.AN ORDINANCE GRANfING A FRONT YARD REQUIREMFNr VARIATION
FOR PROPERTY LOCATED AT '!HE NORlHEAST CORNER OF MEMJRY
LANE .AND ELMHURSr AVENUE, MXJNT PROSPECT, IllINOIS

WHEREAS, the Zoning Board of Appeals of the Village of MOlmt Prospect did
conduct a public hearing on the 25th day of September, 1975, at the hour
of 8: 00 p.m., at the Mount Prospect Village Hall and did hear
Case No. 40-V-75, pursuant to proper legal notice; and

WHEREAS ~ the Zoning Board of Appeals of the Village of Mount Prospect did
hear thlS request for a front yard variation to allow the petitioner to
construct a single- family residence to wi thin fourteen feet (14') of the
property line adjacent to Memory Lane on the lot legally described herein-
below; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees the approval of this
request under Case No. 40-V-75 for the reasons that:
(1) There is a practical difficulty and particular
hardship on the petitioner;
(2) The purpose of the variation is not based
exclusively upon a desire to make money;

(3) The conditions upon which the petition for this
variation is based are unique in that the lot is
a corner lot, subject to having two (2) front
yards; and
(4) The granting of this variation will not be detrimental
to the public or injurious to surrounding property
in that it will not alter the essential character
of the locality, since the other corner lots at this
intersection of Memory Lane and Elmhurst Avenue
have setbacks off of Memory Lane ranging from
eight feet to twelve feet.
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have concurred with the recammendation of the Zoning Board of
Appeals that the variation herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is in the best interests of the Village of Mount Prospect.

NOW, TIffiREFORE, BE IT ORDAINED BY THE PRESIDENT .AND BOARD OF TRUSTEES OF
THE VILLAGE OF MJUNf PROSPECT, moK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 40-V-75

being legally described as follows:
Lot II in Roy Berry Company's "Castle Heights", being a
subdivision of the North Half (1/2) of the Southeast
Quarter (1/4) of the Northwest Quarter (1/4) and the
Southwest Quarter (1/4) of the Northeast Quarter (1/4) ,
of Section 34, Township 42 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as R-l (Single Family Residence), which zoning classification
shall remain in effect subject to the variation granted herein:
That the yard abutting the frontrnost lot line of
the subject property adjacent to Memory Lane be'
reduced to fourteen feet (14').
SECTION lWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variation noted in SECTION ONE
heretofore mentioned.

SECTION 1HREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for
construction in accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null
and void and of no force and effect whatsoever unless an application for
a building perrni t pursuant to such variation is made and construction
commenced within one (l) year of the date of this said Ordinance becomes
effective.

SECTION FIVE: That this Ordinance shall be in full force and effect from
and after 1 ts passage, approval, and publication in the manner provided by
law.
