SC//caf 4/22/97 ORDINANCE NO. 4855 AN ORDINANCE AMENDING CHAPTER 16 (DEVELOPMENT CODE) OF THE VILLAGE CODE OF MOUNT PROSPECT NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Section 16.408 entitled "Landscaping" of Article IV of Chapter 16 (Development Code) of the Village Code of Mount Prospect, as amended, is hereby further amended in its entirety; so that hereafter said Section 16.408 shall be and read as follows: "Sec. 16.408. Landscaping. Any development or subdivision subject to the requirements of this Chapter shall provide landscaping within the development and on public rights of way adjacent to or within such development. Landscaping required by this Chapter shall be a condition to the issuance of a certificate of occupancy for any improvements built on the subject property. Landscaping on private property shall be subject to the landscaping requirements of Chapter 14. A Requirements for Parkway Trees. Trees shall be planted in all parkways and shall be placed subject to the direction and approval of the Director of Public Works. The Director of Public Works shall be responsible for the purchasing and planting of all trees within and upon the public right of way. The applicant shall pay for such planting as detailed in Section 16.611 of this Chapter. 1. Number and Size of Trees Required: Parkway tree planting fees required by this Section shall be determined by calculating the number of two and one-half inch (2-1/2") diameter trees that may be planted forty feet (40') apart along any public right-of-way adjacent to the subject property. The amount payable per tree shall be determined as detailed in Section 16.611. In downtown areas zoned B-5 or B5-C, the above minimum spacing standards may be modified by the Director of Public Works as detailed in the current Arboricultural Standards Manual on file in the offices of the Department of Public Works. 2. Planting Requirements. All plantings within a public right of way shall comply with the requirements set forth in Chapter 9, Article V (Trees and Shrubs) of the Municipal Code. 3. If deemed necessary by the Director of Public Works, the parkway tree requirement may be satisfied if an equivalent number of trees of the same size or larger are planted in the front yards of all adjoining lots. 4. Should completion of the development extend beyond a one year period; the applicant shall be required to post additional funds to cover any increase in cost to plant the remaining trees. B. Existing Public Property Landscaping. 1. The Director of Public Works shall determine if existing trees in the public right of way shall be preserved or removed. Trees to be preserved shall be protected from injury as specified in Chapter 9, Article V (Trees and Shrubs). It shall be the responsibility of the applicant to remove the trees designated for removal, along with their stumps. 2. Where shrubbery or evergreen trees exist in the public right of way, the applicant shall be required to remove the plantings, except in the case of shrubs planted in downtown areas zoned B-5 or .B-5C that were ! specifically exempted from planting restrictions as explained in Section 9.501 of Chapter 9 of this Village Code. Appeals for relief from the requirements of this subsection B.2. may be made by following the sight obstruction appeal procedure set forth in Section 9.117 of Chapter 9 of this Village Code. C. Areas to be Graded and Sodded. 1. All unpaved areas within the dedicated right of way shall be graded and sodded in an approved manner. Restoration work shall be performed to the satisfaction of the Director of Public Works. 2. All parkways shall be graded smooth and topped with at least four inches (4") of black dirt after compacting and removal of stumps, trees that cannot be saved, boulders and such. Such areas shall be sodded. 3. Upon recommendation of the Director of Public Works, the President and Board of Trustees of the Village may require additional sodding of a lot to prevent soil erosion and blockage of drainage systems." SECTION TWO: That Article VI entitled "Review Fees, Development Permit Fees, Public and Private Improvement Guarantees, Connection Fees, Recapture Agreementsu of Chapter 16 (Development Code), as amended, is hereby further amended by adding thereto Section 16.611 entitled "Parkway Tree Fees"; so that hereafter said Section 16.611 shall be and read as follows: "Sec. 16.611 Parkway Tree Fees. If parkway tree plantings are required as specified in Section 16.408 of this code, the applicant shall, prior to final plat or development plan approval, post with the Director of Finance a cash deposit or treasurer's or cashier's check payable to the Village in an amount equal to the number of trees required to be planted in the public parkway pursuant to this Section multiplied by the amount charged by the Village to cover the cost of such trees, and any and all work connected with the guaranteed planting of such trees as such amount is established from time to time by the Village Manager. The Village shall use such funds to plant trees in the parkway." SECTION THREE: That this Ordinance shall be in full force and effect from and after is passage, approval and publication in pamphlet form in the manner provided by law.
