AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
LOCATED ON LOT 7 IN ELMHURST-ALGONQUIN
INDUSTRIAL PARK UNIT NO.2
! WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hea~

~ this request to reduce the side yard on the east side of the property to nineteen feet I
!, eleven and one-half inches (19'lH"). to reduce the side yard on the west side of the I
II property to ten feet one-half inch (10' ~If), and to reduce the minimum lot size requirq-
II ment from four (4) acros to 51,680 square feet. i
II WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did reco~'
i mend to the President and Board of Trustees of the Village of Mount Prospect thel
i approval of this request under Case No. 35-V-73 for the reasons that: l

There is a practical difficulty and particular hardship
upon the petitioner;

II (2) The purpose of the variations is not based exclusively
~i upon a desire to make money;
II (3) The conditions upon which the petition for these varia-
~l tions is based are unique in that the property was here-
il tofore subdivided, fully improved, and developed in
d unincorporated Cook County prior to its annexation to
'I the Village of Mount Prospect;

" to the public or injurious to surrounding property in that

it will not alter the essential character of the locality; and
!,' WHEREAS, the President and Board of Trustees of the Village of Mount Prospect I
I have reviewed the matter herein and have determined that the same is in the best

il NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
II TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

II SECTION ONE: That the property being the subject matter of Case No. 35-V-73, I

Ii being a subdivision in the Southeast Quarter of Section 23, Township
1I 41 North, Range 11 East of the Third Principal Meridian, in Cook

is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as 1-1 (Light Industrial District) , which zoning classification shall remain in effect
subject to the variations granted herein:
(a) To reduce the industrial side yard on the east side of the
property to nineteen feet eleven and one-half inches (19'11~"),
and to reduce the said industrial side yard on the west side
of the property to ten feet one-half inch (1 Off~lf) ;
(b) To reduce the minimum lot size requirement from four (4)
acres to 51,680 square feet.
SECTION TWO: That all requirements of the Mount Prospect Building and
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction
in accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null
void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variations is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.
