Ii !I I; I' II Ii II ,I II II II II II Ii I, I ORDINANCE NO. 2696 AN ORDINANCE ADOPTING AMENDMENTS TO THE BUILDING CODE -_._--_...._~,.-....-~ " ARTICLE I. ENACTMENT and SCOPE SECTION 21.101. Purr>ose. The purpose of this code is to provide for safety, health and public welfare through structural strength and stability, means of egress, adequate light and ventilation and protection to life and property from fire and hazards incident to the design, construction, altera- tion, removal or demolition of buildings and structures, and to regulate the ai'chitectural design of buildings or structures erected or to be erected in the village limits of Mount Prospect. SECTION 21.102. Scope. The provisions of this code apply to the construc- tion, alteration, equipment, use and occupancy, location, maintenance of and additions to buildings and structures and to appurtenances such as vaults) areaways and street encroachments hereafter erected and, where expressly stated, exi.sting on land or over water; and to buildings and structures and equipment for the operation thereof hereafter moved or demolished within the corporate limits of the Village of Mount Prospect. The provisions of this code based on occupancy also apply to conversions of existing buildings and struc- tures or portions thereof from one occupancy classification to another. SECTION 21.103. Adoption of the BOCA B.asie Building Cod~. For the purpose of establishing rules and regulations for the construction, altera- tion, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, there is hereby adopted the 1975 edition of the BOCA Basic Building Code promulgated by the Building Offi- cials and Code Administrators International, Inc. , together with the 1976 Supplement thereof, except such portions thereof as are hereinafter express- ly deleted, modified, or amended. A. This code shall establish restrictions within fire limits and regulate the construction of aU building"s and structures except where other provi- sions of this Chapter specifically cover the subject matter in question. B. While the 1975 edition of the BOCA Basic Building Code and the 1976 Supplement have hereinabove been adopted, the following exceptions thereto (consisting of certain deletions and changes) shall control wherever the said exceptions are applicable or are in conflict with cer- I II II I II Ii II II ,I II II !I I' II 'I II II Ii II 'I I I II Ii I I I i I I I I , I II !1 I I I I 'I II Ii II Ii I' I I I ! Ii I tain other provisions of the said BOCA Code. 1. Deletions: a. Delete Section 128,0 of Article 1 in its entirety . b. In Section 302.2 of Article 3, delete the words nor protected frame (type 4A) II . c. In Section 302.4 of Article 3, delete the words nor Class C" therein. d. Delete Sections 315.1 through 315.3 of Article 3 in their en- tireties . e. Delete Sections 316.0 through 316.11 of Article 3 in their en- tireties. f. The entire Article 14 and Article 15 of the BOCA Basic Build- ing Code as adopted in this Section 21.103 are hereby deleted from this Chapter 21 of the Municipal Code of Mount Prospect. 2. Changes: a. Amend Section 306.2 of Article 3 to permit the use of "split fire lanes" where designated by the Bureau of Fire Prevention, 1) Such split fire lanes shall be no less than twenty (20) feet in width with a center strip of no greater than three (3) feet in width. a) Such center strip shall be landscaped with grass or other plantings not exceeding twelve (12) inches in height. 2) All fire lanes shall otherwise be constructed to conform with the specifications of the Village of Mount Prospect and NFPA #1. 3) In any event, however, all fire lanes shall be sign-posted as fire lanes at the sole expense of the owner of the proper- ty upon which said signs are located and at the locations designated by the Chief of the Fire Prevention Bureau. b. Amend Section 315.1 of Article 3 so as to require the vari- ance to be granted by the President and Board of Trustees of the Village of Mount Prospect after hearing before the Zoning Board of Appeals, rather than by the Board of Ap- peals. c. Amend Section 431. 2.8 of Article 4 so as to require oversized elevator cabs in all buildings containing elevators. d. Make the following chang'es in Article 12: 1) In Section 1202.2, delete: I1Exception: Auditoriums, foyers, lobbies, End toilet rO')illS" . I , i I -2- I I ,"~~J.~_>_~~. Ii II ,I II I 3) Change Section 1202,6 to read: ftBusiness (D) use: In all buildings or structures over five (5) stories in height and/or buildings or structures over 10,000 square feet in area and/or two (2) stories in height and 5,000 square feet in areat! . 4) Make the following changes in Section 1202.9: a) The number 111ft, change 1t12 ,000 square feet" to t! 7 , 500 square feetlt . b) Change number ft2lt to read: Itwhen more than one (1) story in height regardless of floor areatl . c) Delete number 113ft in its entirety. 5) Add to Section 1202.10: Itand in all dumbwaiters and all common areas of the buildingtt . 6) Add to Itexceptionll in Section 1202.16: "Throughout all basements and cellars having an area of 2,000 square feet or more if used for manufacturing, storage or sale of com- bustible material or merchandise, or housing motor vehi- cles, an automatic fire suppression system is required". 7) Add new Section 1202.31 to read as follows: IIAssembly (A-4) churches, schools, colleges and for similar educa- tional and religious purposes over one (1) story in height and/or over 10,000 square feet in area per floortt. 8) Amend Section 1216.3.4 by adding the following: a) trThe smoke detectors required hereinabove shall be of the 110 volt type and permanently wired into the electrical system. It b) ltThe smoke detectors required hereinabove shall also be required in existing buildings at any time that a building permit for alterations, enlargement, or re- storation is approved for any work in excess of Five Hundred ($500) Dollars. Said smoke detectors may be of the wired-in type or battery operated. tI SECTION 21.104. Ado:e.tion of the National Fire Protection Association Codes. Whenever the BOCA Codes (heretofore adopted) do not expressly make provision for specific items to be constructed and/or installed, Vol-- urnes 1-5 and 7-16 of the National Fire Codes as promulgated by the National Fire Protection Association shall control such construction and/or installa-- tion and are hereby adopted in their entireties, except such portions thereof as may be expressly deleted, modified, or amended by this Chapter 21 of thelVIunicipal Code of Mount Prospect. -3- I I Ii d I I I I ,I 'I I II I II I I I I I !I I II I I 'I I "..-",. i II II d SECTION 21.105. Adoption of the BOCA !VI echanical Code and the BOCA I Plumbing Code. A. The 1975 edition of the BOCA Mechanical Code and the 1976 Supplement thereto are hereby adopted in their entireties, except such portions thereof as may be expressly deleted) modified) or amended by this Chapter 21 of the Municipal Code of Mount Prospect. II I) 1. ~elete: M-122.1 through M-122. 6, and substituting therefor all of Section 127.0 of the Basic Building Code heretofore adopted by re- ference. B. The 1975 edition of the BOCA Plumbing Code and the 1976 Supplement thereto are hereby adopted in their entireties, except such portions thereof as may be expressly deleted, modified, or amended by this Chapter 21 of the Municipal Code of Mount Prospect. 1. Delete: P-122.1 through P-122.4 and substitute therefor all of Section 127.0 of the Basic Building Code heretofore adopted by re- ference . 2. Changes: a. In Article 3: 1) In Section P-308.2, insert "200" in the brackets. 2) In Section P-313. 3, insert 115'OIt for water piping and 4'611 for sewers" . b. In Article 4: 1) In Section P-405.1.3, insert a period (.) after the words Itlead pipe" and delete IICPVC hot and cold water plastic pipe or plastic cold water pipe". Also delete" all plastic pipe shall be marked with the appropriate identification of a quality control agency recognized in duly authenticated reports from Building Officials and Code Administrators Internationallt . c. In Article 12: 1) Add new Section P-1205. 5 to read as follows : "All flushometer and/or tank-type urinals shall be of a wa- ter conserving nature and operate at a rate not to ex- ceed 3.0 gallons maximum per flush." 2) Add to Section P-1206 as follows: a) In Section P-1206.2, add: "... at a rate not to ex- ceed 3.0 gallons per flush It . b) In Section P-1206. 3.1, add:" to thus act as a water conserving device and prohibit the valve from remaining in an open position /I . -4- ----________L_ c I) ~-~, c) In Section P--1206.3.2, add: "Water closets for flush tanks shall be of a water conserving nature and operate at a rate not to exceed 3.5 gallons maximum per flush 11 . 3) Add to Section P-1207 as follows: I I I ,I II I a) In Section P-1207.3, add: liThe water supply to sinl~s in public facilities shall be equipped with self--closing faucets which will not permit the un- attended fauct~t to be left in the open position". 4) Add to Sf:ction P-1209 as follows: a) In Section P-1209 .1.1, add: "Every shower shall be equipped with a limited flow shower head of a water conserving nature, and operate at a rate not to exceed 3.0 gallons per minutel1 . 5) Add to Section P-1210 as follows: a) In Section P-1210. 2, add: tiThe water supply to sinks shall be equipped with water saving devices that use aerators plus restrictors to operate at a rate not to exceed 3.0 gallons per minute" . d. In Article 16: 1) Add to Section P-1601 as follows: I; I a) In Section P-1601. 3, add: I1Every building equipped with plumbing fixtures and used for hu- man occupancy or habitation shall be provided with a water saving device on all plumbing fix- tures. These fixtures shall not utilize a water flow rate in excess of the maximum rates publish- ed by the Illinois Department of Transportation in Rules and Procedures for Lake Michigan Alloca- tion, or as may be forthcoming from the Secretary of Housing and Urban Development, pursuant to the Energy Conservation Standards for New Buildings (P .L. 94-385)11. SECTION 21.106. Filing Requirements. Not less than three (3) copies each of the codes adopted by reference hereinabove and as set forth in Sec- tions 21.103, 21.104 and 21.105 of this Chapter have been and now are filed in the Office of the Village Clerk. being nevertheless hereby adopted and incorporated as fully as if set out at length herein, and the provisions there- of shall be controlling the construction of all buildings and structures to the extent specified therein within the corporate limits of the Villag'e of Mount Prospect . A. In the event any of the provisions of any of the above named codes are in conflict with either this Building Code or the Zoning Ordinance of the Village of Mount Prospect. this Building Code and such Zoning Ordi- nance shall prevail, and the conflicting provisions of those other codes hereinabove adopted by reference shall be of n.o effect. -5- Ii C. If any Chapter, Article, Section, or Paragraph, or any part or parts I: II of any Chapter, Article, Section, or Paragraph of this Code is declared , invalid or unconstitutional, it shall not be held to invalidate or impair Ii the validity, force, or effect of any other Chapter, Article, Section, or 11 Paragraph, or any part or parts of any other Chapter, Article, Section. II or Paragraph of this Code. " I ,j I I: SECTION TWO: That, pursuant to the authority vested in the President and Board il of Trustees of the Village of Mount Prospect under Article VII of the 1970 constitu-/ II lion of the State of Illinois as well as the Illinois Revised Statutes. Article III 01 . I Chapter 21 (Building Code) contained in the Municipal Code of Mount Prospect of f 1957, as amended. be and the same is hereby amended in its entirety; so that here after the said Article III of Chapter 21 shall be and read as follows: I I I I I I II II II I: 'i /1 ,I II ,I II II II II I' II ,I [I i II II Ii II r II II I: ,I i! ii B. The term "BuUding Official" as used in any of the above adopted codes shall mean the Director of Building and Zoning of the Village of Mount Prospect. C. Any references in any of the above adopted codes to the "municipality" OJ:' to the "city" 0,1' to the "village" shall mean the Village of Mount Pros- pect. SECTION 21.107. Miscellaneous Provisions. A. Any provisions of this code shall be deemed to supplement and other- wise void any existing building ordinances. Should any two (2) provi- sions conflict, the more restrictive one shall govern. B. Any existing State laws or revisions thereto pertaining to the erection, maintenance, or occupancy of buildings and structures are hereby made a part of the code. Should any provisions in the State laws conflict with a similar provision of this Building Code, the local ordinance shall go- vern. " ARTICLE III. FIRE LIMITS SECTION 21. 301. Conflagration Hazard District Established. A. For the purposes of lessening the possibility of conflagration or fire spread between buildings in close proximity, a conflagration hazard district to be known as Conflagration Hazard District is hereby estab- lished. within which Conflagration Hazard District certain types of construction are prohibited, as specified in Section 21.302 hereunder. B. All property lying within, or which hereafter may be situated within, the B-1, B-2, B-2.1, B-3, B-4, I-I and 1-2 zoning districts as delin- eated in the Village of Mount Prospect Zoning Ordinances shall be con- strued as being in said Conflagration Hazard District. All properties developed under special use ordinances for business uses or industrial uses shall be included in the Conflagration Hazard District. -6- 11 II 'I II .11 , II L II II II I I I I I, [I II 'I I' I II 'I I I I I II II II II I I I I II !I II '/ I, II I C. A building or structure shall be deemed to be within the Conflagration Hazard District if any portion of the area of such building or structure is located therein, Nothing in this Article shall be interpreted to pre- vent the application of location limitations by the Zoning Ordinance of the Village of Mount Prospect. ' SECTION 21.302. Exceptions.' The following accessory structures shall be allowed as exceptions within the Conflagration Hazard District. A. Fences not exceeding the height limitations of the Village of Mount Pros- pect Fence or Zoning Ordinance. B. Temporary platforms, reviewing stands, builders' shanties. and simi- lar temporary structures erected for a limited time as approved by the Director of Building and Zoning. C. Greenhouses not more than fifteen (15) feet in height erected on the same lot as, and accessory to. a store. D. Wall signs affixed flat against the building. E, Ground signs where permitted and not exceeding the height and square foot requirements of the Sign Ordinance of the Village of Mount Prospect. SECTION 21. 303 ti.on-Conformin~ Uses. The provisions of the Village of Mount Prospect Zoning Ordinance relating to non-conforming uses and struc- tures shall not effect the requirements of this Ordinance. SECTION 21.304. Conflagration Hazard District Ma:e. A. The Bureau of Fire Prevention, in conjunction with the Director of Building and Zoning of the Village of Mount Prospect, shall prepare or cause to be prepared a master map on which shall be accurately indicat- ed the area and boundaries of the Conflagration Hazard District estab- lished by this Ordinance. Said Conflagration Hazard District Map shall be available for inspection in the Office of the Village Clerk during re- gular business hours. B. A Zoning Map showing the boundaries of the various zoning districts and special uses mentioned in this Ordinance shall be sufficient map for the purpose of this Section 21. 304. SECTION 21.305. Automatic Detection and/or Extinguishment of Fire. A. Authority is hereby conferred upon the Chief of the Fire Department to adopt and promulgate rules based upon the standards of any nationally recognized organization embodying details for the installation and con.- struction of automatic sprinkler equipment and/or automatic fire detec- tion equipment in such instances where. based upon the standards con- tained herein, any building or part thereof because of its size, con- struction, occupancy, or lack of suitable protective equipment, shall be deemed by the said Fire Chief or his duly authorized agent to con- stitute a special fire hazard to life or property or an excessive burden upon the fire extinguishing facilities of the Fire Department. -7- , Ii II I I B. All 3utomatic sprinkler equipment specified herein shall be inspected at least once each year as is specified hereinbelow, and at all times maintained in proper operative condition by the owner or occupant of such building. The occupant(s) of such buildings containing such equipment shall promptly notify the Fire Prevention Bureau of the Fire Department in case such sprinkler system or any other equipment spe- cified herein is withdrawn from such building, or the use of such equip- ment therein is interrupted, curtailed, or altered. C. It shall be the responsibility of the owners of all buildings having inter- ior fire alarm and suppression systems both existing and those which are to be constructed, to provide for the continuous maintenance of such systems through no less than an annual inspection and testing of the systems, and through a maintenance agreement with a reliable firm actively engaged in the servicing of fire alarm and suppression systems. I' 1. Proof of such a maintenance agreement, and each subsequent agree- ment for continuous service shall be provided to the Fire Preven- tion Bureau of the Fire Department by the owner of any such build- ing. a. For new construction, such proof shall initially be provided at the time the fire alarm and suppression system plans are submitted for approval to the. Bureau of Fire Prevention, and thereafter on an annual basis. b . For existing construction, proof of such a maintenance agree- ment shall be provided within ninety (90) days of the enact- ment of this Ordinance. c. Proof of each annual inspection and testing of the fire alarm and suppression systems shall be provided to the Fire Preven- tion Bureau upon completion of such test. 2. A valid maintenance agreement and a report of the most recent in- spection and testing of the fire alarm and suppression systems shall be provided by the owners of the systems, to any fire inspec- tion officer of the Village of Mount Prospect upon request. SECTION 21.306. Special Regulations for all Buildings Containing Four Stories or More. A. Standpipes. 1. Standpipes and sprinkler Fire Department siamese connections shall be no further than ten (10) feet apart; shall be located on the street or road side wall of any such building; shall be readily accessible; and shall be located no further than 300 feet from the nearest oper- able fire hydrant - which 300 feet shall be measured along a route normally used by motor vehicles. 2. Test with N, s:1', (National Standard Thread). b. Such standpipes shall be installed in accordance with the Na- tional Fire Protection Association Pamphlet No. 14. B. ~vators - Fire Service. 1. A three (3) position (on, off, and by-pass) key shall be provided at the main floor for each single elevator and for each group of ele- vators. This keyed switch shall be located in the left door jamb of the elevator entrance. Where there is more than one elevator, the left elevator shall have the switch. The keyed switch shall be locat- ed not less than six feet six inches (6'611) above the floor and appro- ximately four inches (4") below the headjamb. 2. A keyed switch shall be provided in or adjacent to the operating panel of each elevator. The switch, when operated, shall put the. elevator on emergency service. 3. Power operated doors shall remain closed when the elevator stops at any landing except the main floor until opened by continuous pressure on a door-open button switch. As soon as this door-open button switch is released, the doors shall automatically reclose. 4. Where mechanical-electrical safety edge devices are installed on the leading edge of the car doors, these devi.ces shall remain opera-- tive and doors may be maintained in open position by operation of the device. Any features that may cause doors to reclose after be- ing held a predetermined time shall be disconnected. 5. Keys required to call or operate elevators shall be kept in a conspi- cuous location at the main floor as approved by the Bureau of Fire Prevention. The box shall have a lOCk-type cover which can be opened by the Fire Department's alarm box key. The box shall con- tain a separate key for each elevator in the group. 6. Every group of elevators in a building subject to the provisions of this Section 21. 306 shall be available for firemen's emergency ser- vice. In buildings where there are several groups of elevators and where individual key switches are provided to cause cars to return to the main floor, this arrangement is satisfactory provided that a separate key box is provided for each group of elevators. 7. Immediately adjacent to the firemen's return switch in the car sta- tion, a push button shall be provided to cancel all registered calls when the elevator is on Firemen's Control. The button shall be marked "Fire Cancel". This button shall not be required if all car calls are cancelled when the car makes its first stop. C. Fire Extinguishers and Fire Alarm Systems. 1. Ten (10) pound ABC Fire Extinguishers shall be installed in break- able glass fronted cabinets at locations meeting the requirements of the National Fire Protection Association, Pamphlet No. 10. -9-- 'I I - i ,il 2. Fire alarm systems shall conform to all requirements of the Nation- al Fire Codes hereinbefore adopted. D. Special_Firin~. 1. Non-energized wiring to provide emergency power for fire fighting and other Fire Department purposes shall be installed and located in each stairwell, at each floor level and at ground level - all inter- connected in the following manner: a. An N .E.M.A. L10-30P or approved equivalent weatherproof corrosion resistant male with a snap-type waterproof cover shall be installed adjacent to the Fire Department sprinkler connection (but not so as to interfere with same) and color coded red. b. An N .E.M..A. L10-30R or approved equivalent weatherproof corrosion resistant female with a snap-type waterproof cover shall be installed in each stairwell, at each floor level and color coded red. c. If these installations are not flush mounted, a waterproof en- closure shall be provided. d. Wiring shall conform to the following: 1) T .H. W. #8 in 3/411 conduit, with ground from conduit to neutral, if exposed conduit, to be heavy wall; if conceal- ed conduit, to be thin wall, for buildings up to one hund-- red (100) feet in height. 2) T .II. W. # 6 in 111 conduit, with ground from conduit to neu- tral if exposed conduit, to be heavy wall; if concealed con- duit, to be thin wall, for buildings over one hundred (100) feet in height. e. Wiring shall be 3-pole, 3-wire grounded circuit, conforming with N.E.M.A. LIO-30. E. Voice Communication System. There shall be two (2) approved electri- cally supervised communication systems as described below: 1. A two (2) way Fire Department communication system, which shall provide two (2) way communication capabilities between the con- trol station and the following terminal areas: elevators, elevator lobbies, exitway access corridors, and exitway stairways. 2. A one (1) way (address) communication system for transmission of emergency directions to the building occupants, which shall pro- vide one (1) way communication capabilities between the central control station and throughout the following terminal areas: eleva- tors, elevator lobbies, exitway access corridors, and exitway 8tai1'- ' ways; office areas exceeding one thousand (1,000) square feet in area; dwelling units; and hotel guest rooms and suites. -10- " I I I I I -II II I. I i Ii II " II II I' ,I i The two (2) way Fire Department communication system may be com- bined with the one (1) way address communication system. F. Emergency Lighting Circuits. Emergency lighting circuits shall be provided for all exit signs and in all corridors, stairwells, basements, assembly rooms, and any other public area. Such lighting shall con- form to the requirements of the National Fire Codes hereinbefore adopt- ed. G. Smoke Hatches and Approved Roof Access Ladders. Smoke hatches and approved roof access ladders shall be provided in all stairways. Such hatches shall be activated manually and by automatic smoke detec- tion devices. H. Signing. The following signs shall be provided: 1. A sign shall be posted and maintained within each stairwell enclo- sure on every floor indicating the number of the floor. 2. Each stairway and each bank of elevators shall be identified by an alphabetical letter or letters indicating the geographical location of same, such as "N" for north. "SW" for southwest, or "Mil for middle, etc. A sign indicating the letter or letters of identification shall be posted and maintained at each elevator landing and on the side of the stair door in which egress is to be made. 3. Stair re-entry signs shall be posted and maintained on each floor within each stairway and on the occupancy side of each stairway door, where applicable, indicating whether re-entry is provided into the building and the floor where such re-entry is so provided. 4. Evacuation signs shall be provided in all multi-family units indicat- ing the apartment location and proper evacuation route as well as emergency telephone numbers and directions. 5. Room identification signs shall be posted and maintained on all doors to rooms other than dwelling units. 6. Directional signs shall be posted and maintained on each floor indi- cating spartment numbers and directions. J. Keys. The following keys shall be provided: ---:.- 1. A key to the electrical, mechanical, fire alarm, and fire pump rooms shall be provided for Fire Department use and kept in the elevator key box and tag'ged to identify them properly. 2. A key to the front entrance shall be given to the Fire Department. SECTION 21. 307. Ventilation Panels. All buildings of a controlled atmos- phere design, having non-operable windows or no windows at all, shall be constructed with the Fire Department ventilation panels at all floor levels at locations determined by the Chief'of the Fire Prevention Bureau. -11- Ii I, < Ii II 'I I ! ~;-""~"""- ii I , I i i !
