ORDINANCE NO. 2697
AN ORDINANCE GRANTING CERTAIN V ARIA TIONS FOR
PROPERTIES IN THE J & R SUBDIVISION, GENERALLY
LOCATED AT THE SOUTHEAST CORNER OF THE INTER-
SECTION OF MEIER ROAD AND MARK TERRACE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 13th day of January, 1977, and on the 27th day of January, 1977, at the hour of
8: 00 p.m. , at the Public Safety Building and did hear Case No. 2-V-77, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
certain requests for variations from the front, rear, and side yard requirements of
, the Zoning Ordinance, the expansion of a non-conforming structure and the erection
of a three (3) car garage, on the lots legally described hereinbelow; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount Pros
pect the approval of the requests under said Case No. 2-V-77; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on February 10, 1977, and did review the recommendations of the
Zoning Board of Appeals in said Case No. 2-V-77; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount Pros-
pect concur in the recommendations of the Zoning Board of Appeals under said Case
No. 2-V-77; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect hav
reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEE
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 2-V-77, be-
ing legally described as follows:
The South 160.00 feet of the West 250.00 feet of the North 329.44 feet
of the South 658.83 of Lot One in Owners Division, being a subdivision
of the Southeast Quarter GJ (except the West Half CD of the Southwest
Quarter (D thereof) of Section 10, Township 41 North, Range 11, East
of the Third Principal Meridian, in Cook County, Illinois,
shall be resubdivided into three (3) lots of record pursuant to a proposed Plat of
Subdivision, being the following legal description:
J and R SUBDIVISION,
Being a Subdivision of the Southeast Quarter (n of Section 10, Town-
ship 41 North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois;

which realty is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as R-1 (Single Family Residence) District, which zoning classification shall
remain in full effect subj ect to the variations granted herein:
A. With respect to the proposed Lot No.1:
1. That the front yard adjacent to Mark Terrace be reduced to
twenty (20) feet; and
2. That the rear yard opposite the front yard adjacent to Mark
Terrace be reduced to eight feet six inches (8' 6") .
B. With respect to the proposed Lot No.3:
1. That the existing brick single family residence located upon
the subj ect property may be expanded;
2. That the side yard parallel to the west lot, line of the said
Lot No.3 be reduced to eight (8) feet;
3. That the rear yard be reduced to eleven and one-half (11!) feet;
and
4. That the proposed lot may be improved with a garage of a maxi-
mum size for the housing of three (3) motor vehicles.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Codes shall be applicable except the variations granted in SECTION ONE hereof.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accord-
ance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for building permits
pursuant to such variations is made and construction commenced within one (1) year
I of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be null and void and of no force and effect
whatsoever until after its passage, approval, and publication, and such time as an a -
curate plat resubdividing the said parcel described in SECTION ONE hereinabove is
recorded with the Recorder of Deeds of Cook County, Illinois; a copy of which plat of
resubdivision shall be attached hereto and hereby made a part hereof.
