HomeMy WebLinkAboutOrd 2505 06/04/1974 ORDINANCE NO. 2505 AN ORDI NANCE ESTABLISHING A SCHEDULE OF PERMIT FEES WHEREAS, the Electrical Commission of the Village of Mount Prospect has heretofore recommended to the President and Village Board the adoption of reasonable fees to be paid for inspection of all electrical equipment installed or altered within the Villag of Mount Prospect, in accordance with the provisions of Chapter 24, Section 11-37-3 of the Illinois State Statutes 1971, as amended; and WHEREAS, the President and Village Board has determined reasonable fees for inspectio and permits relating to other aspects of building construction, re-construction, alter ation, removal, demolition and related work and services; and WHEREAS, the President and Village Board of the Village of Mount Prospect has determin that the adoption of said fees as recommended is in the best interest of the Village 0 Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND VILLAGE BOARD OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: Fees for permits. required by the Building Code and related codes of the Vi lage of Mount Prospect shall be determined by reference to this ordinance, as follows: IIPERMIT FEES'~ 1. BASIS OF BUILDING PERMIT FEES: For the purpose of determining a basis for computi building permit fees, the estimated cost of construction shall be determined by th Director of Building and Zoning as follows: (a) The Director of Building and Zoning may accept an estimate furnished to him b, the applicant for permit; or (b) he may require a certificate of the cost of construction from a licensed arch tect or a registered structural or professional engineer; or (c) he may require an affidavit from the owner or his agent setting forth the est mated cost of the proposed work; or (d) he may make such estimate as Director of Building and Zoning. (page two) 2. FEES FOR PERMITS: The permit fees to be charged for permits authorized and requi by the Municipal Code shall be paid to the Village of Mount Prospect and shall be provided in the following sub-sections. 3. BUILDING PERMITS: The minimum fee for any permit to alter, construct, enlarge, er lower, raise, remodel, repair or underpin any building, structure or -part thereo as required by this ordinance, shall be twenty ($20) dollars~ provided that the c of the work authorized by said permit does not exceed one thousand (1,000) dollar When the cost of any such work exceeds one thousand ($1,000) dollars, the fee for said permit shall be computed at the rate of twenty dollars ($20) for the first 0 thousand dollars($I,oOO) of cost, plus six dollars ($6) for each additional thous dollars ($1,000) of cost or fraction thereof, to a maximum cost of forty thousand dollars ($40,000). For each one thousand dollars ($1,000) or fraction thereof ex ceeding a cost of forty thousand dollars ($40,000) the amount of the permit fee shall be increased by four dollars ($4) to a maximum cost of one hundred and fift thousand dollars ($150,000). For each additional one thousand dollars ($1,000) 0 fraction thereof of cost in excess of one hundred and fifty thousand dollars {$15 the permit fee shall be increased by three dollars ($3). 4. ELECTRICAL PERMITS: The permit fee to be charged for electrical installation and alteration shall be as follows: A. Minimum permit fee shall be ten dollars ($10). B. for the inspection of original installation of a single family residence, th fee shall be: ( 1)- 0 to 1,000 sq. ft. $25.00 (2) 1 , 00 1 to 1~599 sq. ft. 30 .00 ( 3) 1,600 to 2,399 sq. ft. 35.00 (4) 2,400 to 2,999 sq. ft. 40.00 (5) 3,000 sq. ft. and over 45.00 In addition to the foregoing an electrical service fee shall be paid in accordanc with schedule for new service fees. (page th ree) C. Conversions of single family residences, such as garages, recreation rooms, dormers, etc, the permit fee shall be computed on a circuit count basis. (see CIRCUIT COUNT SCHEDULE) D. The fee for the inspection of electric motors or power consuming devices othe' than lighting circuits or air conditioners shall be: (1) Base fee $6.00 (2) Plus each horsepower or kilowatt $ .50 (each kilowatt of electrical power shall be considered 1 H.P. for fee purposes) . For the inspection of a three (3) wire circuit, the fee shall be double the amount of a two (2) wire circuit. G. For the inspection of a four (4) wire circuit, the fee shall be three (3) times the amount of a two (2) wire circuit. H. The fees for examination of plans when plans are submitted that are not in conjunction with construction or plumbing shall be ten dollars ($10). I. J. When inspections are called for and re-inspection is required, are-inspection fee of $10 will be deducted from bond or deposit fees. K. For feeders installed or increased in ampacity as a separate installation: one feeder $ 10.00 each additional feeder 1.00 5. PLUMBING PERMITS: The fee for the installation, alteration or extension of a plumbing system shall be: A. Minimum permit fee shall be ten dollars ($10). B. Replacement of fixtures.............first five (5) fixtures......$ 4.00 a fix1 Fixtures in excess of five (5) .....$ 2.00. Alterations of a plumbing system....................... $ 16.00 plus the fee for fixtures replaced or installed. E. Water Connection Tap-on Fee. The "water connection tap-on fee" shall be based upon the size of the water tap made into the water system. (page six) All applicants for water service shall provide and pay the costs of constructior both labor and material, of the water service from the main to the premises to be served. This construction work in connection with the water service shall be performed by a licensed plumber who has a properly executed bond on file in the office of the Village clerk. The water meter shall be furnished by the Village and a charge made to cover the cost of such meter. For the connection charge, the Village will inspect the water service to determine that the construction thereof is in accordance with specifications established by the Village for the regulation of the water and sewer system. F. A chlorination fee of forty dollars ($40) shall be assessed for each water main and fire main system. 6. GAS PIPING PERMITS: The fee for permits for the installation of gas piping shall be computed on the basis of ten dollars ($10) per inch "(1.0.) plus an additional five dollars ($5) on each twenty-five (25) lineal feet or fraction thereof. 7. AIR CONDITIONING AND REFRIGERATION PERMITS: The fee for air conditioning and re- frigeration permits shall be ten dollars ($10) plus three dollars ($3) per ton or fraction thereof for the first twenty (20) tons. When the air conditioning or re- frigeration system exceeds twenty (20) tons the fee to be charged for the addition- al tons shall be computed at the rate of one dollar ($1) per ton or fraction thereo 8. MECHANICAL EQUIPMENT INSTALLATION PERMITS: Mechanical equipment permit fees other than air conditioning, refrigeration, combustion, elevators and fir~ protection systems shall be computed at the rate of ten dollars ($10) for the first one thou- sand dollars ($1,000) of valuation. The permit fee for work which exceeds one thousand dollars ($1,000) of valuation shall be computed at the rate of four dollar ($4) per additional one thousand ($1,000). (pagesev.en) 9. SEWER PERMIT FEES: The fee for the installation, alteration or extension of a sewer system shall be: A. Sewer connection tap-on fee. The IIsewer connection tap-on feell shall be one hundred fifty dollars ($150) for each separate building connection which con- tains not more than ten (10) water outlets or floor drains discharging to the sanitary sewer system. For each additional water outlet or floor drain contained in said premises in excess of ten (10) outlets there shall be an additional sewer connection tap- on fee for said connection of twenty-five dollars ($25) per water outlet or floor drain. In the event any building or premises contains more than one (1) dwelling un4 or commercial unit, an additional permit fee of one hundred fifty dollars ($: shall be made for each such multiple unit. B. The appl i cant for sewer servi ce shall, in all cases, pay for all costs of 1 a and materials required for installing the sewer s vice from the respective mains to the premises to be served. The constructi work in connection with the sewer service shall be performed by a licensed plumber who has a properly executed bond on file in the office of the Villas Cl erk-. For the connecti on charge, the Vill age will inspect the sewer servi ( to determine that the construction thereof is in accordance with specificat4 established by the Village for the regulation of the water and sewer system, c. An additional fee for plan review and final inspection will be required for all projects involving the extension of an existing sanitary-or storm sewer This fee shall be based upon the following percentages of the estimated con struction cost of the sewer extension (exclusive of services to the propose building) : (1) 2.0% of the construction cost of the improvements when such cost is fifty thousand dollars ($50,000) or less. (2) 1.5% of the construction cost of the improvements when such cost is over fifty thousand dollars ($50,000). (page eight) D. In each instance above where the said permit is issued for sewer connections lying outside the corporate limits of the Village of Mount Prospect, said shall be 200% of such fee listed hereinabove in orde~ to cover the additional costs and inspections thereof. E. As a further condition of the issuance of a permit, the individual or firm connecting to the sewer system shall provide a performance bond, payable to the Village of Mount Prospect, to cover the full cost of all sanitary sewer- age system improvements. (1) The amount of such performance bond shall be based upon an estimate of cost approved by the Village Engineer. (2) Said performance bond shall be effective for a period of two (2) year. following the projects acceptance by the Village Engineer, during which til the permittee shall be responsible for the maintenance of the improvements installed under the permit. (3) The performance bond shall also indemnify the Village of Mount Prospel from any costs, charges, expenses, loss or damage that may arise directly I indirectly out of the installation, construction or failure to maintain or repair the sanitary sewer so installed. . F. A fee of one dollar ($1) shall be paid to the Village of Mount Prospect fo each lineal foot of storm, sanitary, or combined sewer installed to help defr~ the cost of telivising said sewers. 10. STREET OBSTRUCTION PERMIT FEES - DEPOSITS - BONDS: No street, alley, parkway, or other public property shall be obstructed without a special permit first having be secured from the Director of Building and Zoning. A. The fee for such street, alley, or parkway obstruction permit shall be fifteen dollars ($15) per month or part thereof for each twenty-five (25) feet or frac tional part thereof of frontage so occupied. The minimum deposit shall be fif dollars ($50). (page nine) B. Upon the discontinuance of the use of such street~ alley or parkway~ the amount due for the special obstruction permit shall be deducted from the deposit and the difference returned. C. The validity of such permit shall not exceed ninety (90) days after the date of issuance of same. D. Said permit may be renewed for an additional thirty (30) days with the approval of the Director of Building and Zoning, and in such event the applicant shall pay an additional fee of twenty-five dollars ($25) per twenty-five (25) feet or fractional part thereof of frontage so occupied per month or fraction thereof. E. The permit fee for the opening of a street, sidewalk or alley for the purpose of making connections to the sewe~:t~r~ or electric piping shall be twenty-five do 11 a rs ( $25 ) . F. No permit shall be issued until the applicant shall have executed and filed with the Director of Building and Zoning a bond in the penal sum of ten thousan dollars ($10~000) with a responsible surety company as surety thereon. Said bond to be approved as to form by the Village Attorney. Said bond to indemnify the Village of Mount Prospect and its' officials for the full period of time prl vided by the Statutes of Limitations of the State of Illinois from any and all loss~ costs~ expense~ or liability of any kind or nature whatsoever~ which said Village or its' officials may suffer or be put to, or which may be recovered from it or them by reason of the issuance of such. permit. G. No permit shall be issued until the applicant has deposited with the Village Treasurer the. sum of two hundred dollars'. ($200) to guarantee the replacement or repair of broken or damaged sidewalks, curbs, gutters and streets, restoring the public property and for the removal of dirt and litter from public streets abutting the premises involved, except that if the improvement- to be made is a single-room addition or a detached garage, such sum shall not exceed fifty dolle ($50). However, the applicant shall not be required to have on deposit, at any time, with the Village Treasurer, any sum in excess of two thousand dollars ($2. for this purpose, regardless of the number of permits issued to the applicant. (page ten) 11. WATER METER RENTAL FEES - AND USE FEE DURING CONSTRUCTION: A. Fees shall be charged for the rental of water meters according to the follow- ing schedule: (1) The charge for connecting a 5/8 inch to and including a 1~ inch orifice size disc water meter, including a- flat rental fee and charge for ordinary maintenance and repair for the life thereof, shall be the current cost of the meter at the time of its purchase plus eighty-five per cent (85%) of the said cost figured to the closest dollar. (2) The charge for connecting a two inch orifice size or larger turbine, compound, or line meter shall be the current cost of the meter at the time of its purchase plus thirty per cent (30%) of the said cost figured to the closest dollar, as well as a flat rental fee plus the cost and expense of necessary maintenance and repairs made by the Village of Mount Prospect during the life of the said meter - which later charges for maintenance shall be billed to the consumer when incurred. B. A fee of ten dollars ($10) shall be made for each user for water used during con- struction. ("USERII is hereby defined as any single family resident, dwelling unit of a duplex, town house, apartment, co-operative, or other residential or combina- tion use building). For all other construction a deposit of fifty dollars ($50) shall be paid for the rental of a construction water meter and water used will be billed by the Finance Director in accordance with the normal water rates in effect at the time of use. The latter alternate may be used by developers of multiple family dwelling unit bui 1 di ngs .. 12. ELEVATOR, ESCALATOR, AND DUMBWAITER PERMIT AND INSPECTION FEES: A. Permit fees for elevator, escalator, and dumbwaiter installation or alteration shall be as fo 11 ows : (1) For each elevator servicing a building up to and including three floors the fee shall be thirty dollars ($30). (2) Each additional floor in excess of three (3) floors, ten dollars ($10) per fl 00 r . B. Semi-annual inspection fees of each elevator, escalator, and dumbwaiter shall be as follows: (1) For each elevator, escalator, and dumbwaiter servicing a building up to and including three floors ten dollars ($10). (2) For each additional floor in excess of three floors $2.50 per floor. (page eleven) 13. PLAN EXAMINATION FEES: The fee for plan examination shall be as follows: A. For single family homes., thirty dollars ($30). B. For garages and normal accessory buildings for single family home~ fifteen doll~rs ($I5). C. For all other alterations, construction or repair of buildings and structures the following system shall apply: The fee for plan examination is related to the complexities of the work in- volved. The fee is based on: (1) The size of the building (Base Fee). (2) The type of construction (Base Fee Multiplier). (3) The use group (Base Fee Multiplier). (4) The type of mechanical plans (Mechanical Plans Multiplier) included in the submittal. The equation is as follows: Plan Exam Fee = (Base Fee) X (Base Fee Multiplier) X Mechanical Plans Multiplier) Example: Use Group C (mercantile) Floor Area 5,000 square feet Height - 2 stories, 20 feet Type II-C construction Plans include building, mechanical and plumbing The volume of the building is 5,000 sq. ft. X 20 ft. = 100,000 cu. ft. For a hearing at a regular meeting of the Zoning Board of Appeals - one hundred twenty-five dollars ($125). B. For a hearing at a special meeting of the Zoning Board of Appeals - one hundred sixty-five dollars ($165). The above listed fees shall be used to cover the cost of; an original and one du- plicate transcript of the proceedings at the Public Hearing, both which shall become (page th i rteen) public property; cost of advertising, including notice to abutting landowners within a two hundred fifty (250) foot radius of the subjected property, if re- quired in the case of special hearings requested by the aggrieved party or pe- titioner, an additional forty dolfars ($40) which shall not be refundable. In the event said fees are not entirely exhausted after payment of the above costs, the Finance Department of the Village of Mount Prospect shall bill the aggrieved party or petitioner for any additional costs accrued under that case or shall re- fund any balance upon request of the aggrieved party or petitioner. 15. GASOLINE "STORAGE "TANK"PERMIT: The permit to install a gasoline storage tank shall be one hundred twenty-five dollars ($125). 16. RE-INSPECTION FEES: Where a re-inspection is required to determine compliance with the related codes, a re-inspection fee shall be paid. Re-inspection fees shall be computed on the. basis of ten per cent (10%) of the original installation fee with a minimum of ten dollars ($10) and a maximum of twenty-five dollars ($25). 17. Demolition of B~ildings - FEES AND BONDS: No building or other structure shall be demolished, razed or wrecked unless permit fees and bonds are submitted to the Vil- lage of Mount Prospect as follows: A. A cash deposit in the sum of five hundred dollars ($500) to assure the filling in of any below-grade areas and completion of the proposed demolition. B. A bond with good and sufficient sureties, acceptable to the Village Attorney, indemnifying, keeping and saving harmless the Village against any loss, cost, damage, expense, judgment or liability of any kind whatsoever which the Village may suffer, or which may accrue against, be charged to or be recovered from the Village, or any of its officials, from or by reason or on account of accidents to persons or property during any such demolition, razing or wrecking operations, and from or by reason or on account of anything done under or by virtue of any permit granted for any such demolition, razing or wrecking operations. Such bond shall be in the penal sum of twenty thousand dollars ($20,000) for struc- tures not exceeding three (3) stories in height and forty thousand dollars ($40,000) for structures of four (4) or more stories. (page fourteen) C. A permit fee ;s to be paid. Said fee to be computed at a rate of ten dollars ($10) for each ten (10) feet of height of such building or structure~ with a minimum permit fee of fifteen dollars ($15) per building or structure. D. A permit fee of $100 shall be paid for moving a building. 18. SIDEWALK DEPOSIT: In addition to the foregoing provisions~ each applicant shall~ at the time of making application for such building permit, deposit with the Village Treasurer the sum of five dollars ($5) for each lineal foot of frontage of the lot for which a permit is sought, and if a corner lot, the additional sum of five dollars ($5) for each lineal foot of such frontage on the side street. Said deposit shall be returned to the applicant after the sidewalk has been constructed and accepted by the Village; provided, however, that if such sidewalk is not constructed within one year from the date of such permit, the Village shall then be authorized to con- struct such sidewalk and pay for such construction out of the deposit made under the provisions of this ordinance. 19." CERTIFICATE OF OCCUPANCY: The fee for a final Certificate of Occupancy for resi- dential buildings shall be five dollars ($5) for each dwelling unit. The fee to be charged for all other uses shall be twenty-five dollars ($25). 20. FENCE PERMIT FEE: The fee to construct, alter, or erect a fence shall be five dollars ($5). SECTION 2: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hreby repealed. SECTION 3: If any part or parts of this ordinance shall be held to be unconstitutional, such unconstitutionality shall not affect the validity of the remaining parts of this ordinance. The Board of Trustees hereby declares that it would have passed the remain- ing parts of this ordinance if it had known that such part or parts thereof would be declared unconstitutional.
