ORDINANCE NO. 2614
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 701 SOUTH CAN DOTA,
MOUNT PROSPECT, ILLINOIS
WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 26th day of February, 1976, at the hour of 8: 00 p.m. , at the Mount Prospect
lie Safety Building and did hear Case No. 44-V-75, pursuant to proper legal notice;
and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for variations to allow the petitioner to construct a garage to within
twelve fE!et (12') of the property line adjacent to Man-A-Wa Trail, and to within
two feet (2') of the property line adjacent to Lot 12, which Lot 12 is immediately ad-
jacent to and southeast of the subject proeperty commonly known as 701 South Can
Dota, Mount Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees the approval of this request under
Case No. 44-V-75 for the reasons that:
(1) There is a practical difficulty and particular hardship
on the petitioner;
(2) The purpose of the variations is not based exclusively
upon a desire to make money;
(3) The conditions upon which the petition for these varia-
tions is based are unique in that the lot is a corner lot.
subject to having two front yards; and
(4) The granting of these variations will not be detrimental
to the public or injurious to surrounding property in
that said variations will not alter the essential character
of the locality; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
concurred with the recommendation of the Zoning Board of Appeals that the varia-
tions herein be granted; and

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect hav~
reviewed the matter herein and have determined that the same is in the best interest~

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES!
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: '
SECTION ONE: That the property being the subject matter of Case No. 44-V-75,
being legally described as follows:

Lot 11 in Block 27 in Prospect Park Country Club, being a
subdivision of the Southeast Quarter CD of Section 11 and
the South 15 acres of the East Half (!) of the Northeast
Quarter (!) of said Section 11, Township 41 North. Range
11, East of the Third Principal Meridian, in Cook County.
Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
R-l (Single Family Residence) District, which zoning classification shall remain in
effect subject to the variations granted herein:
(a) That the yard abutting the frontmost lot line of the subject
property adjacent to Man-A-Wa Trail be reduced to twelve
feet (12') to allow the construction of a twenty-two foot by
twenty-four foot (22/x24/) garage upon the subject property .
(b) That the yard adjacent to Lot 12, which lot is located to the
southeast of the subject property, be reduced to two feet (2'),
so that the same aforesaid garage may be constructed upon the
subject property in the manner and location shown upon the
tracing attached hereto and hereby made a part hereof as Ex-
hibit I.
SECTION TWO: That all requirements of the Mount Prospect Building & Zoning
shall be applicable except the variations noted in SECTION ONE heretofore
SECTION THREE: That the Director of Building & Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accord-
ance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for a building per-
mit pursuant to such variations is made and construction commenced within one (1)
year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.
