ORDINANCE NO. ~5?
AN ORDINANCE AMENDING ARTICLE II, CHAPTER 9 OF
THE MUNICIPAL CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTESS OF THE VILLAGE OF
MJUNf PROSPECf, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the President and
Board of Trustees of the Village of MOunt Prospect under Article VII of the
1970 Constitution of the State of Illinois, Article II of Chapter 9 of the
Municipal Code of the Mount Prospect of 1957, as amended, be and the same
is hereby further amended by adding thereto two additional Sections to be
known as Section 9.202 and Section 9.203; which Sections 9.202 and 9.203
hereafter be and read as follows:
"Section 9.202 Prior Approval of Work by the President and
Board of Trustees.
A. No person, firm, corporation, trustee, and/or other legal
entity or association, and no unit of local government as
defined in the Illinois Constitution of 1970 (other than
the Village of Mount Prospect and any other public utility
holding the current franchise granted to it by the Village
of Mount Prospect) shall commence installation, construction,
re-construction, repair, or replacement of any roadway,
thoroughfare, street, highway, easement, open space for the
use of the public for the primary purpose of vehicular
traffic, water main, sanitary sewer, storm sewer, field
tile, cable, .or any other structure, or perform any other
work of any kind upon, above, or below the surface of the
ground which is upon any real estate, easement, right-of-
way, street, highway, roadway, licensed, leased, or owned
by or under the control of or within the corporate limits
of the Village of Mount Prospect, unless and until the
President and Beard of Trustees of the Village of Mount
Prospect shall have first approved such proposed work.
B. The approval provided for in Section A hereinabove shall be
in addition to the requirements of other prior approvals
of other official or officials as set forth in any other
applicable ordinances of the Village of Mount Prospect.
"Section 9.203 Penalties.
It is a misdemeanor for any person to violate any of the
provisions of this Article. Every person, firm,
corporation, trustee, other legal entity, association, or
unit of local govel1ruTIent as defined in the Illinois
Constitution of 1970 convicted of a misdemeanor for the
violation of any of the provisions of this Article shall
be punished by a fine of not less than Twenty Five ($25)
Dollars nor more than Five Hundred ($500) Dollars. Each
and every additional violation existing shall be deemed
a separate and distinct violation for the purposes of
determining punishments hereunder."
SECTION ThD: That, the provisions of this Ordinance shall apply to all
applications on file with the Village of Mount Prospect at the effective date
hereof as well as any and all future applications and/or work to be done.
SECTION THREE: That, if any part or parts of this Ordinance shall be held to!
be unconstitutional, such unconstitutionality shall not effect the validity ~
of the remaining parts of this Chapter. The Board of Trustees of the Villagel
of Mount Prospect hereby declares that it would have passed .the remaining I
parts of this Ordinance if it had known that such part or parts thereof would!
be unconstitutional.
SECTION FOUR: That this Ordinance shall be in full force and effect from and!
after its passage, approval, and publication in the manner provided by law.
