WHEREAS, the Zoning Board of Appeals of the Village of Mount pros-II'
pect heard testimony presented under Case No. 39-SU-74, on the .
24th day of October, 1974, pursuant to a request for certain spec-I'
ial us~s pursuant to t~e Mount Prospect Zoning Ordinance to per- I
mit certain uses upon the property hereinafter described; and I

AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY
COMMONLY KNOWN AS 1825 WEST ALGONQUIN ROAD
I" WHEREAS, notice of the public hearing held in conjunction with
the aforesaid Case was published in the manner provided by law;
and

WHEREAS, the Zoning Board of Appeals of the Village of Mount
Prospect did recommend to the President and Board of Trustees
of the Village of Mount Prospect the approval of this request
under Case No. 39-SU-74: and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have determ-
ined that the same is in the best interests of the Village of
Mount Prospect:
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF !
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: I

SECTION ONE: That pursuant to the Mount Prospect Zoning Ordinanc~l;
the following special use is hereby authorized on the property :
described in SECTION TWO herein- below: I

The operation of mechanical game machines and electronic
game machines as well as the lease of time thereon to
third parties for their amusement in the running of such
machines located on the said premises, provided that the
operation and the hours of such use of said machines con-
form to other applicable ordinances of the Village of
Mount Prospect.
SECTION TWO: That the special use authorized to be established
in SECTION ONE above shall not run with the land but shall be
valid and effective only so long as the establishment is operated
by David Geller upon the follQwing property legally described as:
Lot 3 (except the West 33 feet thereof taken for Briar-
wood Drive and except that part thereof falling in Algon-
quin Road) of Edward Busse1s Division of part of the
Southeast Quarter(~) of Section 15 and the
Northeast Quarter (~) of Section 22, Township 41 North,
Range 11 East of the Third Principal Meridian as per
plat recorded December 17,1919 as Document 6696216
(excepting therefrom that part thereof described as
follows: Commencing at a point 33 feet East of the South-
west corner of said Lot 3, said point being on the East
line of Briarwood Drive; thence North along the East line
of Briarwood Drive, a distance of 164.04 feet, to the placel
of beginning of the herein described part of Lot 3; thence I
East at right angles to the East Jine of Briarwood Drive,
a distance of 155.52 feet; thence North at right angles
to the last described line, a distance of 119.76 feet
to the Southwesterly line of Algonquin Road: thence
NOrthwesterly along the Southwesterly line of Algonquin
Road, a distance of 175 feet to the point of intersection

along the East line of Briarwood Drive, a distance of 200
feet to the place of beginning), in Cook County, Illinois,
which property has been zoned B-1 (Business-Shopping
Center) District, and which zoning classification shall re-
main in full force and effect.
SECTION THREE: That this Ordinance shall be in full force
and effect from and after its passage, approval and pub-
lication in the manner provided by law.
