ORDINANCE NO. 2608
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 908 PALM DRIVE

iIwHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a
ublic hearing on December 18, 1975, at the hour of 8: 00 p.m. , in the Mount Pros-
ect Public Safety Building, pursuant to proper legal notice; and
HEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testi-
Fony presented under Case No. 50-V-75 pertaining to a request for a variation from
f. aragraph 20 of subsection B of Section 14.2602 of the Zoning Code in order to install
secondary kitchen in conjunction with a proposed recreation room in the basement
f the property described hereunder; and
'IWHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recomme d
I~o the Building Committee of the Board of Trustees of the Village of Mount Prospect th
I~pproval of this request under Case No. 50-V-75; and

I HEREAS, the Building Committee of the Board of Trustees of the Village of Mount Pr s.
ect did meet on February 11, 1976, and did consider the recommendations of the Zo 'n
oard of Appeals under Case No. 50-V-75; and
HEREAS, the Building Committee has recommended to the President and Board of
rustees of the Village of Mount Prospect to allow the variation as presented;' and
VHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
eviewed the matter herein and have determined that the same is in the best interests
f the Village of Mount Prospect;
OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD O~ TRUSTEES
F THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
ECTION ONE: That the property being the SUbject matter of Case No. 50-V-75, bei
egally described as follows:
Lot 45, Unit 1, Kaplan-Braun's Subdivision, 4th Addition to Mount
Prospect of part of the Northwest Quarter (D and the Northeast
Quarter CD of Section 14, Township 41 North, Range 11, East of
~ the Third Principal Meridian, in Cook County, Illinois.
s currently zoned under the Zoning Ordinance of the Village of Mount Prospect as 'I
' -1 (Single Family Residence) District, which zoning classification shall remain sub-
ect to the following granted variation: That the owner of the land described herein-
bove shall have the right to construct secondary kitchen facilities below grade pur-
uant to the plans and specifications attached hereto and hereby made a part hereof as
xhibit A. which variation is granted with the specific prohibition of use and occupan y
f the home located upon the subject property legally described hereinabove by more
an one family and with the further prohibition that any owner, resident, or person
aving a beneficial interest in the real estate hereinabove described shall not hereafte
I tilize the premises and/or the single family home located thereon for the production f
~! come through the lease or assignment of the use and enjoyment of any portion of the

ECTION TWO: That all other requirements of the Municipal Code of Mount Prospect
hall be applicable, except that variation specified in SECTION ONE hereinabove.
ECTION THREE: That the Director of Building & Zoning of the Village of Mount Pros
ect is hereby directed to issue a building permit in accordance with the variation
ereinbefore mentioned.
ECTION FOUR: That the variation granted by this Ordinance shall be null and void
nd of no force and effect whatsoever unless an application for a building permit pur-
uant to such variation is made and construction commenced within one (1) year of
he date said Ordinance becomes effective.

~ECTION FIVE: That this Ordinance shall be in full force and effect from and after
ts passage, approval, and publication in the manner provided by law.
