AN ORDINANCE GRANTING A SPECIAL USE FOR
PROPERTY GENERALLY LOCATED NORTH OF
RAND ROAD AND SOUTH OF CENTRAL ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case 10-Z/SU-77 pertaining to a request for certain
special uses pursuant to the Mount Prospect Zoning' Ordinance to permit certain
uses upon the property hereinafter described; and
l'l'HEREAS, the Building Committee of the Board of Trustees of the Village of Iilount
Prospect did meet on June 6, 1977, and did consider the recommendations of the
Zoning Board of Appeals under Case No. 10-Z/SU-77; and
B. That the said special use granted in SECTION TWO hereinbelow shall
not run with the land, but shall be limited to that period of time wherein
the subject property is occupied as a Burger King Restaurant.
SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in
accord with the terms and conditions of this Ordinance, the following special
use is hereby authorized upon the subject property described in SECTION THREE
hereinbelow:
The operation of a dr~ve-in restaurant.
SECTION THREE: That the special use authorized to be established in SECTION
TWO hereinabove shall be valid and effective upon the following property,
hereinabove and hereinafter referred to as "subject property", legally described
as:

That part of the Northwest Fractional Quarter of Section 7. Township 41
North. Range 12. East of the Third Principal Meridian . Bounded and
described as follows: Beginning at the Northwest corner of Lot 12 in
Arthur T. McIntosh & Co.' s Des Plaines Acres, a Subdivision of part of
the Northwest Fractional Quarter of said Section 7; thence West parallel
to the North line of said Northwest Fractional Quarter for a distance of
397 . 54 feet. to a point of curve; thence on the arc of a circle .convex
Westerly, tangent to the last described course having a radius of 20 feet,
for a distance of 5 L 40 feet (as measured on said arc) to its point of
tangency with a line 50 feet Northeasterly of and parallel to the Center
Line of Rand Road as now located; thence Southeasterly on Said parallel
line for a distance of 487.44 feet to the Southwest corner of Lot 13 in
Said Arthur T. McIntosh and Co.' s Des Plaines Acres; thence North on the
West line of L~ts 13 and 12 aforesaid, for a distance of 300.56 feet to the
point of beginning, Excepting therefrom that part lying West of a line 167.63
feet West of and parallel to the West line of said Lots 12 and 13 (as measured
on the North line of said tract) all in Cook County, Illinois.-
