ORDINANCE NO. 2611
AN ORDINANCE AMENDING CHAPTER 11 OF THE
MUNICIP AL CODE OF MOUNT PROSPECT

WlHEREAS, it has been determined that increased costs of special services of the
Vallage of Mount Prospect in the form of various inspections, added police protec-
~on and patrol, etc., currently being provided each business, occupation, and/or
R~ofession conducted within the Village of Mount Prospect necessitate an increase
i~ the business license fees currently charged by the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the charges and fees for licensing such businesses, occupations,
and/or professions; and
~HEREAS , the President and Board of Trustees of the Village of Mount Prospect
~elieve that an increase in such license fees is in the best interests of the citizens
~f the Village of Mount Prospect;
!fOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SBCTION ONE: That, pursuant to the authority vested in the PresiC "'nt and Board
qf Trustees of the Village of Mount Prospect under Article VII of the :C970 Constitu-
tion of the State of Illinois, Section 11.202 of the Municipal Code of IVlount Prospect
qf 1957, as amended, be and the same is hereby amended in its entirety so as to
increase the license fees for Auctioneers; so that hereafter the said Section 11.202

II SECTION 11. 202. License Fees. The fees for an auctioneer's license shall
be as follows: $52.50 for a period of one (1) month; $7.50 per day for any
period of less than one (1) month. II

SECTION TWO: That. pursuant to the authority vested in the President and Board
~f Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
non of the State of Illinois. Section 11.303 of the Municipal Code of Mount Prospect
.of 1957. as amended, be and the same is hereby amended in its entirety so as to
~ncrease the license fees for Bankers and Brokers; so that hereafter the said Sec-
~on 11.303 shall be and read as follows:

A. The fee for a banker's license shall be $52.50 for a period of one (1) year.

B. The fee for a broker's license shall be $52.50 for a period of one (1) year.
j~ECTION THREE: That, pursuant to the authority vested in the President and Board
!pf Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
;tion of the State of Illinois, subsection B of Section 11.502 of the Municipal Code of
IMount Prospect of 1957, as amended. be and the same is hereby amended in its
:ty so as to increase the license fees for Shooting Galleries; so that hereafter the said
~ubsection B of Section 11.502 shall be and read as follows:

The fees for shooting galleries shall be: $150 per year; $7.50 per day,
if for less than one (1) year. "
SECTION FOUR: That, pursuant to the authority vested in the President and Board
~f Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, Section 11.604 of the Municipal Code of Mount Prospect

~f 1957, as amended, be and the s~e is hereby amended in its entirety so as to
increase the license fees for Carnivals and Circuses; so that hereafter the said.
~ection 11. 604 shall be and read as follows:
" SECTION 11.604. License and Permit Fees.
A. The fee for a carnival license or a circus license shall be $75 per day
for each day of operation, with a minimum fee of $300.
1. An additional license fee of $7.50 per day shall be charged for
each concession operated in conjunction with a carnival.
2. An additional license fee of $7.50 per day shall be charged for each
concession and/or side show operated in conjunction with a circus.
B. The fee for each permit for each mechanical amusement riding device
shall be calculated to equal the cost of the safety inspection by the Vil-
lage of such device at the rate of $30 per hour. II
SECTION FIVE: That, pursuant to the authority vested in the President and Board
~f Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
~on of the State of Illinois, subparagraph e. of subsection E of Section 11.605 of the
~Vlunicipal Code of Mount ProspecLoL1957, as amended, be and the same is hereby
'~ended in its entirety so as to increase the license fees for lottery drawings; so
that hereafter the said subparagraph e. of subsection E of Section 11.605 shall be
~nd read as follows:
" e. License Fee.
1) The Village Treasurer shall charge a non-refundable
application fee in the amount of Fifteen Dollars ($15)
for each lottery license application.
2) Within thirty (30) days after the drawing held at the
culmination of any lottery, the licensee shall pay over
to the Village Treasurer a license fee in the amount of
one and one-half percent (1. 5%) of the gross ticket
and/or chance sales. "

SECTION SIX: That, pursuant to the authority vested in the President and Board
bf Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, subsection A of Section 11.703 of the Municipal Code of
Mount Prospect of 1957, as amended. be and the same is hereby amended in its en-
tirety so as to increase the license fees for Coin-in-Slot devices; so that hereafter
1he said subsection A of Section 11.703 shall be and read as follows:

" SECTION 11.703. License Fees.
A. Every applicant, before being granted a license shall pay the follow-
ing annual license fee for the privilege of operating or maintaining for
operation each cigarette vending machine, juke box, or other mechani-
cal or electronic coin-in-slot device:
1. Cigarette Vending Machines
$37.50 per machine
2. Juke Boxes
$15.00 per machine

increase the license fees for Taximeter Inspection; so that hereafter the said Sec-
tion 11.1116 shall be and read as follows:
"SECTION 11.1116. Taximeter Inspection Fee. The fee for each certificate
of inspection shall be Four and Fifty One Hundredths Dollars ($4.50), but
no charge shall be made for any certificate when the inspection and test is
made upon complaint, and it is found that the taximeter is in proper work-
ing condition and accurately registers the lawful rates and charges. TI

~~ls; so that hereafter the said subsection B of Section 11. 2502 shall be and read as

For motion pictures and theatricals, which are to be presented on pre-
mises which are not covered by such license fee, the fee to be paid
shall be Fifteen Dollars ($15) per day; provided that no such motion
picture or theatrical shall be presented in or on any premises or build-
ing which does not fully comply with the requirements of the ordinances
relating to public gatherings and to maintenance of buildings for this

~ntireties so as to increase the license fees for the business of hawker, peddler, itine1
~ant merchant, or transient vendor; so that hereafter the said subsections A and B of I
Section 11. 2807 shall be and read as follows: i

The fee which shall be charged by the Village Clerk for a license to en-
gage in the business of hawker, peddler, itinerent merchant, or transi-
ent vendor shall be Seven and Fifty One Hundredths Dollars ($7.50) per
day; Thirty-seven and Fifty One Hundredths Dollars ($37.50) per week;
Seventy-five Dollars ($75) per month; and One Hundred Fifty Dollars
($150) per year.
B. The annual fees for persons selling cigarettes, cigars, and/or tobacco
at retail, whether as a specialty or in conjunction with the providing of
other retail sales or services, shall be Thirty-seven and Fifty One Hund-
redths Dollars ($37.50), which fee shall be in addition to any other li-
cense fee provided for in this Section. " I
SECTION TWENTY: That, pursuant to the authority vested in the President and Boar~
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
~irm of the State of Illinois, Section 11.3008 of the Municipal Code of Mount Prospect
pf 1957. as amended, be and the same is hereby amended in its entirety so as to
~ncrease the fee for a certain seal placed upon approved scales; so that hereafter
~he said Section 11.3008 shall be and read as follows:
" SECTION 11.3008. License Fee. The annual fee for the seal authorized
herein to be placed upon approved scales shall be Seven and Fifty One
Hundredths Dollars ($7.50). II
iSECTION TWENTY -ONE: That, pursuant to the authority vested in the President and
!Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Con-
!stitution of the State of Illinois. subsections A, B, and C of Section 11.3104 of the
!Municipal Code of Mount Prospect of 1957, as amended. be and the same are hereby
I amended in their entireties so as to increase the component fees for specific profes- I
isions, occupations, businesses, and/or commercial establishments; so that hereafterl
Ithe said subsections A, B, and C of Section 11. 3104 shall be and read as follows: i

All of such professions, occupations, businesses, and/or commercial
establishments shall pay a $15 basic component fee to cover the pro-
cessing, documentation, and filing of their application and license.

B. Such professions, occupations, businesses, and/or commercial estab-
lishments which have an established place of business within the cor-
porate limits of the Village of Mount Prospect shall be assessed an addi-
tional component fee to cover the cost of enforcement of safety regula-
tions including fire prevention, which component fee shall be deter-
mined in accordance with the following schedule:

C. Such professions, occupations, businesses, and/or commercial estab-
lishments operated within the corporate limits of the Village of Mount
Prospect and subject to health and sanitation regulations of the Village
of Mount Prospect shall be assessed an additional component fee based
upon classification as to the degree of regulation as follows:

SECTION 11. 3107. Late Payments.
A. Whenever an application for a renewal of a license previously issued
for the prior fiscal year is received by the Village Clerk between
July 1 and August 31 of any given fiscal year, the Village Clerk is here-
by authorized to compute the license fee for such license at the rate of
one hundred twenty percent (120%) of the license fee heretofore desig-
nated in this Article.
B. Whenever an application for a renewal of a license previously issued
for the prior fiscal year is received by the Village Clerk after Au-
gust 31 of any given fiscal year, the Village Clerk is hereby authori-
zied to compute the license fee for such license at the rate of one
hundred fifty percent (150%) of the license fee heretofore designated
in this Article. 11

S~CTION TWENTY -THREE: If any part or parts of this Ordinance shall be held to be
uhconstitutional, such unconstitutionality shall not affect the validity of the remain-
it?g parts of this Ordinance. The Board of Trustees of the Village of Mount Prospect,
h~reby declares that it would have passed the remaining parts of this Chapter if it
~rd known that such part or parts thereof would be declared unconstitutional.
$;ECTION TWENTY-FOUR: That the Village Clerk be and is hereby directed to pub-
llsh this Ordinance in pamphlet form, by authority of the President and Board of
'Jirustees of the Village of Mount Prospect, pursuant to the statutes of the State of
~pinois made and provided.
