HomeMy WebLinkAboutOrd 5564 05/16/2006 ORDINANCE NO. 5564 AN ORDINANCE DISCONNECTING CERTAIN PROPERTY FOR THE VILLAGE OF MOUNT PROPSECT (531 DOUGLAS AVENUE) Passed and approved by the President and Board of Trustees the 16th day of May, 2006 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 1 ih day of May, 2006 ~,..."--".,-,:,".""C''''''',"""",""":",."",,,,,,,;,,",,.~..,.=,,,,,,~-,,,,,,,,,,~.~.,,,,,,,.,...,".',,,,;=,=~,,,,,,,,,,,,,=~.',,,,,,,,,,,',-,,,,:C""~"'''",,_~~==''=T._.~_,___~.___ ORDINANCE NO. 5564 AN ORDINANCE DISCONNECTING CERTAIN PROPERTY FROM THE VILLAGE OF MOUNT PROSPECT (531 DOUGLAS AVENUE) WHEREAS, the North Star Trust Company, as Trustee under Trust No. 1500, dated 4/29/88, and Larry McKone, having a beneficial interest in said trust (hereinafter the "Owner"), are the legal owners of record of all land within the territory hereinafter described (hereinafter the 'Territory"), there being no electors residing thereon; and WHEREAS, the Owner has filed with the Village Clerk of the Village of Mount Prospect, Cook County, Illinois, a Petition to Disconnect from the Village of Mount Prospect requesting that the Territory be disconnected from the Village of Mount Prospect (hereinafter the "Petition to Disconnect"); and WHEREAS, the Territory, commonly known as 531 Douglas Avenue and legally described on the Petition to Disconnect, which is attached hereto and made a part hereof as Exhibit A, consists of less than 160 acres and is within the corporate limits of the Village of Mount Prospect but contiguous to the corporate limits of the Village of Arlington Heights; and WHEREAS, the Petition to Disconnect was filed by the Owner pursuant to, and in accordance with, 65 ILCS 5/7-1-24 of the Illinois Municipal Code; and WHEREAS, the Owner has filed a petition to annex the Territory into the Village of Arlington Heights, which will not become effective until the approval of this Ordinance by the President and Board of Trustees of the Village of Mount Prospect pursuant to 65 ILCS 5/7-1-24. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF ITS HOME RULE POWER, AS FOLLOWS: SECTION 1: The Territory shall be disconnected from the Village of Mount Prospect, Cook County, Illinois, but only after the Territory has been annexed by the Village of Arlington Heights, Cook County, Illinois. SECTION 2: This Ordinance shall be in full force and effect from and after its passage and approval as required by law.
