PROCLAMA TION
"NORTH AMERICAN OCCUPATIONAL
SAFETY AND HEALTH (NAOSH) WEEK"
APRIL 30 -MAY 6,2006
WHEREAS, every year more than 5500 people die from job-related injuries
and 4.4 million more suffer occupational injuries and illnesses; and
WHEREAS, every day, millions of people go to and return home from work
safely due, in part, to the efforts of occupational safety, health and
environmental practitioners - who work day in and day out identifYing hazards
and implementing safety and health advances in all industries and at all
workplaces, aimed at eliminating workplace fatalities, injuries and illnesses;
and
WHEREAS, these occupational safety, health and environmental practitioners
work to prevent accidents, injuries and occupational diseases, create safer work
and leisure environments, develop safer products and are committed to
protecting people, property and the environment; and
WHEREAS, during the week of April 30 - May 6, 2006 and throughout the
year the American Society of Safety Engineers (ASSE), the U. S. Occupational
Safety and Health Administration (OSHA) and other NAOSH partners
representing hundreds of thousands of people, will work to raise employers "
employees' and the public's understanding of the importance of occupational
safety, health and the environment in everyone's lives, and provide valuable
information and resources aimed at decreasing workplace fatalities, injuries
and illnesses.
NOW, THEREFORE, 1, Irvana K. Wilks, Mayor of the Village of Mount
Prospect, do hereby proclaim April 30 - May 6, 2006 as
"NORTH AMERICAN OCCUPATIONAL
SAFETY AND HEALTH (NAOSH) WEEK"
and I further commend occupational safety, health and environmental
practitioners for their ongoing commitment to protecting people, property and
the environment.

WHEREAS, the Office of the Municipal Clerk, a time honored and vital
position of local government exists throughout the world; and
WHEREAS, the Office of the Municipal Clerk is the oldest among public
servants; and
WHEREAS, the Office of the Municipal Clerk provides a professional link
between the citizens, the local governing bodies and agencies of government
at other levels; and
WHEREAS, Municipal Clerks have pledged to be ever mindful of their
neutrality and impartiality, rendering equal service to all; and
WHEREAS, Municipal Clerks continually strive to improve the administration
of the affairs of the Office of the Municipal Clerk through participation
in education programs, seminars, workshops and the regular meetings of
their state, county and international professional organizations,'
WHEREAS, it is most appropriate at this time that we recognize the
contributions and accomplishments of the Office of the Municipal Clerk.

"BUILDING SAFETY WEEK"
MAY 7 -13,2006
WHEREAS, through our continuing attention to building safety, we enjoy the comfort and
peace of mind of structures that are s<<fe and sound; and,
WHEREAS, building safety andfire prevention officials are at work year round to guide the
safe construction of buildings; and,
WHEREAS, the dedicated members of the International Code Council, including building
safety and fire prevention officials, architects, engineers, builders and others in the
construction industry, develop and enforce codes to safeguard Americans in the buildings
where we live, work, play and learn; and.
WHEREAS, the International Codes, the most widely adopted building safety and fire
prevention codes include safeguards to protect the public from natural disasters that can
occur. such as hurricanes, snowstorms, tornadoes, wildlandfires and earthquakes; and,
WHEREAS, Building Safety Week, sponsored by the International Code Council
Foundation, is an excellent opportunity to educate the public. It is a perfect time to increase
public awareness of the role building safety and fire prevention officials, local and state
building departments, andfederal agencies play in protecting lives and property; and,
WHEREAS, this year '05 theme, "Building a Safer World Together," encourages all
Americans to raise our awareness of building safety everyone can take appropriate steps to
ensure that the places where we live, work, play and learn are safe. Countless lives have
been saved because of the building safety codes adopted and enforced by local and state
agencies; and,
WHEREAS, this year, as we observe Building Sqfety Week, we ask all Americans to
consider projects to improve building safety at home and in the community, and to recognize
the local building sqfety andfire prevention officials and the important role that they play in
public safety.

PROCLAMATION
"BRAIN TUMOR ACTION WEEK"
MAY 1-7,2006
WHEREAS, each year, more than 190,000 people in the United States and 10,000 people in
Canada will be diagnosed with a brain tumor and of these, over 40, 000 new cases of primary
brain tumors are expected to be diagnosed in the United States in 2006; and
WHEREAS, because brain tumors are located at the control center for thought, emotion
and movement, their effects can be devastating, and at present standard treatments for brain
tumors include surgery, radiation therapy and chemotherapy, used either individually or in
combination; and
WHEREAS, enhancing the quality of lift of people with brain tumors requires access to
quality specialty care, clinical trials, follow-up care and rehabilitative services, and
improving the outlookfor adults and children with brain tumors requires research into the
causes of and better treatments for brain tumors; and
WHEREAS, there are a number of new approaches to the treatment of brain tumors, several
of which target the biological processes that cause a normal cell to multiply abnormally; and
WHEREAS, basic and clinical research is being conducted on a wide range of promising
therapies including angiogenesis inhibitors, differentiating agents, gene therapy,
immunotherapy and invasion inhibitors; and
WHEREAS, the North American Brain Tumor Coalition is sponsoring the 9th Annual Brain
Tumor Action Week to seek supporters in the fight against brain tumors; the North American
Brain Tumor Coalition is a network of twelve charitable organizations dedicated to
eradicating brain tumors; the Lori Arquilla Andersen Foundation is joining the coalition
and working with them to raise awareness.

SUBJECT: GARDEN FRESH MARKET, 1145 MT. PROSPECT PLAZA
CLASS C-1 LIQUOR LICENSE
On Tuesday, April 25, 2006, the Village Manager met with Messrs. Adi Mor (owner) and
Dan O'Neill (Vice President-Operations), regarding their request for a Class C-1 Liquor
License. The Class C-1 License provides for the retail sale of packaged liquors in
conjunction with a full-service grocery store over 10,000 square feet. Garden Fresh
Market is a full-service grocery store specializing in produce, deli selections and ethnic
foods. Garden Fresh will be occupying the former Dominick's Food Store at Mt.
Prospect Plaza. The space is currently under renovation with occupancy expected in
late July, early August.
The Village Manager reviewed at length with Messrs. Mor and O'Neill the Village's
particular sensitivity to the sale of alcohol to minors as well as sales to intoxicated
persons. The Village Manager informed the principals they were responsible for the
actions of all employees and that it was imperative to establish an appropriate training
program as well as management oversight with regard to such sales. The principals
indicated they had read the Village Code and understood all the requirements. Garden
Fresh has two other locations in the area that have liquor licenses. Mr. O'Neill indicated
that such controls were already in place at these other stores.
A completed application is on file with all required fees. The applicants have submitted
to fingerprinting and background checks. If the request is considered favorably, an
Ordinance creating a new class C-1 Liquor License would need to be adopted.

AN ORDINANCE AMENDING CHAPTER 13 OF THE
VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of
Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses
available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized.
Said list is hereby amended by increasing the number of Class C-1 Liquor Licenses by One (1) Garden
Fresh Market, 1145 Mt. Prospect Plaza. Said list is as follows:

SUBJECT: OUTDOOR DINING REGULATIONS
Village regulations currently provide for outdoor dining on both public and private property.
Consumption of alcoholic beverages in these dining venues is permitted (with the appropriate
Liquor License) by Chapter 13 (Alcoholic Liquors) unless the outdoor venue is within 300 feet of
a Residential Zoning District. This restriction is commonly referred to as the "Butch McGuire's
rule" dating back to the early 1990s. As you may recall, Butch McGuire's was a bar with an
extensive beer garden that abutted the backyards of a dozen single-family residences. The
impact of the beer garden on the adjoining residences was substantial and severe. When Butch
McGuire's closed due to fire, the Village Board adopted the 300-foot rule.
By and large, the "Butch McGuire rule" has served the Village well. However, with changes in
dining trends in the restaurant industry generally and the on-going redevelopment of Mount
Prospect's downtown specifically, this restriction presents severe limitations to realizing
desirable dining opportunities in the downtown and throughout the Village.
Staff looked at ways to keep the overall protection provided by the "Butch McGuire rule" in
place, yet permit, under closely regulated conditions, outdoor dining opportunities, with alcohol
service, closer than the current 300' limit. Attached is an Ordinance that would modify the
"Butch McGuire rule" by providing for the issuance of a Special Permit by the Liquor Control
Commissioner that would allow such an outdoor dining facility to be established. The strength
of the "Special Permit" approach is that it allows maximum flexibility for both the issuance and
revocation of said Permit. The Ordinance allows the Liquor Control Commissioner to establish
"conditions" as part of the permit. These conditions would be in addition to the rules and
regulations already in place governing outdoor dining venues.
Staff recommends favorable consideration of the proposed Ordinance.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 13, "ALCOHOLIC LIQUOR" OFTHE
VILLAGE CODE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE
POWERS:
SECTION 1: Chapter 13 entitled "Alcoholic Liquor" of the Village of Mount
Prospect Village Code, as amended, is amended further by deleting paragraph 0
in Section 13.117 "Restrictions on Premises" in its entirety and inserting a new
paragraph 0, which shall be read as follows:
D. Notwithstanding provisions of Chapter 14 or Section 9.115 of
this Code, it shall be unlawful for any licensee to serve or permit the
consumption of alcoholic beverages in any outdoor area when any portion
of the area is located within three hundred feet (300') of any residential
zoning district in the Village, except as follows:
(1) Any licensee that commenced the conduct of business in
an outdoor area within three hundred feet (300') of a
residential zoning district prior to January 1, 1989, may
continue to operate the outside service area;
(2) The Local Liquor Control Commissioner may grant a
special permit for the delivery of alcoholic beverages in
an outdoor service area subject to the following:
(a) The outdoor service area is on public or private
property, owned or leased by the licensee, and
immediately adjacent to the licensed premises;
(b) The Local Liquor Control Commissioner has
determined that the outdoor service area will not
have a detrimental effect on the neighborhood in
which the premises is located;
(c) The Local Liquor Control Commissioner may place
such conditions on the outdoor service area as
she or he may deem appropriate;
(d) such a special permit may be revoked at any time
if the Local Liquor Control Commissioner
reasonably believes that the operation of the
outdoor area is detrimental to the neighborhood in
which it is located and upon such revocation, the
Licensee may not reapply for a permit for a period
of twelve (12) months following the date of
revocation;
(e) such a special permit shall be available only to the
holder of a Class R, Class S or Class W liquor
license;
(f) alcoholic beverages may be served in the outdoor
area only with the purchase of food;
(g) such a permit may be granted only upon receipt by
the Local Liquor Control Commissioner and
approval by the Village Attorney of a statement
signed by the licensee acknowledging and
accepting the terms of the special permit; and
(h) such a special permit is not transferable and if
there is any change in the ownership of the
premises, whether by the addition of a new
shareholder, partner or limited partner, a new
special permit must be obtained by the licensee.
SECTION 2: All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed.
SECTION 3: This ordinance shall be in full force and effect from and after
its passage, approval, and publication in pamphlet form in the manner provided
bylaw.
