ORDINANCE NO. 2520
AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT
VARIATION FOR PROPERTY LOCA TED AT THE NORTHEAST
CORNER OF THAYER AND FOREST STREETS,
MOUNT PROSPECT, ILLINOIS

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did mee~
on the 25th day of April, 19711: ,at the hour of 8: 00 p.m., at the Mount Prospect !
Village Hall and did hear Case No. 14-V-74, pursuant to proper legal notice; !
and

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hea~
this request for a front yard variation to allow the petitioner to construct a residencel
to within eighteen (18) feet four (4) inches of Thayer Street instead of the required I
thirty (30) foot front yard setback upon the lot legally described hereinbelow; and I

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recolm.
mend to the President and Board of Trustees of the Village of Mount Prospect thel
approval of this request under Case No. 14-V-74 for the reasons that: i

(1)
There is a practical difficulty and particular hardship on
the petitioner;
(2) The purpose of the variation is not based exclusively upon
a desire to make money;
(3)
The granting of this variation will not be detrimental to
the public or injurious to surrounding property in that
it will not alter the essential character of the locality; and

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect I
have reviewed the matter herein and have determined that the same is in the bes!!:
interests of the Village of Mount Prospect; r

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF I
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: I

SECTION ONE: That the property being the subject matter of Case No. 14-V-74,!
being legally described as follows: i

All of LOT TWELVE--The South Seventeen feet of LOT THIRTEEN--
in Block Thirteen, in Prospect Manor Subdivision of part of the
South three quarters of the West Half of the West Half of Section
34, Township 42 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-l (Single Family Residence District), which zoning classification shall re-
main in effect subject to the variation granted herein:
That the front yard abutting Thayer Street be reduced by eleven
(11) feet eight (8) inches so as to allow construction of a single
family home thereon to within eighteen (18) feet four (4) inches
of Thayer Street.

SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction
in accordance with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null and I
void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variation is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.
