!iwHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on I
lithe 26th day of February, 1976, at the hour of 8: 00 p.m. , in the Public Safety Build-
l~ng, pursuant to proper legal notice; and I

l!wHEREAS , the Zoning Board of Appeals of the Village of Mount Prospect heard testi- I
JfInony presented under Case No. 20-V-75 pertaining to a request for a land use varia-I
~!tion to operate a medical and professional office building use of premises zoned ~
ljwithin the R-3 (Apartment Residence) District; which premises is commonly known I
!,las 435 West Prospect Avenue, Mount Prospect, Illinois; and i

iIWHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- I
!jmend to the President and Board of Trustees the approval of this request under I
OCase No. 20-V-75; and i

i!WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount I
!jprospect did meet on April 14, 1976 , and did consider the recommendations of the
!jZoning Board of Appeals under Case No. 20-V-75; and

~lWHEREAS , the Building Committee recommended to the President and Board of I
IiTrustees of the Village of Mount Prospect to allow the variation as presented in
Hsaid Case No. 20-V-75; and

II WHEREAS , the President and Board of Trustees of the Village of Mount Prospect I
l! have reviewed the matter herein and have determined that the same is in the best 1
!! interests of the Village of Mount Prospect. I

il NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEESl

II SECTION ONE: That the property being the subject matter of Case No. 20-V-75, I
Ii being legally described as follows: I

Lot 1 in The Heck Resubdivision in Mount Prospect, being a resub-
division of Lots 20, 21, and 22 in H. Roy Berry Company's Subdivi-
sion of part of the Northeast Quarter <-n of Section 11, and part of
the Northwest Quarter CD of Section 12, all in Township 41 North,
Range 11, East of the Third Principal Meridian, in Cook County, Illi-
nois ,
~i is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
11 R-3 (Apartment Residence) District, which zoning classification shall remain sub-
ii ject to the following granted variation:

office purposes or such other purpose as may be authorized as an
allowable use under the R-3 (Apartment Residence) District, and
that no other uses shall hereafter be allowed upon the subject pro-

IbECTION TWO: That the construction of any building shall conform to the applicableIi
!requirements of the Building Code of the Village of Mount Prospect for construction !
!lwithin the Conflagration Hazard District No.1; and that in all other respects all othe~
i~equirements of the Municipal Code of Mount Prospect shall be applicable to the subje~t
iIProperty, except as altered herein and except for the variation specified in SECTION I
