ORDINANCE NO. 2492
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 320 WEST CENTRAL ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on January 31, 1974, at the hour of 8: 00 p. m. in the Village Hall and did hold a
public hearing under Case No. 6-V-74, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear a
petition requesting a variation to enlarge a presently non-conforming residential use
in an otherwise commercial building located in the B-3 (Business-Retail and Service)
zoning district under the Zoning Ordinance of the Village of Mount Prospect; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect the
granting of this variation by a vote of 6-0 and has found that:
1. There is a practical hardship on the petitioner in that the
present structure is a sixteen year old building in which
there is a 4-room apartment used as living quarters; and
that due to an increase in the family status, the petitioner
is in need of additional room;
2. The purpose of the variation is not based exclusively upon
the desire to make money;
3 . The granting of the variation will not be detrimental to the
public or injurious to surrounding property in that it will
not alter the essential character of the locality; and
ilwHEREAS , the Building Committee of the Board of Trustees of the Village of Mount
:IProspect did subsequently meet on February 21, 1974, and considered Case No.
iI6-V-74, and recommended to the President and Board of Trustees that the variation
:!reqUested under the said Case No. 6-V-74 be granted; and "

i!SECTION ONE: That the property being the subject matter of Case No. 6-V-74, beingi
!Ilegally described as follows:

il Lot 9, 10, 11, 12, 13 and 14, Block 25 Prospect Manor Subdivision,
tl of part of the South Three-Quarters (3/4) of the West Half (1/2) of
,I Section 34, Township 42 North, Range 11 East of the Third Principal
'i Meridian, in Cook County, Illinois;

is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
B-3 (Business-Retail and Service) District, which zoning classification shall remain
subject to the variation granted hereinbelow:
That there be allowed one (1) dwelling unit consisting of a total
of seven (7) rooms and located on the second floor level and at
the rear of the existing funeral parlor building.

l SECTION TWO: That, except for the variation granted in SECTION ONE hereinabove J
i all other requirements of the Building Code and Zoning Code of the Village of Mount !
i Prospect shall be applicable including the requirement that the three (3) room addi- '
1 tion applied for under Case No.6-V-74 be constructed in compliance with the codes

Iii relative to construction in Conflagration Hazard District Number 1.

II SECTION THREE: That, in accordance with the plans for the addition hereinabove
II mentioned, which plans are attached hereto and hereby made a part hereof as Ex-
~; hibit I, the Director of Building and Zoning of the Village of Mount Prospect is here-
!!bY authorized and directed to issue a building permit in accordance with the varia-
11 tion hereinabove mentioned.

II SECTION FOUR: That the variation granted by this Ordinance shall be null and

!lvoid and of no force and effect whatsoever unless an application for a building per-
'! mit pursuant to such variation is made and constructed commenced within one (1)
!Iyear of the date said Ordinance becomes effective.

i,','ISECTION FIVE: That this Ordinance shall be in full force and effect from and after
I its passage, approval, and publication in the manner provided by law.
