HomeMy WebLinkAboutOrd 2674 11/16/1976 II ORDINANCE NO. 2674 AN ORDINANCE GRANTING A HEIGHT VARIATION FOR PROPERTY LOCATED 100 SOUTH EMERSON STREET r .I WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did condu t a public hearing under Case No. 64-V-76, on the 28th day of October, 1976, at the hour of 8: 00 p. m., in the Mount Prospect Village Hall, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 64-V-76 pertaining to a request for a certain. variation from the Mount Prospect Zoning Ordinance to permit the erection of three (3 antennae towers upon the subj ect property, which towers shall not exceed a total height of sixty feet (60T) when measured from grade legally described as follows: Lots 1, 4, 5 and 6 in Busse & Wille's Resubdivision in Mount Prospect, recorded March 31, 1906, Document No. 3839591, in Cook County, Illinois; and WHEREAS, the Zoning' Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees of the Village of Mount Prospect that the requested height variation be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on the 11th day of November, 1976, and did consider the recommendations of the Zoning Board of Appeals under Case No. 64-V-76; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals to allow the height variation requested under Case No. 64-V-76; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subj ect property NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the following variation be and it is hereby granted for the above described property which is the subject matter of Case No. 64-V-76; The terms of the Mount Prospect Building Code are hereby varied so as to permit the construction and erection of three (3) antennae towers upon the subject property. SECTION TWO: That the aforesaid variation will be valid and effective only upon the performance and continuous maintenance with respect to the subject property II II II 64-V-76 2 of the following condition and restriction: That the total height of the towers including the antennae attached to the top thereof shall not exceed sixty feet (60T) when measured from grade. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit for the subject towers in accordance with the variation and limitation herein set forth. SECTION FOUR: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
