ORDINANCE NO. 2638
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 405 EAST BERKSHIRE LANE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 13th day of May, 1976, at the hour of 8: 00 p.m. , at the Public Safety Build-
ing and did hear Case No. 21-V-76, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to allow the petitioner a variation from the portable swimming pool re-
gulations contained in subsection B of Section 21.1121 of the Mount Prospect Muni-
cipal Code on the lot legally described hereinbelow; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
pect the approval of this request under Case No. 21-V-76; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did conduct a public hearing on June 11, 1976, and did review the recom-
mendations of the Zoning Board of Appeals in Case No. 21-V-76; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount Pros-
pect concur in the recommendations of the Zoning Board of Appeals under said Case I
No. 21-V-76; and
WHEREAS, the President and board of Trustees of the Village of Mount Prospect hav
reviewed the matter herein and have determined that the same is in the best interest
of the Village of Mount Prospect;
SECTION ONE: That the property being the subject matter of Case No. 21-V-76,
ing legally described as follows:
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
Ellendale-East, being a Subdivision of the South Thirty (30) acres
of the West Forty (40) acres of the Southeast Quarter cn of Section
12, Township 41 North, Range 11, East of the Third Principal Meri-
dian, according to Plat thereof registered in the Office of the Regis-
trar of Titles of Cook County, Illinois, on July 21, 1955, as Docu-
ment No. 1609080,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residence) District, which zoning classification shall re-
main in effect subject to the variation granted herein:
That the use of the subject property may include the location of a
prefabricated swimming pool, having a depth at any point of more
than two (2) feet and utilized upon the subject property herein-
above described without an excavation, which portable swimming
pool may be located at the southwest property line upon the subject
property .

ECTION TWO: That all requirements of the Mount Prospect Building and Zoning
odes shall be applicable except the variation noted in SECTION ONE heretofore
I entioned.
ECTION THREE: That the Director of Building and Zoning of the Village of Mount
!rospect is hereby authorized to issue a building permit for construction in accord-
~ce with the variation hereinbefore mentioned.

ECTION FOUR: That the variation granted by this Ordinance shall be null and
" oid and of no force and effect whatsoever unless an application for a building
ermit pursuant to such variation is made and construction commenced within one
,1) year of the date this said Ordinance becomes effective.

ECTION FIVE: That this Ordinance shall be in full force and effect from and after
s passage, approval, and publication in the manner provided by law.
