ORDINANCE NO. 2636
AN ORDINANCE GRANTING A SPECIAL USE TO THE
DELL CORPORATION FOR SENIOR CITIZENS HOUSING
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a
Public Hearing on Case No. 24-SU-76, with respect to a request for Senior Citizens
housing, on the 13th day of May, 1976, at the hour of 8: 00 p.m. , in the Public S
Building, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testi-
mony presented under Case No. 24-SU-76 pertaining to a request for certain special
uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon
the property hereinafter described; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the ap-
proval of this request under Case No. 24-SU-76; and
WHEREAS, the United States Housing Act of 1937 provides that there shall be local
determination for the need for low-rent housing, including Senior Citizen housing,
to meet needs not being adequately met by private enterprise; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
reviewed the matter herein and have determined that the same is in the best
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the special use authorized and granted in SECTION TWO
below is conditioned upon and shall be valid and effective only so long as:
A. That the use of the subject property is for housing for Senior
Citizens, i. e. , persons who have attained the age of sixty-two
(62) years;
B. That the construction of the subject property will meet the require-
ments set forth by the Department of Housing and Urban Development
as well as Section 8 of the "United States Housing Act of 1937" , as
amended;
C. That the construction of the Senior Citizens facility contemplated
herein shall be located as shown on the Site Plan attached hereto
and hereby made a part hereof as Exhibit I; with the further re-
quirement that the forty-six (46) efficiency units, forty-eight (48)
I-bedroom units, and six (6) 2-bedroom units will be laid out sub-
stantially the same as shown upon the floor plans for such units,
attached hereto and hereby made a part hereof as Group Exhibit II,
"a" through "f"; and that such units will be leased through a twenty
(20) year through forty (40) year agreement with the Department
of Housing and Urban Development to persons at least sixty-two
(62) years old. or physically handicapped, pursuant to the pros-
pectus attached hereto and hereby made a part hereof as Exhibit III;

D. That the said special use granted in SECTION TWO hereinbelow i
shall not run with the land, but shall be limited to that period I

of time wherein the subject property is owned, operated, and I
maintained by Dell Corporation, a petitioner herein. I
SECTION TWO: That, pursuant to the Mount Prospect Zontng Ordinance and in acco~
with the terms and conditions of this Ordinance, the following special use is hereby I
authorized upon the subject property described in SECTION THREE hereinbelow: I
The construction, maintenance, and operation of one hundred (100)
dwelling units for Senior Citizens housing pursuant to the terms of
this Ordinance and Exhibits I, II, and III hereto. I
SECTION THREE: That the special use authorized to be established in SECTION TwA
above shall be valid and effective upon the following property, hereinabove and her~-
inafter referred to as "subject property" , legally described as: I
Lot Thirty-seven (37) in I
Westgate Garden Subdivision, being a subdivision of part of the !
Northeast Quarter CD of the Southwest Quarter (!) of Section 35, I'
Township 42 North, Range 11, East of the Third Principal Meri- 'I
dian, in Cook County, Illinois, '
which property has been zoned R-2 (Duplex Residence) District, and which zoning I
classification shall remain in full force and effect, subject to the special use under 1
the terms, conditions, and exhibits of this Ordinance. i
SECTION FOUR: That the Village Clerk shall and he is hereby authorized to record i
at the petitioner's expense, a certified copy of this Ordinance with the Cook County
Recorder of Deeds and/or the Registrar of Titles of Cook County, Illinois, as the cas
may be. !

SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.

MT. PROSPECT ELDERLY APARTMENTS DATA
TENANT - INCOME - RENT - CARE - PARKING
ELDERLY OCCUPANCY WILL BE SECURED BY A 20 TO 40 YEAR LEASE
WITH HUD. (SEE ATIACHED HUD LETTER.)
TO BE ELIGIBLE, AN OCCUPANT MUST BE AT LEAST 62 YF:ARS OLD
OR HANDICAPPED AND HAVE A MAXIMUM TOTAL INCOME OF ABOUT
$7,000 FOR A SINGLE PERSON AND $9,000 FOR A COUPLE. TEN PER-
CENT OF A PERSON'S ASSETS ARE CONSIDERED PART OF THEIR TOTAL
INCOME FOR ELIGIBILITY DETERMINA TIONS.
ABOUT 70 PER CENT OF THE UNITS WILL BE OCCUPIED BY 70 TO 75
YEAR OLD WIDOWS LIVING ON SAVINGS, SOCIAL SECURITY, AND
PENSIONS.
RENT TO A TENANT WILL BE NO MORE THAN 25 PER CENT OF THEIR
INCOME. THE REMAINING RENT WILL BE PAID BY HUD.
THE APARTMENTS ARE NOT FOR PEOPLE REQUIRING NURSING HOME
TYPE CARE.
ABOUT 10 TO 15 PER CENT OF THESE TENANTS OWN CARS IN SIMILAR
FACILITIES. WE ARE PROVIDING PARKING FOR 40 PER CENT TO AC-
COMMODATE VISITORS, ETC. HUD TYPICALLY PROVIDES 25 PER CENT.
THE SITE IS WALKING DISTANCE TO MOUNT PROSPECT PLAZA SHOP-
PING CENTER, BUS SERVICE TO RANDHURST, AND THE MOUNT PROS-
PECTNORTHWESTERN RAILROAD STATION WHICH REDUCES THE NEED
FOR CARS. TENANT AGE AND INCOME ALSO REDUCES CAR OWNERSHIP.
