WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
heard testimony presented under Case No. 24-V-75 pertaining to a request
for a certain variation from the Motmt Prospect Zoning Ordinance to penni t
I the erection of an antenna tower upon the subj ect property, which tower
I' shall not exceed a total height of sixty (60') feet when measured from
I grade, legally described as follows:

Lots One (1) through Eighteen (18), inclusive, in Block Four (4)
in Prospect Park Country Club Subdivision, being a subdivision
of the Southeast Quarter CD of Section Eleven (11) and the South
Fifteen (15) acres of the East Half (f) of the Northeast Quarter (!)
of Section 11, Township 41 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois,

in H. Roy Berry Co's. Colonial Manor, being a Subdivision of a part
of the Northeast Quarter (!) of Section Eleven (11) and part of the
Northwest Quarter CD of Section Twelve (12), all in Township 41
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois;
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
reconnnend to the President and Board of Trustees --of-the Village of Mount
Prospect that the requested height variation be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect did meet on SeptEmber 9, 1975, and did consider the
reconnnendations of the Zoning Board of Appeals under Case No. 24-V-75; and
WHEREAS, the Building Camrni ttee has reconnnended that the President and
Board of Trustees of the Village of Mount Prospect concur in the
I recorrnnendations of the Zoning Board of Appeals to allow the height variation
, requested under Case No. 24-V-75; and

I WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect
will be attained by the adoption of the following Ordinance regarding the
subject property;

SECTION ONE: That the following variation be and it is hereby granted for
the above described property which is the subject matter of Case No. 24-V-75:

The terms of the Mount Prospect Building Code are hereby
varied so as to penni t the construction and erection of

one tubular steel television receiving antenna tower upon
the subj ect property.
SECTION TWO: That the aforesaid variation will be valid and effective only
upon the perfoImance and continuous maintenance with respect to the
subject property of the following conditions and restrictions:
(a) That the total height of the tower including the
antenna attached to the top thereof shall not
exceed sixty (60') feet when measured from grade
with the further restriction that such tower and
antenna shall consist of a forty (40') foot high
tower to be located upon an existing twenty (20')
foot high gyImlasium roof located upon the
subject property.
(b) That the antenna to be located on the subject
property shall in no way cause any interference
wi th radio or television reception to any other
properties within the corporate limits of the
Village of Motmt Prospect.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building permit for the subject
tower in accordance with the variation and limitations herein set forth.
SECTION FOUR: That the variation granted by this Ordinance shall be null
and void and of no force and effect whatsoever unless an application for a
building permit, pursuant to such variation and restrictions contained
herein, is made and construction connnenced within one (1) year of the date
of this Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided
by law.
