AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT
VARIATION FOR PROPERTY LOCATED AT 435 WEST PROSPECT
AVENUE, MOUNT PROSPECT, ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount
Prospec~ did meet on the 19th day of December, 1974, and on the
27th day of March, 1975, at the hour of 8:00 P.M., at the Mount
Prospect Village Hall and did hear Case No. 44-V-74, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount
Prospect did hear this request for a side yard variation to alloy
the petitioner to construct an addition to the rear of an existir~
building to within seven feet (71) of the west property line on hE
lot commonly known as 435 West Prospect Avenue, Mount Prospect,
Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount
Prospect did recommend to the Building Committee of the Board of
Trustees of the Village of Mount Prospect the approval of this
request under Case No. 44-V-74 for the reasons that:
(1) There is a practical difficulty and particular
hardship on the petitioner;
(2) The purpose of the variation is not based exciusiv 11
upon a desire to make money; and
(3) The granting of this variation will not be Getri~e -
tal to the public or injurious to surrounding
property in that it will not alter the essential
character of the locality; and

V 1age of Mount Prospect has recommended to the President and
30ard of Trustees of the Village of Mount Prospect to concur
with the recommendations of the Zoning Board of Appeals that
the variation herein be granted; and

NO~, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOU~T PROSPECT, COOK COUNTY, ILLI~OIS
SECTION O~E: That the property being the subject matter of CasJ
~o. 44-V-74, being legally described as follows: I
Lot 1 in The Heck Resubdivision in Mount Prospect, be~ng
a resubdivision of Lots 20, 21 and 22 iA H. Roy Berry
Company's Subdivision of part of the Northeast Quarter
of Section 11, and part of the Northwest Quarter of
Section 12, all jn Township 41 North, Range 11 East
of the Third Principal Meridian, in Cook County, I11ino~ ,
i~ currently zoned under the Zoning Ordinance' of the Village"
aT Mount Prospect as R-3 (Apartment Residence) District which
zoning classification shall remain in effect subject to'the
variation granted herein:
That the side yard lot line on the west side of
the subject property be reduced by six inches (6").
SECTIO~ TWO: That all requirements of the Mount Prospect

Building and Zoning Code shall be applicable except the
variation noted in SECTION ONE heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning
of the Village of Mount Prospect is hereby authorized to
issue a building permit for construction in accordance
with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance
snall be null and void. and 9f no force and effect whatso-
ever unless an application for a building permit pursuant
to such variation is made and construction commenced with-
in one (l} year of the date this said Ordinance becomes
effective.
SECTION FIVE: That this Ordinance shall be in full force
and effect from and after its passage, approval, and
