WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did con- I
duct Public Hearings under Case No. 4-Z-74 and Case No. 5-Z-74 on January 24, I
1974, and on March 28, 1974, on a request for amendments to the text of the Zon- I
ing Ordinance of the Village of Mount Prospect with respect to certain height regu- I
lations, definitions, and allowable uses in the B-3 zoning district classification; and1

WHEREAS, notices of the aforesaid Public Hearings were made and published in the I
I
manner provided by law; and i

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect hav~
determined that the best interests of the Village of Mount Prospect will be attained by!

adoption of the following Ordinance regarding the requests contained in Case No. i
4-Z-74 and Case No. 5-Z-74;
AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT

NOW, THEREFORE, pursuant to the power vested in the Corporate Authorities of I
the Village of Mount Prospect under Article VII of the 1970 Illinois Constitution, as I
well as Chapter 24 of the Illinois Revised Statutes, BE IT ORDAINED BY THE PRESI- I
DENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK i
COUNTY, ILLINOIS: I

SECTION ONE: That subsection C of Section 14.1004 of the Municipal Code of Mount I
Prospect of 1957, as amended (Zoning Ordinance), be amended to allow ham radio I
operators and antenna towers to be erected in the R-X single family residential zon-I
ing districts of the Village of Mount Prospect; so that hereafter the said subsection cl
contained in said Section 14.1004 shall be and read as follows: I

"Section 14. 1004. Height Regulations.
C. Federally licensed amateur radio operator's transmitting antenna
towers with a maximum height of sixty (60) feet and such antenna
tower structures having an over-all height of not more than seventy
(70) feet, chimneys, flag poles, and steeples shall be excluded from
the regulations contained in this Section 14.1004."
SECTION TWO: That subsection C of Section 14.1104 of the Municipal Code of Mount
Prospect of 1957, as amended (Zoning Ordinance) , be amended to allow ham radio
operators and antenna towers to be erected in the R-1 single family residential zon-
ing districts of the Village of Mount Prospect; so that hereafter the said subsection C
contained in said Section 14.1104 shall be and read as follows:
"Section 14.1104. Height Regulations!-.
C. Federally licensed amateur radio operator's transmitting antenna
towers with a maximum height of sixty (60) feet and such antenna
tower structures having an over-all height of not more than seventy
(70) feet, chimneys ,flagpoles, and steeples shall be excluded from
the regulations contained in this Section 14.1104."

SECTION THREE: That subsection C of Section 14.1204 of the Municipal Code of i
Mount Prospect of 1957, as amended (Zoning Ordinance), be amended to allow ham !
radio operators and antenna towers to be erected in the R-A single family residential
zoning districts of the Village of Mount Prospect; so that hereafter the said SUbsectidp
C contained in the said Section 14. 1204 shall be and read as follows: !i
"Section 14.1204. Height Regulations .
C. Federally licensed amateur radio operator's transmitting antenna
towers with a maximum height of sixty (60) feet and such antenna
tower structures having an over-all height of not more than seventy
(70) feet, chimneys, flag poles, and steeples shall be excluded from
the regulations contained in this Section 14. 1204. "
SECTION FOUR: That Section 14.2001 of the Municipal Code of Mount Prospect of
1957, as amended (Zoning Ordinance) , regarding permitted uses in the B-3 zoning
classification be amended to provide for Regional Shopping Centers, Orphanages,
Homes for the Aged and similar institutions as allowable uses within the said B-3
zoning districts; so that hereafter the said Section 14.2001 shall be and read as
follows:
"SECTION 14.2001. Permitted Uses. In the B-3 Business Retail and
Service District, the only uses which may hereafter be established are:
A. Temporary carnival or circus, operating not longer than ten (10) days;
B. Cleaning, dyeing, and laundry establishments where no actual clean-
ing, dyeing, or laundry is done on the premises;
C. Coin operated cleaning, dyeing, and laundry establishments;
D. Finance Banking, including: Federal Reserve Banks; Commercial
and Stock Savings Banks; Mutual Savings Banks, Trust Companies;
and establishments performing functions closely related to banking
such as Check Cashing Agencies and Currency Exchanges, Safe De-
posit Companies, and Clearing House Associations;
E. Financial Institutions other than banks, including: Savings & Loan As-
sociations, Rediscount and Financing Institutions for Credit Agencies
other than banks, Personal Credit Institutions, and Business Credit
Institutions;
F. General hospitals for humans, orphanages, homes for aged and simi-
lar institutions;
G. Hotel, lodging house, or motel, with sleeping rooms or units in num-
ber not exceeding one (1) for each five hundred (500) feet of lot area;
H. Professional or business office;
J. Parking lots for private self-propelled passenger automobiles;
K. Regional Shopping Center;
L. Restaurant (except drive-in variety) , tavern, or confectionery;
M. Private music, dancing, business, vocational, or other school or
college;

N. Signs, inasfar as they may be allowed under the Sign Ordinance of
the Village of Mount Prospect;
O. Undertaking or funeral parlor;
P. Village Hall, Police or Fire Station, or other municipal building; and
Q. Retail business establishments, whether retail sales or retail service,
except the following uses hereby specifically excluded:
1. Abattoirs
2. Advertising signs, billboards, or poster panels
3. Animal hospital, including dog pounds
4. Amusement centers, including theatres, indoor and outdoor;
arcades, dance halls; miniature golf courses; and golf driving
ranges
5. Arsenals
6. Automobile garages, laundries, sales operations, and/or
service stations
7. Bag cleaning establishments
8. Boiler works
9. Bottling works
10. Bowling Alleys
11. Building material storage yards; including coal, coke, or wood
yards, and lumber yards
12. Bus passenger stations or passenger terminals
13. Cleaning, dyeing, and laundry establishments where cleaning,
dyeing, or laundry is done on the premises
14. Coke ovens
15. Crematories
16. Rock crushers
17. Dance halls
18. Incineration or reduction of garbage, dead animals, offal,
or refus e
19. Central mixing plants for cements, mortor, plaster, or paving
materials
20. Golf driving range and miniature golf courses

21. Drive-in restaurants
22. Skating rinks
23. Junk, iron, or rag storage or bailing
24. Storage warehouses
25. Smelters
26. Commercial swimming pools
27. Truck and bus terminals, and milk distributing stations
28. Trampoline centers
29. Public Utility substations and facilities
30. Wrecking or junk yards"
SECTION FIVE: That paragraphs 28 through 46 of subsection B of Section 14.2602
the Municipal Code of Mount Prospect of 1957, as amended (Zoning Ordinance) , be
and the same are hereby further amended in their entireties and a new paragraph,
No. 47, be added to the aforesaid subsection B of Section 14.2602; so that hereafter
the said paragraphs 28 through 47 shall be and read as follows:
"28. MAXIMUM HEIGHT:
(a) In feet, the vertical distance from grade as established in this
Chapter to the highest point of the roof or parapet, whichever
is greater, of a building; provided, that antenna towers with
a maximum height of sixty (60) feet and antenna tower struc-
tures (including mast and antenna) having an over-all height
of not more than seventy (70) feet, penthouses, steeples, or
other towers shall not be counted in measuring the height of
buildings.
(b) In stories, the number of habitable stories in a building, ex-
clusive of basement, cellars, penthouses containing no habit-
able rooms, antenna towers with a maximum height of sixty (60)
feet and antenna tower structures (including mast and antenna)
having an over-all height of not more than seventy (70) feet,
steeples, and/or other towers.
34. PUBLIC STREET FACTOR: A resultant mathematical factor deter-
mined by dividing the total number of lineal feet of proposed and
existing public street frontage abutting the Residential Development
by the total number of square feet in the Residential Development
tract submitted for approval.
35. REGIONAL SHOPPING CENTER: A business development containing
ten (10) or more indoor retail stores conneGted by party walls develop-
ed under one ownership, with an integrated building arrangement, hav-
ing an aggregate floor area of more than one hundred thousand (100,000)
square feet and located on a lot at least fifty (50) acres in size, which
development with its off-street accessory parking facilities shall be con-
sidered as a single unit. The term "Regional Shopping Center" shall
not be confused with the term "Shopping Center".

36.
REAR YARD: The rearmost area of any lot in the zoning districts of the
Village of Mount Prospect as required by this Zoning Ordinance and main-
tained, except for ingress and egress drives and sidewalks transversing
the same in a fashion other than parallel to the rear lot line it abuts, as
open space except as otherwise provided by this Municipal Code.
37.
RESIDENTIAL DEVELOPMENT: A tract of land not less than twenty-seven
thousand (27,000) square feet which is developed as a unit under single
ownership or control. Said tract may be composed of one or more lots
provided:
(a) That each lot shall not have less than nine thousand (9,000)
square feet;

(c) That no lot be improved by more than one building thereon, unless suc~
lot is improved as a Planned Unit Development under Article XXV hereiJh.

SHOPPING CENTER: A business development containing four (4) or more I
indoor retail stores, connected by party walls, developed under one owner~
I
ship, with an integrated building arrangement having an aggregate floor I
area of more than twenty thousand (20,000) square feet, which developmen~
with its off-street accessory parking facilities shall be considered a single I
uni 1.
(b) That the F .A.R. is observed as to each lot; and
(a) The term "Shopping Center" shall not include drive-in and/or auto-
motive service type or sale facilities but shall include all other retail
sales and service facilities.
(b) The term "Shopping Center" shall not be confused with the term
"Regional Shopping Center" .
39. SIDE YARD: That area of any lot located between the side lot line thereof
and a building or structure thereon; found within the zoning districts of
the Village of Mount Prospect as required by this Zoning Ordinance; and
maintained, except for ingress and egress drives and sidewalks trans-
versing the same in a fashion other than parallel to the side lot line it
abuts, as open space.
40. STORAGE WAREHOUSE: The business of receiving and storing goods of
others for compensation or profit.
41.
STRUCTURE: Any construction or any production or piece of work arti-
fically built up or composed of parts joined together in some definite man-
ner, the use of which requires permanent location in or upon the land or
requires attachment to something having a permanent location in or upon
the land; including but not limited to stadia; gospel and circus tents, re-
viewing stands, platforms, radio towers, air conditioning compressor
units, coal bins, fences, display signs, advertising signs, billboards,
and poles connected by wires for the transmission of electricity.

42. STRUCTURAL ALTERATIONS: Any change in the supporting members
of a building or structure, including among others, any change in the
bearing walls, columns, beams, or girders.

43. TRUCK TERMINAL: Either end of a carrier line or junction point with
other lines having classifying yards or dock facilities, management
offices, storage sheds, and freight and passenger stations.
44. VILLAGE: The Village of Mount Prospect.
45. VILLAGE MANAGER: Village Manager of the Village of Mount Prospect.
46. WHOLESALE BUSINESS: The business of selling goods in gross for re-
sale to retail dealers and not to ultimate users thereof.
47. ZONING ADMINISTRATOR: The Director of Building and Zoning of the
Village of Mount Prospect, and/or his duly authorized agent (s) . "
SECTION 'SIX: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.
