HomeMy WebLinkAboutOrd 2602 12/16/1975 p II I ~ I I II /l I I I Ii II II II WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 20th day of November, 1975, at the II hour of 8:00 p~m., at the Mount Prospect Village Hall and did II hear Case No. q5-V-75, pursuant to proper legal notice; and 1\ d I ~ I I , II Ii I I i i I I ORDINANCE NO. 2602 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY LOCATED AT 1804 HOPI LANE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for variance from side yard requirements of the Zoning Ordinance and variance from footing and foundation requirements of the Building Code; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the Building Committee of the Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 45-V-75; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on December 10, 1975, and did review the recom~endations of the Zoning Board of Appeals; and WHEREAS, the Building Committee has recommended that the Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals; and I II II WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS 1'1 ~ " I' ii ,I I' I' ,I I SECTION ONE: That the property being the sUbject matter of Case No. 45-V-75, being legally described as follows: Lot 44 in Forest Manor Unit No.2 being a sub- division in the southwest quarter in the south- east quarter of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian according to plat registered in the office of the Registrar of Titles of Cook County, Illinois May 29, 1963, as Document No. 2093496, I I I II Ii I " . is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (Single Family Residential) District, which zoning classification shall remain in effect subject to the variations granted herein: A. That the side yard located adjacent to the west lot line of the aforedescribed property be and 1,1 I ji I ,I II. I n II and the same is hereby authorized to be reduced from the required seven feet eleven inches (7' 11") to seven feet (7'); and B. That Section 21.1215 of the Mount Prospect Building Code be varied so as to allow footings and foundations below grade at a thirty-six inch (36") depth rather than at the reauired forty-two inch (42") depth for the shed attached to the house located on the afore- described property,pursuant to the plans and specifications attached hereto and hereby made a part hereof as Exhibit I. I I , I Ii i I I SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. I, I SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction concluded within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
