ORDINANCE NO. 4858
AN ORDINANCE GRANTING A MODIFICATION FROM
THE DEVELOPMENT CODE (CHAPTER 16) FOR THE
WESTGATE APARTMENTS, 280 - 290 WESTGATE ROAD
WHEREAS, WESTGATE, LLC, (hereinafter referred to as Petitioner) has requested a
modification from the Development Code (Chapter 16) of the Village of Mount Prospect
for property generally located at 280 - 290 Westgate Road hereinafter referred to as
Subject Property) and legally described as follows:
Lot 17 in C. A. Goelz Prospect Gardens, being a subdivision of the West half
of the southeast 1/4 together with the East 2/3 of the North 3/4 of the
Northwest 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range
11, East of the Third Principal Meridian, in Cook County, Illinois; and
WHEREAS, the Petitioner is requesting a modification from the Development Code, in
conjunction with the conversion from apartments to condominiums, to allow a slope ratio
on the existing retention pond of 3:1; and
WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the
proposed modification from the Development Code (Chapter 16) for the Subject Property
at their regular meeting on March 19, 1997;
WHEREAS, the Plan Commission has forwarded its recommendations relative to the
modification requested herein to the President and Board of Trustees of the Village of
Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporate herein as
findings of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: That the President and Board of Trustees of the Village of Mount
Prospect do hereby grant to the Subject Property a modification from the Development
Code (Chapter 16) to allow a slope ratio of 3:1 on the existing retention pond.
SECTION THREE: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
