ORDINANCE NO. 2578
.AN ORDINANCE AUTHORIZING A VARIATION
FROM SECTION 21.1011 OF lliE IDUNT PROSPECf
BUILDING CODE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct public hearings on March 27, 1975, and June 26, 1975, at the hour
I of 8:00 p.m., at the Mount Prospect Village Hall and did hear Case No. 10-V-75,
II pursuant to proper legal notices; and
I WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
I hear this request for a side yard variation to allow the petitioners to
install one central air conditioner compressor in the east side yard of
properties connnonly known as 1 Judith .Ann Drive and 3 Judith .Ann Drive,
I Mount Prospect, Illinois; and
I 'WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
did recommend to the President and Board of Trustees of the Village of
Mount Prospect the approval of these requests under Case No. 10-V-75 for
the reasons that location of the compressors in the east side yards of
these unique instances will be the least offensive to neighbors; and
MlliREAS, the Building Carrnnittee of the Board of Trustees of the Village of
Mount Prospect did conduct a hearing on August 13, 1975, and did
reconnnend to the Board of Trustees of the Village of Mount Prospect the
granting of the requested variations under Case No. 10-V-74; and
h~lliREAS, the President and Board of Trustees of the Village of Mount Prospect
have concurred with the recommendation of the Building Connnittee that the
I variations herein be granted; and
'WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matters herein and have detennined that the same
is in the best interests of the Village of Mount Prospect;

THE VILLAGE OF MOUNT PROSPECT, COOK COUNrY, ILLINOIS:
SECTION ONE: That the properties being the subject matter of Case No. 10-V-7S,
being legally described as follows:
PARCEL 2-A
The North 50.42 feet of Lot 2 in Judith .Ann Serafine's Garden
Resubdivision of part of the Northwest Quarter of the North-
east Quarter of Section 34, Township 42 North, Range 11, East
of the Third Principal Meridian, Cook County, Illinois; and

PARCEL 2-B
The South 19.50 feet of the North 69.92 feet of Lot 2 in
Judith .Ann Serafine's Garden Resubdivision of part of the
Northwest Quarter of the Northeast Quarter of Section 34,
Township 42 North, Range 11, East of the Third Principal
Meridian, Cook County, Illinois.

are currently zoned under the Zoning Ordinance of the Village of Mount !
Prospect as R-1 (Single Family Residence) District, which zoning c1assificationl
shall remain in effect subject to the variations granted herein.

Code shall be applicable except that Section 21.1011 of the MUnicipal
Code of Mount Prospect of 1957, as amended, (Building Code), shall not
govern the placement of the central air conditioner compressors to serve
the homes located upon the subj ect property, and that the locations of
said compressors shall be those shown upon the plan attached hereto and
hereby made a part hereof as Exhibit"A".
SECTION 'IHREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue building permits for
construction in accordance with the variations hereinabove mentioned.
SECI'ION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless applications
for building permits pursuant to such variations are made and construction
commenced with one (1) year of the date of this Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided
by law.
