WHEREAS, the Village of Mount Prospect operates a combined water works and sewe~

ORDINANCE NO. 2485
AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 23
TO PROVIDE FOR CERTAIN SEWER AND WATER
CONNECTION CHARGE
WHEREAS, the corporate authorities of the Village of Mount Prospect have powers
under the Illinois Municipal Code and under the 1970 Constitution of the State of
Illinois to provide for and collect a fair and reasonable charge for connection to any
such water works and sewage system, which charge shall cover the expansion and I
extention of the works of the said water works and sewage system, and which charge!
is to be assessed against new or additional users of the system so expanded and ex-
tended; and

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect havel
reviewed the needs of owners of land in the vicinity of Westgate Road and Marcella ~
Lane within the corporate limits of the Village of Mount Prospect and have determined
that the expansion and extention of the water works and sewage system is necessary I
for the said area to meet said needs; and ~

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES~
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: I

SECTION ONE: That, pursuant to the authority vested in the Village of Mount Prosp~ct
under-Article VII of the 1970 Constitution of the State of Illinois as well as the Illinois I
Revised Statutes, Section 23.110 and Section 23.111 of Article I of Chapter 23 (Water I
and Sewer) of the Municipal Code of Mount Prospect of 1957, as amended, be and the!
same is hereby further amended by renumbering said Section 23.110 and Section 23.i11
respectively to allow the insertion within the said Article I of an entirely new sectionl
Section 23.110, establishing reasonable fees for connection to the water works and i
sewage system of the Village of Mount Prospect; so that hereafter the said Sections 2~.1
23.111, and 23.112 shall be and read as follows:
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect be-
lieve that the best interests of the Village of Mount Prospect will be attained by the
passage of this Ordinance;
"SECTION 23.110. Water Works and Sewage Connection Charge.
A. Prior to the tapping into certain water mains and sewer lines shown
upon Exhibit A attached hereto and hereby made a part hereof, the
following designated lots and parcels (also shown on Exhibit A) ,
shall pay the following prescribed fair and reasonable charges for
connection to the said water works and sewage system, which charges
for connection shall be in addition to any other tap-on fees or other
charges prescribed under other ordinances of the Village of Mount
Prospect:

I SECTION TWO: That this Ordinance shall be in full force and effect from and after
l passage, approval, and public ation in the manner provided by law.

B. The persons, firms, or corporations desiring to make any such connec-
tion to any portion of the water works and sewage system set forth in
subsection A hereinabove shall pay the entire amount due and owing
as a connection fee prior to the actual connection, or shall make pay-
ment in installments, provided such connection charge is fully paid
within six (6) months from the time of the connection, and further pro-
vided that the applicant desiring such connection gives guarantee of
payment of all installments in the form approved by the Village Attorney
of the Village of Mount Prospect.
C. The funds thus collected for such connections shall be used by the Vil-
lage of Mount Prospect for its general corporate purposes with primary
application thereof being made to offset the necessary expansion of the
water works and sewage system reflected in subsection A hereinabove
in order to meet the requirements of the new or additional users
thereof.
SECTION 23.111.
Restriction on Use of Water.
A. No person shall at any time, without proper authority, take any water
from a fire hydrant.

B. In case of mechanical failure of any of the wells providing water for
the Village or in case of a water shortage, the Village Manager, upon
declaring an emergency exists, shall be authorized to impose immedi-
ate restrictions upon the use of water for sprinkling.
SECTION 23.112. Penalty. Any person, firm, or corporation violating any
provision of this Article shall be fined not less than Ten ($10.00) Dollars
nor more than Two Hundred ($200.00) Dollars for each offense; and a se-
parate offense shall be deemed committed on each day during or on which
a violation occurs or continues. "
