ORDINANCE NO. 2555
AN ORDINANCE GRANTING A REAR YARD REQUIREMENT
VARIATION FOR PROPERTY LOCATED AT 222 NORTH
WILLIAM STREET, MOUNT PROSPECT, ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 21st day of November, 1974, at the hour of 8: 00 p. m. , at the Mount Prospect Vil- Ii
lage Hall and did hear Case No. 47-V-74, pursuant to proper legal notice; and iI
WHEREAS, the Zoning Board of Appeals of the'Village of Mount Prospect did hear this~
request to construct a creened-in porch on an existing concrete slab to within ten feet
four and one-half (10' H") of the rear yard lot line instead of the required twenty'
feet (20') on the lot commonly known as 222 North William Street, Mount Prospect,
Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the ap-
proval of this request under Case No. 47-V-74 for the reasons that:
(1) There is a practical difficulty and particular hardship
on the petitioner;
(2) The purpose of the variation is not based exclusively
upon a desire to make money;
(3) The conditions upon which the petition for this variation
is based are unique in that its layout is not similar to any
other lot in the area, being a corner lot of unusual physical
shape; and
(4) The granting of this variation will not be detrimental to the
public or injurious to surrounding property in that it will
not alter the essential character of the locality; and
WHEREAS, The Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on January 8, 1975, and did review the aforesaid Case No. 47-V-74;,
and has recommended to the Board of Trustees of the Village of Mount Prospect that
it concurs with the recommendations of the Zoning Board of Appeals with respect to
Case No. 47-V-74; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 47-V-74, be-
ing legally described as follows:
Lot One (1) in Block Nine (9) in Bluett's Subdivision of part of the
North Half (l) of the Southeast Quarter C!J of Section 34, Township
42 North, Range 11, East of the Third Principal Meridian, according
to Plat thereof registered in the Office of the Registrar of Titles of
Cook County, Illinois, as Document No. 1464233,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
R-1 (Single Family Residential) District, which zoning classification shall remain in
effect subject to the variation granted herein:
That the rear yard abutting the rearmost lot line of the subject
property adjacent to Isabella Street be reduced to ten feet four
and one-half inches (10' H") .
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variation noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accord-
ance with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null and voidf
and of no force and effect whatsoever unless an application for a building permit pur-i
suant to such variation is made and construction commenced within one (1) year of
the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
passage, approval, and publication in the manner provided by law.
