Yard materials" are defined as small amounts of sod, grass
clippings, garden materials, small brush, leaves, twigs, weeds, and all other items of
similar nature. Items placed in these receptacles shall not exceed the size of the
approved receptacles and shall not exceed fifty (50) pounds in weight.
3. A village imprinted and furnished thirty-five (35) or sixty-five (65) gallon blue
wheeled cart is the approved receptacle for the collection of recyclables. Said
receptacle shall be a wheeled cart of standard waterproof construction with handles,
wheels and a tight-fitting cover or lid and shall be no larger than 35 or 65 gallons in
capacity. All recycling materials must be in the blue-wheeled cart or it will not be
collected.
4. A receptacle furnished by a village approved scavenger for commercial or industrial
establishments including multi-family dwelling units when curb service for each
family is not in effect
B. No containers are necessary for such items as bulk items, brush bundles, construction
debris and other items as described in the most recent edition of the village "Solid Waste
Services" booklet.
c. In the case of all residential refuse collections, approved receptacles and other approved
discarded items shall be placed on the parkway or alley (if garbage collections are made
from alley) after four thirty o'clock (4:30) P.M. on the day before the day designated for
such collection.
1. There shall be no limit as to the number of approved receptacles which the resident can
use to dispose of items to be collected.
2. Except for the placement of receptacles on the curb on the day of pickup, such
receptacles may be stored only in a side or rear yard and not forward of a principal
building (not including porches, decks, stoops or overhangs). Such receptacles may not
be placed in exterior side yards unless completely screened by permanent fence or
dense evergreen planting from the adjacent street.
3. No item or items of trash or waste, except those that are disposed of pursuant to
subsection A2, A3, or B of this section, may be placed outside unless such items are
placed in an approved receptacle.
4. Such receptacles shall be removed from the parkway or alley, as the case may be, after
collection but on the day collection is made.
5. Items such as bulk items, bundles of brush, construction debris, and other items
suitable for collection by the scavenger shall be neatly stacked along side of approved
receptacles for collection.
6. Any resident or multi-dwelling unit not wishing to avail themselves of such curb
service may, by separate contract with the scavenger company servicing the village,
secure any special service offered by said scavenger on a private basis.
7. Should any refuse, recyclable or yard material be placed at the curb on a day not
designated by ordinance for collection the resident shall remove it from the curb and
store it next to their premises until the next designated collection day.
D. Whenever, through private contract with any scavenger, there occurs the use of containers of
a size in excess of the ninety-five (95) gallon capacity allowed for approved receptacles as
defined hereinabove, the scavenger shall ensure such containers are:
1. Of drip proof construction and have tight fitting lids or covers;
2. Have adequate outriggers and other safety equipment attached.
3. Exchanged and replaced on a quarterly basis of each year (or more often as may be
necessary to keep such containers in sanitary condition) with steamed cleaned sanitary
containers clearly marked in legible lettering on the vertical front of such container
reflecting the date such container was last cleaned in conformity with this article.
4. Furnished regularly scheduled collection."
"19.208: FEES:
The following fees are required for the collection and disposal of garbage, refuse, recyclables
and yard materials.
A. Residential: The village shall provide a once-a-week service collection and disposal of
garbage, refuse, and recyclables only, as described in the village's current Solid Waste
Contract. Every owner, agent, tenant or occupant of any single family residential dwelling or
residential dwelling unit (multi-family) located within the corporate limits of the village shall
pay a portion of the village's cost for that once-a-week service, including collection,
dumping and administrative fees, as follows:
1. Single family residential dwellings will pay the amount as set forth in Appendix A,
Division II of this code.
2. Multi-Family Residential Properties: As set forth in Appendix A, Division II of this code,
the village will be responsible for the cost of a portion of once-a-week service and the
remaining portion will be the responsibility of the respective multi-family residential
properties. Multi-family residential properties receiving such service two or more times
per week will pay the cost for all such additional services.
a. Multi-family properties submitting payment for services on or before the 10th day
following the date of the statement for such services will receive a 1 % discount for that
monthly service.
(1) If payment is not submitted to the Village Finance Department on or before the 25th
day following the date of the statement for such services, a 20% penalty shall be
added to the amount due.
(2) If payment is made 15 days or more past the due date, which is the twenty first day
after the date of the statement, a letter requesting payment will be sent by the village
to the property owner/manager. The owner/property manager will be notified that a
$10.00 per day late fee will be assessed beginning the 30th day after the due date and
shall continue accruing on a daily basis until the balance is paid in full.
(3) If payment is made 60 days or more past the due date, the owner/property manager
will be required to remit a deposit equal to two months of the service, in addition to
the balance due and all late charges.
3. Clean-up of refuse by the franchise solid waste contractor at multi-family properties due to
failure of tenants and/or management to properly dispose of waste shall be billed
according to the current per cubic yard fee schedule in the exclusive solid waste contract.
4. The Village Finance Department is responsible for billing and collecting the fees set forth
in Subsection A 1 and A2 of this section.
B. Yard material collection and disposal requires a user fee through the purchase of a village
yard waste sticker, which must be attached to every unit of yard material placed at the curb.
Or, subscription service scheduled by the user of requested service with the Village's solid
waste contractor. Annual subscription service fees are set forth in the Residential Solid
Waste Contract. The user of said service pays subscription service fees directly to the solid
waste contractor.
The sticker fee, as set forth in Appendix A, Division II of this code, is determined by the
Village Manager to be directly related to the cost of the sticker, its distribution, and the cost
of collection and disposal of yard materials.
C. Commercial And Industrial Establishments: All commercial and industrial establishments will
contract directly with their respective scavengers for collection and disposal of all garbage,
refuse, waste and yard materials."
"19.209: FAILURE TO PAY GARBAGE COLLECTION BILL:
A. Penalty For Nonpayment: All garbage and refuse charges (garbage collection) shall be due
and payable on or before the twenty-first (215t) day after the date of the statement for such
charges. All bills unpaid after that twenty-one (21) day period shall become delinquent and a
penalty, as set forth in appendix A, divisions II and III of this code, shall be added thereto
and become due in addition to the charges for such services. The provisions of this section
shall apply to all users regardless of whether the property is owner-occupied or tenant-
occupied. Any agreement between a property owner and his/her tenant regarding the
payment of garbage and refuse bills shall not be binding to the village.
B. Lien Against The Property: Whenever a bill for garbage collection service remains unpaid for
sixty (60) days after the statement for service was mailed, the finance director may file in the
office of the recorder of deeds of Cook County a sworn statement of lien claim. The notice of
lien shall contain a legal description of the premises with permanent index number, if
available, the amount of all unpaid service charges including interim penalties for garbage
collection services up to the date the lien is prepared, the date when the unpaid amount
became delinquent, and a notice that the village claims a lien for the delinquent amount as
well as all charges subsequent to the period covered by the bill and any costs incurred to
record the lien. The finance director shall send a notice of lien to the user of the garbage
collection service at the premises. If the user of the garbage collection service is not the
owner of the premises, and the finance director has such knowledge, then the notice of lien
shall also be mailed to the owner of the premises or the holder of the beneficial interest in the
premises, if their address is known to the finance director. The failure of the finance director
to record the lien claim or to mail notice of lien, or the failure of the owner to receive such
notice, shall not affect the right to foreclose the lien for unpaid garbage collection bill.
The filing of any claim for lien under this section shall not be construed to limit the right and
power of the village to otherwise enforce collection of the delinquent garbage collection
account.
C. Property subject to a lien for unpaid garbage collection charges shall be sold for nonpayment
of the same, and the proceeds of such sale shall be applied to pay the charges, after deducting
costs, as is the case in the foreclosure of statutory liens. Such foreclosure shall be by
complaint for foreclosure filed in the circuit court of Cook County in the name of the village.
The village attorney is hereby authorized and directed to institute such proceedings, in the
name of the village, in any court having jurisdiction over such matters, against any property
which a garbage bill has remained unpaid ninety (90) days after it has been rendered. (Ord.
5253,5-21-2002).
D. Other Remedies For Nonpayment: In addition to the foregoing, the village shall have the
following remedies for failure to pay for garbage collection service:
1. If the premises is subject to a business license, the business license may be revoked
pursuant to chapter 10 of this code.
2. Such other legal remedies as may be determined by the village manager. (Ord. 4776, 2-20-
1996; amd. Ord. 5051, 10-5-1999; Ord. 5189, 5-15-2001)"

AN ORDINANCE TO AMEND SOLID WASTE FEES SET FORTH IN
APPENDIX A. DIVISIONS II AND III OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF
THEIR HOME RULE POWERS:
SECTION ONE: A new Section 19.208, entitled "Fees" of Appendix A, Division II entitled
"Garbage and Refuse" of the Village Code of Mount Prospect shall be inserted to be and read as
follows:
"19.208 Fees
A. Residential Refuse Collection:
1) Annual Fee of$75.00 per single-family dwelling.
2) An annual fee of 35% of the Village's cost for providing solid waste
contractual services, disposal fees and Village administrative costs for the
once a week service plus an annual fee of 100% of all costs for service in
excess of once a week service.
B. Yard Material User Fee: $2.25 per Village-imprinted sticker."
SECTION TWO: That Section 19.209, entitled "Failure to Pay Garbage Collection Bill"of
Appendix A, Division III entitled "Garbage and Refuse" of the Village Code of Mount Prospect
shall be deleted in its entirety and to insert thereof, an entirely new Section 19.209 to be and
read as follows:
"19.209 Failure to Pay Garbage Collection Bill:
A. Single Family Residential Dwelling - fine for late payment shall be 10% of the total
amount of such charges shall be added thereto and shall be due in addition to the
charges for such services.
B. Multi-Family Residential Dwelling - fine for late payment shall be 20% of the total
amount of such charges shall be added thereto and shall be due in addition to the
charges for such services."
SECTION THREE: That this Ordinance shall be in full force and effect from its approval and
publication in pamphlet form in the manner provided by law.

RESOLUTION NO.
A RESOLUTION REQUESTING CLOSURE OF A PORTION
OF CENTRAL ROAD IN ORDER TO CONDUCT A PARADE
WHEREAS, the Village of Mount Prospect desires to hold the annual Independence
Day Parade on a portion of Central Road and Elmhurst Road (Route 83) in the
Village of Mount Prospect on Tuesday, July 4, 2006; and
WHEREAS, said parade will require closure of that portion of Central Road between
Northwest Highway and Busse Road, the curb lane of Westbound Central Road
between Busse Road and Arthur Street, and Elmhurst Road (Route 83) between
Northwest Highway and Golf Road; and
WHEREAS, the State of Illinois requires that the Village assume all responsibility
and liability involved in the closure of said State roadways.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the Village of Mount Prospect hereby requests the State of
Illinois, Highway Department, to close Central Road between Northwest Highway and
Busse Road, the westbound curb lane of Central Road between Busse Road and
Arthur Street, and Elmhurst Road (Route 83) between Northwest Highway and Golf
Road between the hours of 1 :00 P.M. and 3:00 P.M. in order to conduct the annual
July 4th Parade, a copy of which parade route and requested roadway closures is
attached hereto.
SECTION TWO: That the Village of Mount Prospect will assume full responsibility for
the direction, protection and regulation oftraffic during the time the detour is in effect
and all liability for damages of any kind occasioned by the closure of the
aforementioned roadways.
SECTION THREE: That the Village of Mount Prospect will provide for efficient, all
weather detour signs, to be maintained, conspicuously marked and judiciously
patrolled by the Police Department for the benefit of traffic diverted as a result of the
street closure requested herein.
