I WHEREAS, the Finance Committee of the Board of Trustees of the Village of Mount
II Prospect did meet on December 15, 1975, and did determine therein that current
I procedures of the Cook County Assessor do not place liability for municipal real
estate tax levies upon property recently annexed to such municipality until Janu-
ary 1st of the year following any such annexation; and
II WHEREAS, the Finance Committee of the Board of Trustees of the Village of Mount
Ii Prospect has determined that the Village of Mount Prospect commences garbage
I, pick-up and regular garbage services to newly annexed residential real estate
' immediately upon annexation; and
AN ORDINANCE ESTABLISHING A GARBAGE COLLECTION
CHARGE FOR NEWLY ANNEXED PROPERTIES
WHEREAS, the said Finance Committee of the Board of Trustees of the Village of
Mount Prospect has recommended to the President and Board of Trustees of the I
I Village of Mount Prospect that a garbage collection charge to such newly annexed
I, residential properties is more equitable than garbage collection service at no charge
until January 1st of the year following such annexation; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the recommendation of the Finance Committee and have determined that the
same is in the best interests of the Village of Mount Prospect.
I'NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
I TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to authority contained in Article VII of the 1970 Con-
stitution of the State of Illinois, Article II of Chapter 19 (Health Regulations) contain-
ed in the Municipal Code of Mount Prospect of 1957, as amended, be and the same is
hereby further amended by renumbering Section 19.204 to become Section 19.205 and
by creating an entirely new section, Section 19.204, establishing a garbage collec-
tion charge for newly annexed properties; so that hereafter the said new Section
119.204 and the said Section 19.205 shall be and read as follows:
II "SECTION 19.204. Collection Charges -- Newly Annexed Residential
I Dwelling Units.
A. Each single family residential home and each dwelling unit located upon
real estate annexed and made part of the Village of Mount Prospect shall
pay the sum of Four and Thirty One Hundredths Dollars ($4.30) per
dwelling unh pe~ month for the collection and disposal of residential
garbage, rubbish, refuse, and/or waste -- which collection shall be
mandatory for all such residential dwelling units within the Village
i -- which Four and Thirty One Hundredths Dollars ($4.30) rate may
I hereafter increase or decrease to coincide with the current rate charg-
! ed per dwelling unit by the aforesaid exclusive licensee per its con-
i! tract with the Village for garbage collection service elsewhere through-

II out the Village of Mount Prospect.

I. 1. Said monthly charge shall be payable quarterly and in advance to
the Village Treasurer of the Village of Mount Prospect.

I,', SECTION 19.205. Penalty. Any person, firm, or corporation violating the
provisions of this Article shall be fined at least Ten Dollars ($10) but no
I more than Two Hundred Dollars ($200) for each offense. Each day that a
I violation is permitted to exist consitutues a separate offense. "

I SECTION TWO: That this Ordinance shall be in full force and effect from and after
lits passage, approval, and publication in the manner provided by law.

2. Bills shall be sent by the Finance Department of the Village of
Mount Prospect to each such residential dwelling unit quarterly
and may be combined with the sewer and water billing currently
processed by the said Finance Department.

In the instance where such residential dwelling unit is other
than a single family residential home, such billing and collec-
tion provided for hereinabove shall be made by invoicing the
owner, landlord , and/or manager, as the case may be, of such
multi-family residential dwelling building, who, in turn, shall
make the payments herein required.

b.
Such monthly charge shall terminate upon that first day of Janu-
ary following the date of annexation of such property .
B. Upon said advance payment being received by the Village, each such re-
sidential dwelling unit having so paid shall be entitled to one (1) week-
ly pick-up of all garbage and refuse at the curb in accord with subsec-
tions A, B, and C of Section 19.201 hereinabove. In the event such re-
sidential dwelling unit is serviced through private contract with the ex-
clusive licensee for additional garbage and refuse service as contempla-
ted under subsection D of Section 19.201 hereinabove, such residential
dwelling unit shall continue to be billed and shall continue to pay to the
Village the regular monthly collection charge provided for in this Sec-
tion 19.204.
C. A service charge of One Dollar ($1) per quarter shall be added to any
bill unpaid within twenty (20) days from the date of such billing requir-
ed hereinabove.
