ORDINANCE NO. 2631
AN ORDINANCE GRANTING A FRONT YARD VARIATION
FOR PROPERTY LOCATED AT 322 MARCELLA LANE
i}\THEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 4th day of March, 1976, at the hour of 8: 00 p.m. , at the Public Safety Build-
~ng, and did hear Case No. 10-V-76, pursuant to proper legal notice; and
~HEREAS , the Zoning Board of Appeals of the Village of Mount Prospect did hear
tlrl.s request for a front yard variation to allow the petitioner to utilize a portion
bf said front yard for the parking of motor vehicles thereon; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
,mend to the B11ilding Committee of the Board of Trustees of the Village of Mount
!Prospect the approval of this request under Case No. 10-V-76 for the reasons that:
(1) There is a practical difficulty and particular hardship
on the petitioner;
(2) The purpose of the variation is not based exclusively
upon a desire to make money;
(3) The conditions upon which the petition for this variation
is based are unique in that the said lot abuts the Northern
Illinois Gas Company's property; and
(4) The granting of this variation will not be detrimental to
the public or injurious to surrounding property in that
it will not alter the essential character of the locality; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did conduct a public hearing on May 13, 1976, and did review the recom-
mendations of the Zoning Board of Appeals in Case No. 10-V-76; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount ,
Prospect have recommended that the Board of Trustees of the Village of Mount Pros- i,
pect concur in the recommendations of the Zoning Board of Appeals under said Case ~
No 10-V-76. and ~

reviewed the matter herein and have determined that the same is in the best interest~

in the West Half G) of the West Half (D of the Southeast Quarter
G) of Section 35, Township 42 North, Range 11, East of the Third
Principal Meridian in Cook County, Illinois, according to the Plat
thereof registered in the Office of the Registrar of Titles of Cook
County, Illinois, on October 29, 1970, as Document No. 2528274,

SECTION ONE: That the property being the subject matter of Case No.

i~ currently zoned under the Zoning Ordinance of the Village of Mount Prospect
tiS R-1 (Single Family Residence) District, which zoning classification shall re-
xnain in effect subject to the variation granted herein:
That the use of the required and existing yard abutting the
frontmost lot line of the subject property adjacent to Marcella
Lane be varied so that the parking of a maximum number of
three (3) motor vehicles shall be permitted upon the paved
driveway area within the said front yard -- which driveway
area is shown upon the survey attached hereto and hereby
made a part hereof as Exhibit I.
'SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variation noted in SECTION ONE heretofore
~entioned.
SECTION THREE: That the variation granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for a building per-
mit to convert the existing garage upon the subject property into a habitable room
is made and construction commenced within one (1) year of the date this said Ordi-
nance becomes effective.
iSECTION FOUR: That this Ordinance shall be in full force and effect from and after
:its passage, approval, and publication in the manner provided by law.
