ORDINANCE NO. 2605
AN ORDINANCE AMENDING SECTION 23.304 AND SECTION 23.306
OF THE MUNICIPAL CODE OF THE VILLAGE OF MOUNT PROSPECT,
COOK COUNTY, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the
Board o~ Trustees of the Village of Mount Prospect under
Article VII of the 1970 Illinois Constitution, Section 23.304
of the Municipal Code of the Village of Mount Prospect of 1957,1
as amended, be and the same is hereby further amended in its
entirety; so that hereafter, the said Section 23.304 shall be
and read as follows:

A. The Director of Public Works shall read or cause
to be read every water meter used in the Village
at such times as are necessary that bills may
be sent out at the proper time.

B. Where a water meter is so located that it is not
readily accessible to reading by Village officials,
or in the event any given user's water meter cannot
be read or inspected by reason of the user's
failure to allow access thereto for any given
continuous period of six months or more, the
Director of Public Works be and he is hereby
authorized to install or cause to be installed
outside meters, or "Read-o-matic" or equal meters,
and thereafter the Village Treasurer-Collector
shall bill said user and said user shall pay the
Village for such meter and its installation
within the next regular billing period.
SECTION TWO: That, pursuant to the authority vested in the
Board of Trustees of the Village of Mount Prospect under
Article VII of the 1970 Illinois Constitution, subsections B
and C of Section 23.306 of the Municipal Code of the Village
of Mount Prospect of 1957, as amended, be and the same are
hereby further amended in their entirety, retaining similar
provisions but increasing the water rate; so that hereafter,
the said subsections Band C of Section 23.306 shall be and
read as follows:
"Section 23.306
B.
All Village users within the Village, except as
set forth in paragraphs 1 and 2 below, having a
direct or indirect connection with Village water
mains shall pay the following rates per quarter:

consumption, the rate per gallon shall be
calculated at the total gallonage used as
reflected upon that meter so utilized.

In addition to the foregoing charges, all'
Village users residing in the Fairview Gardens
Subdivision, being legally described as:

Beginning at a point on the South line of the South
East Quarter of Section 35, Township 42 North,
Range 11, East of the Third Principal Meridian in
the County of Cook in the State of Illinois, vvhich
said point lies 660.30 feet West of the Southeast
corner of said Section 35; running thence West
for a distance of 1320.48 feet along the section
line; running thence North to the North line of
the Southeast Quarter of said Section 35, begiIming
a distance of 2646.66 feet, more or less; running
thence East for a distance of 1319.23 feet along the
said North line of the Southeast Quarter of said
Section 35; running thence South to the point of
beginning; and

That part of Section 35, Township 42 North, Range 11,
East of the Third Principal Meridian in the County of
Cook in the State of Illinois described as follows:
Corrnnencing at the Southeast corner of said Section 35,
running thence West on the South line of said
Section 35 for a distance of 66.30 feet; running
thence North for a distance of 2646.66 feet;
running thence East for a distance of 653.20
feet to a brass momnnent in Wolf Road; running
thence South to the point of beginning; and

Apartment project located in the C. A. Goelz Prospect
Gardens, being a subdivision of the West 1/2 of the
West 1/2 of the Southeast 1/4 together with the East 2/3
of the North 3/4 of the Northeast 1/4 of the
Southwest 1/4 of Section 34, Township 42 North,
Range 11, East of the Third Principal :Meridian,
in Cook County, Illinois;
shall pay an additional charge of Thirty-two
and 5/100 Dollars ($32.05) per quarter as part
of their water bill. Said charge shall be
terminated upon the payment of the user's share
of the cost of acquisition of the Fairview
Utility facilities pursuant to a certain agreement
by and between the Village and Fairview Utility
Company, dated October 28, 1969. Any user within
the above-described area may terminate his
liability for such additional payments by payment
in full of his share of the acquisition cost, as
determined by the Village Clerk.
C. All Village users outside the corporate limits of the
Village having a direct or indirect connection with
Village water mains shall pay the following rater per

SECTION THREE: That the billing procedures and rates set
forth in SECTION TWO hereinabove shall be applied to any
given user upon the completion of the first three month billing
period fOllowing the date of the passage and approval of this
Ordinance.
SECTION FOUR: That this Ordinance shall be in full force and
effect from and after its passage, approval, and publication
in the manner provided by law.
