ORDINANCE NO. 2494
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
LOCATED AT 1300 WEST NORTHWEST HIGHWAY,
MOUNT PROSPECT, ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
on the 21st day of February, 1974, at the hour of 8:00 p.m., at the Mount Pros-
pect Village Hall and did hear Case No. 12-V-74, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to eliminate the easterly side yard requirement and to reduce the front
yard requirement to seven feet (7'); and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
to the President and Board of Trustees of the Village of Mount Prospect the approval
of this request under Case No. 12-V-74 for the reasons that:
(1) There is a practical difficulty and particular hardship
upon the petitioner;
(2) The purpose of the variation is not based exclusively
upon a desire to make money;
(3) The conditions upon which the petition for these variations
are based are unique in that the property is shpaed in the
configuration of a parallelogram and is located adjacent to
a park site which is likely never to be developed;
(4) The granting of these variations will not be detrimental to
the public or injurious to surrounding property in that it
will not alter the essential character of the locality; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 12-V-74,
being legally described as follows:
That part of Davidson Avenue adjoining Lot 6 in H. Roy Berry Com-
pany's Northwest Heights, being a Subdivision of all that land lying
North of the Chicago and North Western Railroad in the Northwest
Quarter of the Southeast Quarter of Section 33, Township 42 North,
Range 11 East of the Third Principal Meridian; which lies Southerly
of a line drawn perpendicularly to the East line of Lot 65 in said Sub-
division and passing through the most Southerly corner of said Lot;
and lying Northerly of the Westerly extension of the Sound line of
Lot 64 in the aforesaid Subdivision and lying Northeasterly of the
Southeasterly extension of the Southwesterly line of said Lot 6 ,
all in Cook County, Illinois,

is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
B-2 (Business-Office District) , which zoning classification shall remain in effect
subject to the variations granted herein:
(a) That the ten foot (10') side yard requirement adjacent to the
easterly side yard be eliminated; and
(b) That the twenty foot (20') front yard requirement be reduced
thirteen feet (13') to seven feet (7') adjacent to Isabella Street.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accord-
ance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
and of no force and effect whatsoever unless an application for a building permit
suant to such variations is made and construction commenced within one (1) year of
the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.
