ORDINANCE NO. 2532
AN ORDINANCE AMENDING ARTICLE XIII OF
CHAPTER FIVE OF THE MUNICIPAL CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the power and authority given Home Rule Units
in Article VII of the 1970 Constitution of the State of Illinois, Chapter 5 of the Muni-
cipal Code of Mount Prospect of 1957, as amended, be and the same is hereby fur-
ther amended by amending Article XIII in its entirety, creating and establishing
a Business District Development and Redevelopment Commission, for the Village
of Mount Prospect, so that said Article XIII of Chapter 5 shall hereafter be and
read as follows:

and REDEVELOPMENT COMMISSION
SECTION 5.1301. Creation and Purpose. In that it is essential to the eco-
nomic and social welfare of the Village of Mount Prospect, there is hereby
established a citizens' commission which shall be known as the "Business
District Development and Redevelopment Commission of the Village of Mount
Prospect" for the purpose of establishing a plan for the central business
district within the corporate limits of the Village of Mount Prospect to as-
sure opportunities for redevelopment and to attract sound and stable com-
mercial growth therein.
SECTION 5.1302. Membership.
A. The voting members of the Business District Development and Redeve-
lopment Commission shall be seven (7) residents of the Village of
Mount Prospect.
1. The Village President shall appoint the Chairman and other mem-
bers of this Commission with the advice .and consent of the Board
of Trustees. In the determination of such appointments, considera-
tion shall be given to the appointees' background relating to indus-
try, commerce and municipal planning.
2. The term of office to this Commission shall be for a period of four
(4) years, or until their successors are appointed and qualified.
However, members appointed at the onset shall be for the follow-
ing terms:
Two (2) members for an initial term ending April 30, 1978;
Two (2) members for an initial term ending April 30, 1977;
Two (2) members for an initial term ending April 30, 1976; and
the Chairman for an initial term ending April 30, 1975.
Successors shall be appointed for four (4) year terms.
3. Members may succeed themselves, and shall serve without com-
pensation.
B. The ex-officio or non-voting members shall be the Village President
and the Chairman of the Planning Commission of the Village, or his
designee.

SECTION 5 .1303. Organization.
A. Immediately upon its organization, the Business District Development
and Redevelopment Commission shall select from its membership a
vice-chairman and a secretary. The persons so selected shall serve
for terms of one (1) year, and may be reelected to said position.
B. The Commission shall adopt rules for the conduct of its meetings and
keep written minutes of all meetings and other proceedings.
C. All meetings of the Commission shall be public and its minutes shall be
available for examination in the office of the Village Clerk during regu-
lar business hours.
SECTION 5. 1304. Duties and Responsibilities. In establishing a plan for
the Central Business District development and/or redevelopment, the Busi-
ness District Development and Redevelopment Commission shall have the
following powers, duties, and obligations, the exercise of which shall be
dedicated to the promotion of the public interest and the enhancement of the
tax base of the Village of Mount Prospect:
A. To make findings and recommendations to the President and Board of
Trustees of the Village of Mount Prospect regarding:
1. The area of the Village of Mount Prospect which may be designated
as a Central Business District by the President and Board of Trust-
ees after a public hearing on the subject;
2. The approval of all development and redevelopment proposals for
a central business district;
3. The exercise of the use of eminent domain for the acquisition of
real and personal property for the purpose of a development or re-
development project;
4. The acquisition, management, conveyance, or other disposal of
real and personal property acquired pursuant to the provisions of
a development or redevelopment plan;
5. The application for and acceptance of capital grants and loans from
the United States and the State of Illinois, or any instrumentality of
the United States or the State, for central business district develop-
ment and redevelopment;
6. The issuance of such obligation or revenue bonds as may be deemed
necessary, subject to applicable limitations imposed by law, in
order to borrow funds as may be deemed necessary for the purpose
of central business district development and redevelopment;
7. Agreements and contracts with any public or private agency or
person;
8. Sale, lease, trade, or improvement of such real property as may be
acquired in connection with central business district development
and redevelopment plans;

9. The employment of all such persons as may be necessary for the
planning, administration, and implementation of central business
district plans;
10. The expenditure of such public funds as may be necessary for the
planning, execution, and implementation of the central business
district plans; and
11. The establishment by ordinance and/or resolution of procedures
for the planning, execution, and implementation of the central busi-
ness district planning, which may include the passage of an ordi-
nance creating a special zoning district to be included within the
Zoning Ordinance of the Village of Mount Prospect to regulate de-
velopment of the central business district -- provided that any such
proposals to amend the Zoning Ordinance of the Village of Mount
Prospect shall be presented to the corporate authorities by both
the Business District Development and Redevelopment Commission
and the Planning Commission jointly.
B. To make periodic reports on its progress and findings and to make its
recommendations to the President and Board of Trustees regularly, but
not less than every six (6) months. "
SECTION TWO: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.
