II WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
II meet on the 24th day of July, 1975, at the hour of 8:00 p.m., at the
I, Mount Prospect Village Hall and did hear Case No. 27-V-75, pursuant to
II proper legal notice; and

AN ORDINANCE .AJJ11IORIZING A VARIATION
FROM SEcrION 21.1011 OF THE MOUNT PROSPECT
BUILDING CODE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect,
pursuant to authority vested in it under subsection 13 of Section 14.504
of the Mtmicipal Code of Mount Prospect, did hear this request to locate
a central air conditioner compressor in the front yard of the property
commonly mown as 401 S. See-Gwun Avenue, Mount Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 27-V-75 for the
reasons that location of the compressor in the front yard in this unique
instance will be the least offensive to neighbors; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect did conduct a hearing on August 13, 1975, and did
recommend to the Board of Trustees of the Village of Mount Prospect the
granting of the requested variation under Case No. 27-V-75; and
'I^.'HEREAS, the President and Board of Trustees of the Village of Mount
Prospect have concurred with the recommendation of the Building Committee
that the variation herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the same
is in the best interests of the Village of Mount Pro?pect;
NOW, TIlEREFORE, BE IT ORDAINED BY TIlE PRESIDThrf AND BOARD OF TRUSTEES OF
TIlE VILLAGE OF M)UNl' PROSPEcr, COOK COUNI'Y, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 27-V-75,
being legally described as follows:
Lot 20 in Block 20 in Prospect Park Country Club Subdivision
being a subdivision of the Southeast Quarter of Section 11
and South 15 acres of the East Half of the Northeast Quarter
of said Section 11, Township 41 North, Range 11, East of the
Third Principal Meridian, in Mount Prospect, in Cook
County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as R-l (Single Family Residence) District, which zoning classifi-
cation shall remain in effect subject to the variation granted herein.
SECTION TIlO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except that Section 21.1011 of the
Municipal Code of Mount Prospect of 1957, as amended (Building Code), shall
not govern the placement of a central air conditioning compressor to serve
the home located upon the subject property, and that the location of said
compressor shall be that shown upon the plans attached hereto and hereby
made a part hereof as Exhibit "A".

III SEcrION THREE: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby authorized to issue a building permit for
I construction in accordance with the variation hereinabove mentioned.

SECTION FOUR: That the variation granted by this Ordinance shall be null
and void and of no force and effect whatsoever unless an application for
a building penni t pursuant to such variation is made and construction
commenced within one (1) year of the date this said Ordinance becomes
effective.
SEcrION FIVE: That this Ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided
by law.
