MAYOR~J REPORT BOY SCOUT TROOP Mayor Farley acknowledged the presence of Boy' Scout Troop 235 from St. Emily's in the audience. It was noted that these Scouts were working to obtain their Merit Badge for Citizenship. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD WAIVE FEES: Rockne Bork, representing the Mount Prospect Lions Club, requested JULY 4TH LIONS CLUB the Board waive all fees and out of pocket expenses involved with CARNIVAL conducting the annual Lions Club Village Fair, which will be held June 30 through July 4th at Melas Park. Trustee Clowes, seconded by Trustee Skowron, moved to waive all fees and out of pocket expenses involved with the annual Lions Club July 4th Carnival/Village Fair. Upon roll cell: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion cerried. WAIVE FEES: A representative from the Mount Prospect Jaycees Club asked that JAYCEES the Village Board waive all fees and out of pocket expenses involved CARNIVAL with conducting the annual Mount Prospect Jaycees Carnival, which will be held May 25 - 30 at the Mount Prospect Plaza. Trustee Hoefert, seconded by Trustee Wilks, moved to waive all fees and out of pocket expenses involved with the annual Jaycees Carnival. Page 2 - April 19, 1994 OLD BUSINESS ZBA 71-Z-93 and ZBA 72-SU-93, Northeast comer of Rand Road ZBA 71-Z-93 & and Euclid Avenue ZB^ 72-SU-93 Ordinances were presented for first reading that would amend the CREEKSIDE official zoning map of the Village, rezoning the subject property from CONDOS C-R to an R-4 (Multi-Family) District; grant a special use RAND & EUCLID in the nature of a Planned Unit Development, allowing four "" 5-story buildings with a total of 200 residential condominiums; and, authorizing the execution of an amendment to the Consent Decree governing Old Orchard (65 CH 5300). These Ordinances will be presented May 3 for 2nd readings. Village Manager JanOnis stated that he plans to meet with PARKING: those people involved with this parking problem and asked that 200 N. LOUIS ST. this matter be continued to the May 17th meeting when a status report will be made. Mayor Farley continued this matter to the May 17th meeting of the Village Board. ZBA 6-CU-94, Clocktower Place, Northwest Highway/Pine/Wille ZBA 6-CU-94 Trustee Hoefert, seconded by Trustee Skowren, moved for passage of Ordinance No. 4633 ORD.NO. 4633 AN ORDINANCE GRANTING A CONDITIONAL USE IN THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWN AS MOUNT PROSPECT CLOCKTOWER PLACE Upon roll cell: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Henddcks Motion carried. Trustee Hoefert, seconded by Trustee Wilks, moved for passage ORD.NO. 4634 of Ordinance No. 4634 AN ORDINANCE AMENDING THE OFFICIAL COMPREHENSIVE PLAN OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Henddcks Motion carded. Trustee Corcoran ardved at this point in the meeting. Trustee Hoefert, seconded by Trustee Wilks, moved for passage ORD.NO. 4635 of Ordinance No. 4635 AN ORDINANCE GRANTING A MODIFICATION FROM THE DEVELOPMENT CODE FOR PROPERTY COMMONLY KNOWN AS MOUNT PROSPECT CLOCKTOWER PLACE Upon roll call: Ayes: Clowes, C0rcoran, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. Page 3 - April 19, 1994 CLOCKTOVVER Trustee Clowes, seconded by Trustee Skowron, moved to authorize PLACE PLAT OF the Mayor to sign and Clerk to attest his signature on the Clocktower SUBDIVISON Place Plat of Subdivision. PUBLIC HEARING Mayor Farley called a Public Hearing to order at 8:15 P.M., noting that the public hearing was called pursuant to proper legal notice having been published in the Mount Prospect Herald on April 6, 1994, and was for the purpose of considering the adoption of the 1994/95 budget. It was noted that the total budget for 1994 is $46,750,885 plus the Mount Prospect Library budget of $3,206,000 for a total of $49,956,885. The following residents spoke on the subject: James Lynch, 207 South Louis Mike Phelps, 206 South Louis Both residents expressed their opposition to the "user fee" taxes (utility tax, telecommunications tax) recently adopted. There being no further participation from the audience, Mayor Farley declared the Public Hearing dosed at 8:18 P.M. Trustee Clowes expressed his feeling that the cost for solid waste pick-up would be less if there was direct billing, rather than included in the property taxes. He also expressed his opposition to the creation of the various user fee taxes adopted recently. Trustee Clowes stated that since there is a savings in the solid waste contract that the Board review the need for the existing user fee taxes in the near future. Trustee Hendricks stated that he objected to increasing the number of staff members. ORD.NO. 4636 Trustee Corcoran, seconded by Trustee Wilks, moved for passage of Ordinance No. 4636 AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR COMMENCING MAY 1, 1994 TO APRIL 30, 1995 IN LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE Upon roll call: Ayes: Corcoran, Hoefert, Skowron, WiIks, Farley Nays: Clowes, Hendricks Motion carried. Page 4 - April 19, 1994 Trustee Corcoran left the meeting for a brief period. NEW BUSINESS ZBA 2-CU-94, 1814 Bonita Avenue ZBA 2-CU-94 The Petitioner is requesting a Conditional Use to allow a detached 1814 BONITA garage designed to house more than 2 motor vehicles, allowing a 528 square foot addition to the existing garage. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. In response to a question raised at the last meeting, it was noted that the Petitioner purchased his home with the existing satellite dish, however, now that the Petitioner has been informed of the · requirement for a permit and/or special use permit, the Petitioner will proceed to secure the appropriate permit. Members of the Board asked that the subject of 4-car garages be discussed at a Committee of the VVhole meeting in the near future. Trustee Clowes, seconded by Trustee Hoefert, moved to concur with the recommendation of the Zoning Board of Appeals and grant the request for an over-sized garage to accommodate 4 vehicles, provided the satellite dish is removed and installed in accordance with the Village regulations and that the addition be built of materials similar to the existing home. Upon roll call: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. An Ordinance will be presented for first reading at the May 3rd meeting of the Village Board. Trustee Corcoran returned to the meeting at this point. ZBA 9-A-94, Text Amendment ZBA 9-A-94 A Petition has been filed to amend Chapter 14 (Zoning Ordinance) Article XIV to allow a convalescent home-nursing home as a Conditional Use in an R-5 District. The Zoning Board of Appeals recommended granting this request by a vote of 6-1. It was noted that during the recent revision of the Zoning Ordinance this use was inadvertently omitted. Trustee Hoefert, seconded by Trustee Skowron, moved to concur with the recommendation of the Zoning Board of Appeals and grant the text amendment as requested in ZBA 9-A-94. Upon roll call: Ayes: Clowes, Corcoran, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. ZBA 10-Z-94 and ZBA 11-CU-94, 350 North Wolf Road ZBA 10-Z-94 & The Petitioner is requesting the Subject Property be rezoned ZBA 11-CU-94 Page 5 - April 19, 1994 from O-R (Office Research) District to R-5 (Senior Citizens Residence) District. Also requested is a Conditional Use to allow a convalescent-nursing home at 350 North Wolf Road, formerly the Winona School of Photography. The Zoning Board of Appeals recommended granting the rezoning and Conditional Use by votes of 7-0. The Petitioner explained that the intention is to open a one-story, 120 bed skilled nursing facility. It was noted that there ara no convalescent or nursing homes located within the Village of Mount Prospect. The Petitioner noted that, as required by State law, an application is pending before the appropriate State agency for a Certificate of Need and that if the Board approves these cases, it would be considered as community support for the proposal. Trustee Hendricks expressed his concern that the Petitioner COuld build a 6 story building under R-5 zoning district, however, it was pointed out that existing O-R zoning district also allows 6 story buildings. Trustee Wilks, seconded by Trustee Corcoran, moved to concur with the recommendation of the Zoning Board of Appeals and grant the R-5 zoning district, as requested in ZBA 10-Z-94. Trustee Skowron, seconded by Trustee Corcoran, moved to amend the main motion to place a restriction of 3-stories (30 feet) on the subject property. Upon roll call: Ayes: Corcoran, Hoefert, Skowron, Wilks Nays: Clowes, Hendricks Motion carried. AMEND CH. 18 An Ordinance was presented for first reading that would amend MAPLE STREET Chapter 18 (Traffic Code) of the Village Code to establish traffic Page 6 - April 19, 1994 control regulations on the west side of Maple Street between Northwest Highway and Busse Avenue, which amendment would allow 2 hour parking on weekdays. Trustee Clowes, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an Ordinance. An Ordinance was presented for second reading that would AMEND CH. 22 amend Chapter 22 by increasing the water and sewer rates. WATER/SEWER RATES Trustee Wilks, seconded by Trustee Corcoran, moved for passage of Ordinance NO. 4638 ORD.NO. 4638 AN ORDINANCE AMENDING ARTICLE IV ENTITLED "WATER AND WATER SUPPLY" AND ARTICLE V ENTITLED "METERS AND RATES" OF CHAPTER 22 OF THE VILLAGE CODE Upon roll call~ Ayes: Clowes, Corcoren, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. A Resolution was presented that expressed the intent of the Village DISSOLVE to dissolve the Cultural Trust as of June, 1995. This action is a CULTURAL a result of the lack of financial support from the community for an TRUST auditorium at Lincoln Jr. High School. Trustee Corcoran, seconded by Trustee Hoefert, moved for passage RES.NO. 16-94 of Resolution No. 16-94 A RESOLUTION DISSOLVING THE MOUNT PROSPECT CULTURAL TRUST COOPERATIVE Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. Page 7 - April 19, 1994 MFT FUNDS A Resolution was presented that would authorizing the appropriation of Motor Fuel Tax (MFT) Funds in the amount of $1,350,000 for the resurfacing program for 1994. EMPLOYEE A request was presented to renew the contract with ComPsych to ASSISTANCE provide the Employee Assistance Program for fiscal year 1994/95 at PROGRAM (EAP) a cost of $19.50 per employee, which based on 273 employees, would be $5,323.50. Trustee Clowes, seconded by Trustee Corcoran, moved to concur with the recommendation of the administration and renew the contract with ComPsych to administer the Employee Assistance Program at a cost not to exceed $19.50 per employee. Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Hoefert, Skowron, Wilks ; Nays: None Motion carried. VILLAGE MANAGER'S REPORT BID RESULTS: Village Manager Michael E. Janonis presented the following bid results. CABLE T.V. The following bids were received for (3) three-chip (CCD) replacement CAMERAS & cameras and the maintenance contract and an option to re- MAINTENANCE engineer the Control Room: Cameras: Bidder Amount Swiderski Electronics $ 32,845.00 Video Images $ 37,634.00 Maintenance & Re-engineering Bidder Maintenance Re-Enqineerin.q Swiderski Electronics $ 29,995.00 $14,085.00 Video Images $ 23,688.42 $19,520.00 It was noted that the bids received exceed the budgeted amounts therefore the administration requested the Board to reject all bids and staff will re-draft the specifications and re-bid these items. Page 8- Apd119,1994 Trustee Corcoran, seconded by Trustee Hoefert, moved to concur REJECT BIDS with the recommendation of the administration and reject all bids received for (3) three-chip replacement cameras, the maintenance contract and the optional bids to re-engineer the Control Room. Mr. Janonis stated that Old Orchard Colony Country recently OLD ORCHARD experienced a broken water main and until it was determined COLONY COUNTRY whether the water main was the responsibility of the Village or WATER MAIN the Homeowners Association, the Master Homeowners Association REPAIRS hired a contractor and paid for the repair at a cost of $7,079.00. It has since been determined that the Village had accepted responsibility for the water and sewer mains within this development and therefore it would be appropriate to reimburse the Homeowners Association for this expense. Trustee Hoefert, seconded by Trustee Corcoran, moved to concur with the recommendation of the administration and authorize payment be made to reimburse the Old Orchard Colony Country Homeowners Association for the water main repair in January,1994, in the amount of $7,079.00. TRUSTEE COMMENTS None ANY OTHER BUSINESS Trustee Hendricks asked for information as to whether there is a Code 1009 NA WA TA violation at 1009 Na Wa Ta Trail, noting that he observed a boat parked in the front yard. The Village Manager stated that staff is looking into this matter. EXECUTIVE SESSION Trustee Hoefert, seconded by Trustee Wilks, moved to adjourn into EXECUTIVE Executive Session for the purpose of determining if the minutes of SESSION Executive Sessions can be released from confidential status and to discuss subjects involving Personnel and Litigation.
